Task 6 – Permitting (Gulfside component and Soundside component) (Revised from TA5)

Description Task 6: The following state and federal permits are anticipated:

• DEP Environmental Resource Permit (ERP) - An ERP Joint Application will be prepared and submitted to the DEP District Office and a response to comments from District staff submitted as needed. Documentation of wetlands and other environmental features on the site will be provided by the sub-consultant, Scheda. The ERP Joint Application will serve to jointly apply for the USACE Dredge and Fill Permit, if needed. Up to two (2) meetings with DEP regulatory staff are anticipated including a pre-application after acceptance of 30% Construction Documents by the DEP Project Manager. One (1) response to comments from DEP regulatory staff will be provided.

• DEP Coastal Construction Control Line Permit (CCCL) –The Consultant will prepare the DEP CCCL permit application and documentation submittal for the Project. The Consultant will schedule an initial meeting with the Bureau of Beaches and Coastal Systems to review the 30% Construction Documents and solicit concerns and/or recommendations.

• USACE Dredge and Fill Permit – On July 25, 2011, the USACE issued a State Programmatic General Permit (SPGP IV-R1) that delegated general authority for administration of limited portions of Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. Part b. of the SPGP IV-R1 applies to Boat Ramps and Boat Launch Areas and Structures Associated with Such Ramps or Launch Areas. At this time, it appears that the Project as proposed will receive a “green” rating under the SPGP IV-R1 agreement which will require minimal regulatory intervention by the

USACE.

If, upon review by DEP, it is determined that SPGP IV-R1 does not apply, additional services will be requested to meet with USACE staff at a Pre-Application Conference, and provide responses to one (1) set of comments.

• Apply for all Santa Rosa County Land Development permits.

Description Subtask 6.1: Permit Pre-application Meeting(s) (Gulfside component and Soundside component) Upon approval of the 30% Construction Documents, the Consultant, in coordination with the DEP Project Manager, will prepare for and arrange to meet with the Santa Rosa County Development Review and Permitting staff, DEP regulatory staff and the USACE for pre-application meeting(s) to review the Project’s

The Consultant will also provide one (1) paper copy and one (1) digital copy of any additional correspondence with permitting authorities following the pre-application meetings to the DEP Project Manager. Description Sub-Task 6.4 The initial solicitation for bids on the combined Gulfside and Soundside project was canceled and all bids received on this project were rejected. Solicitations for construction bids will be reissued as two (2) individual projects for the Gulfside and Soundside components. Because of these changes, the time frame required to rebid the project and begin construction would go beyond the current DEP CCCL permit’s expiration date and will require the Consultant to prepare a request from DEP for the extension of the CCCL permit’s expiration date. The Consultant will prepare a request for an extension of the CCCL permit. The request for the CCCL extension will also require an additional application fee for the extension.

Deliverables Subtask 6.4: The Consultant shall provide to the DEP Project Manager; a copy of the application for extension of the CCCL and proof of payment made to DEP for the request to extend the CCCL permit.
