About this file

This file is an attachment to a federal contract opportunity that provides the contractor on-boarding and off-boarding process for the Bureau of Reclamation, including required forms and a PowerPoint presentation on personnel security vetting.

The on-boarding process requires contractors to complete multiple security and employment forms: Form 7-2682 (Request for Initiation of Contractor Background Investigation), Optional Form OF-306 (Declaration for Federal Employment), Form 7-2695 (Fair Credit Reporting Act Release for Tier 2-5 investigations), and Form 7-2696 (Noncriminal Justice Applicant's Privacy Rights). Contractors must also submit a Statement of Work or description of duties, resume, and Position Designation Record. The security vetting process is governed by Homeland Security Presidential Directive 12 (HSPD-12), OMB Memo M-19-17, and Reclamation Manual Section SLE 01-01, which mandate that all federal employees and contractors performing work on behalf of the U.S. government be credentialed with a Personal Identity Verification (PIV) card. Contractor responsibilities include completing all on-boarding tasks within communicated timeframes, providing truthful information on security questionnaires, completing fingerprinting at a US Access Credentialing Center, and renewing credentials as required. The Security Office reviews packets within three days of receipt, applicants have seven days to complete the electronic application (e-APP), and Security provides pre-employment fitness determinations within one business day. Non-U.S. citizens must have a minimum of three years of continuous residency in the United States immediately preceding federal affiliation to be eligible for PIV credential issuance.

Form Approved:

OMB No. 3206-0182 Declaration for Federal Employment*

(*This form may also be used to assess fitness for federal contract employment)

Instructions The information collected on this form is used to determine your acceptability for Federal and Federal contract employment and your enrollment status in the Government's Life Insurance program. Most applicants are asked to complete this form after a tentative offer of employment has been made; however, depending on your position, you may be asked to complete this form earlier during the hiring process. Follow instructions that the agency provides. Before you are appointed you will be asked to update your responses on this form and on other materials submitted during the application process and then to recertify that your answers are true.

All your answers must be truthful and complete. A false statement on any part of this declaration or attached forms or sheets may be grounds for not hiring you, or for firing you after you begin work. Also, you may be punished by a fine or imprisonment (U.S. Code, title 18, section 1001).

Either type your responses on this form or print clearly in dark ink. If you need additional space, attach letter-size sheets (8.5" X 11").

Include your name, Social Security Number, and item number on each sheet. We recommend that you keep a photocopy of your completed form for your records.

Privacy Act Statement The Office of Personnel Management is authorized to request this information under sections 1302, 3301, 3304, 3328, and 8716 of title 5, U. S. Code. Section 1104 of title 5 allows the Office of Personnel Management to delegate personnel management functions to other Federal agencies. If necessary, and usually in conjunction with another form or forms, this form may be used in conducting an investigation to determine your suitability or your ability to hold a security clearance, and it may be disclosed to authorized officials making similar, subsequent determinations.

Your Social Security Number (SSN) is needed to keep our records accurate, because other people may have the same name and birth date. Public Law 104-134 (April 26, 1996) asks Federal agencies to use this number to help identify individuals in agency records. Giving us your SSN or any other information is voluntary. However, if you do not give us your SSN or any other information requested, we cannot process your application. Incomplete addresses and ZIP Codes may also slow processing.

