| 17 | Section L, Paragraph 7.8, item iii | Page 131 |
Please clarify the Governments intent with pricing; should offerors price in the CBA escalation into their pricing models or not?
| Regardless of a WD or CBA, offerors should straight-line the rates after the first pricing period and through all option periods. Per FAR 52.222-43(b), “The Contractor warrants that the prices in this contract do not include any allowance for any contingency to cover increased costs for which adjustment is provided under this clause.” Thus, contract price should include amounts for known or projected increases in wage rates, fringe benefits, or allowable accompanying costs that may become effective after the first pricing period of the contract. This also requires exclusion of any collective bargaining agreement (CBA) increases scheduled to become effective after the end of the first pricing period. However, any CBA increases effective or scheduled to become effective at any time during the first pricing period should be included in the contract price for all pricing periods and options. | |||

| 20 | Attachment 3, Wage Determination and Attachment 11, CBA | FAR 22.1008-2 | In order to meet the established legal obligations and to accurately estimate the actual costs and obligations incurred by successful offerors, would the Government please provide offerors with a seniority list of employees currently covered by the CBA or a distribution of seniority for each labor category noted in the solicitation? |
| Additionally, offerors require the seniority list (or a distribution of seniority chart) to accurately calculate the number of support personnel needed to offset labor shortages created by annual vacation entitlement for staff (which vary by seniority of individual staff). | The Government is working a response. | |||
| 21 | Attachment 3, Wage Determination and Attachment 11, CBA | FAR 22.1008-2 | For the Pricing Models, how does the Government want Offerors to bid the CBA wage determination? |
• For the base period of the contract only
• Through the expiration of the current CBA (15 February 2018)
• Through the end of the Period of Performance to include Option Years
Please clarify how the Government would like us to bid the CBA across the solicitation period of performance in order to assure a common, accurate comparison of offeror TEP.
| 22 | Attachment 3, Wage Determination and Attachment 11, CBA | FAR 22.1008-2 | Given the dependence and variability that offeror pricing will have based on Government responses to these questions, will the Government grant Offerors an extension for submittal until 30 days after the Questions and Answers are provided? | Amendment 02 was issued to extend the proposal due date to 23 Feb 16. |
