| QUESTION: Can the Government please clarify the intent of this language? Are there under-funded pension liabilities with the current contractor’s plan that would require a successor contractor to incur some hidden liabilities? If so, does the government intent to allow a one time adjustment to compensate for these costs after award? | RESPONSE: The requirements of the Service Contract Act apply to this contract; the intent of the language is to clarify a successor contractors responsibility under Section 4(c ) of the Act. You are referred to the DOL regulations 29 CFR Part 4 for a full statement of the obligations of a successor contractor. Should you have specific questions regarding your obligations under the Act, you should address these questions to the US Department of Labor Wage and Hour Division. |
The predecessor contractor is responsible for all benefit liabilities incurred as a result of the Service Contract Act through the last date of their performance of the contract.

The aircraft’s canopy seals will be removed and an internal radiation survey will be performed when the aircraft is re-painted in March 2008. Aircraft radiation surveys are performed by the Base Bioenvironmental Engineer (BEE), not the Contractor. The contractor only notifies the BEE when radiations surveys are due. |