ROUTINE USES: Any disclosure of this record or information in this record is in accordance with routine uses found in System Notice OPM/GOVT-1, General Personnel Records. This system allows disclosure of information to: training facilities; organizations deciding claims for retirement, insurance, unemployment, or health benefits; officials in litigation or administrative proceedings where the Government is a party; law enforcement agencies concerning a violation of law or regulation; Federal agencies for statistical reports and studies; officials of labor organizations recognized by law in connection with representation of employees; Federal agencies or other sources requesting information for Federal agencies in connection with hiring or retaining, security clearance, security or suitability investigations, classifying jobs, contracting, or issuing licenses, grants, or other benefits; public and private organizations, including news media, which grant or publicize employee recognitions and awards; the Merit Systems Protection Board, the Office of Special Counsel, the Equal Employment Opportunity Commission, the Federal Labor Relations Authority, the National Archives and Records Administration, and Congressional offices in connection with their official functions; prospective non-Federal employers concerning tenure of employment, civil service status, length of service, and the date and nature of action for separation as shown on the SF 50 (or authorized exception) of a specifically identified individual; requesting organizations or individuals concerning the home address and other relevant information on those who might have contracted an illness or been exposed to a health hazard; authorized Federal and non-Federal agencies for use in computer matching; spouses or dependent children asking whether the employee has changed from a self-and-family to a self-only health benefits enrollment; individuals working on a contract, service, grant, cooperative agreement, or job for the Federal government; non-agency members of an agency's performance or other panel; and agency-appointed representatives of employees concerning information issued to the employees about fitness-for-duty or agency-filed disability retirement procedures.

Public Burden Statement Public burden reporting for this collection of information is estimated to vary from 5 to 30 minutes with an average of 15 minutes per response, including time for reviewing instructions, searching existing data sources, gathering the data needed, and completing and reviewing the collection of information. Send comments regarding the burden estimate or any other aspect of the collection of information, including suggestions for reducing this burden, to the U.S. Office of Personnel Management, Reports and Forms Manager (3206-0182), Washington, DC 20415-7900. The OMB number, 3206-0182, is valid. OPM may not collect this information, and you are not required to respond, unless this number is displayed.

NONCRIMINAL JUSTICE APPLICANT’S

PRIVACY RIGHTS (PR)

As an applicant who is the subject of a national fingerprint-based criminal history record check for a noncriminal justice purpose (such as an application for employment or a license, an immigration or naturalization matter, security clearance, or adoption), you have certain rights which are discussed below.

• You must be provided written notification1 that your fingerprints will be used to check the criminal history records of the FBI.

• You must be provided, and acknowledge receipt of, an adequate Privacy Act Statement when you submit your fingerprints and associated personal information. This Privacy Act Statement should explain the authority for collecting your information and how your information will be used, retained, and shared.2

• If you have a criminal history record, the officials making a determination of your suitability for the employment, license, or other benefit must provide you the opportunity to complete or challenge the accuracy of the information in the record.

• The officials must advise you that the procedures for obtaining a change, correction, or update of your criminal history record are set forth at Title 28, Code of Federal Regulations (CFR), Section 16.34.

• If you have a criminal history record, you should be afforded a reasonable amount of time to correct or complete the record (or decline to do so) before the officials deny you the employment, license, or other benefit based on information in the criminal history record.3

You have the right to expect that officials receiving the results of the criminal history record check will use it only for authorized purposes and will not retain or disseminate it in violation of federal statute, regulation or executive order, or rule, procedure or standard established by the National Crime Prevention and Privacy Compact Council.4

If agency policy permits, the officials may provide you with a copy of your FBI criminal history record for review and possible challenge. If agency policy does not permit it to provide you a copy of the record, you may obtain a copy of the record by submitting fingerprints and a fee to the FBI. Information regarding this process may be obtained at https://www.fbi.gov/services/cjis/identity-history-summary-checks.

If you decide to challenge the accuracy or completeness of your FBI criminal history record, you should send your challenge to the agency that contributed the questioned information to the FBI. Alternatively, you may send your challenge directly to the FBI. The FBI will then forward your challenge to the agency that contributed the questioned information and request the agency to verify or correct the challenged entry. Upon receipt of an official communication from that agency, the FBI will make any necessary changes/corrections to your record in accordance with the information supplied by that agency. (See 28 CFR 16.30 through 16.34.)

Privacy Act Statement for Fingerprints

Authority: The FBI’s acquisition, preservation, and exchange of fingerprints and associated information is generally authorized under 28 U.S.C. 534. Depending on the nature of your application, supplemental authorities include Federal statutes, State statutes pursuant to Pub. L. 92-544, Presidential Executive Orders, and federal regulations. Providing your fingerprints and associated information is voluntary; however, failure to do so may affect completion or approval of your application.

Principal Purpose: Certain determinations, such as employment, licensing, and security clearances, may be predicated on fingerprint-based background checks. Your fingerprints and associated information/biometrics may be provided to the employing, investigating, or otherwise responsible agency, and/or the FBI for the purpose of comparing your fingerprints to other fingerprints in the FBI’s Next Generation Identification (NGI) system or its successor systems (including civil, criminal, and latent fingerprint repositories) or other available records of the employing, investigating, or otherwise responsible agency. The FBI may retain your fingerprints and associated information/biometrics in NGI after the completion of this application and, while retained, your fingerprints may continue to be compared against other fingerprints submitted to or retained by NGI.

7-2696 (10-2022)

Routine Uses: During the processing of this application and for as long thereafter as your fingerprints and associated information/biometrics are retained in NGI, your information may be disclosed pursuant to your consent, and may be disclosed without your consent as permitted by the Privacy Act of 1974 and all applicable Routine Uses as may be published at any time in the Federal Register, including the Routine Uses for the NGI system and the FBI’s Blanket Routine Uses. Routine uses include, but are not limited to, disclosures to: employing, governmental or authorized non-governmental agencies responsible for employment, contracting, licensing, security clearances, and other suitability determinations; local, state, tribal, or federal law enforcement agencies; criminal justice agencies; and agencies responsible for national security or public safety.

Start

Processing Considerations

• Security Office handles cases in a “first-in” manner. Cases do not get pushed to the front of the que based on requested start dates.

• Every case is different. The complexity of an applicant’s background has a significant impact on the time it will take the Security Office to review and reach approval.

• The most common stall point in timeliness is slow/unresponsive applicants. It is critical for the COR/PM to stress that applicants provide a good email that is regularly monitored.

**CORs /PMs are not to authorize a contractor start date until official authorization is received from the Security Office advising the individual has been cleared for pre-employment screening.

Processing Timeline

• Security Office will review packet submissions from COR/PMs within 3 days of receipt.

• If the packet is complete, the Security Office will invite the applicant to complete the e-APP. **Applicant must submit fingerprints through Identity Management Office.**

• Incomplete packets get sent back to the COR/PM and require resubmission.

• Applicant is afforded 7 days to complete e-APP.

• Security Office will review e-APP & fingerprint results within 3 days of applicant’s completed release to the Security Office.

• Omissions, errors or suitability issues discovered during the review will result in a pause in the process. Nothing can move until errors/issues are corrected/mitigated.

• The Security Office will notify the COR/PM within 1 business day upon reaching a pre-employment fitness determination.

• Favorable determinations result in an approval from Security to onboard/begin work.

• Unfavorable determinations result in denial/end of process.

What constitutes a complete Security Packet?

• Reclamation Form 7-2682, Request for Initiation of Contractor

Background Investigation

• SOW or description of duties being performed

• Resume

• Completed Form 7-2696, Fingerprint Privacy Rights

• Completed Form 7-2695, Fair Credit Form (For Tier 2 through Tier 5)

• Completed OF-306

• Position Designation Record (This is the output from using the Position Designation Tool)

• SOW or description of duties being performed.

• SOW/description of duties should be used by the COR/PM in conjunction w/ OPM’s

Position Designation Tool to determine the appropriate Risk & Position Sensitivity of the tasks being performed.

• Security Office compares the SOW/description of duties against the Position Designation Record to ensure the proper investigation is ordered.

• Resume

• Security uses the resume to reconcile employment and residence information which are provided in additional security questionnaires.

• Any format, any style is fine! Basic information needed: Full name, contact information and work history.

• Form 7-2695- Fair Credit Reporting Act Release

• Needs to be in the Security packet for all Tier 2 thru Tier 5 applicants.

• Security may reach back to the applicant for this form on a Tier 1 if there are disclosed financial issues.

• Easy to complete. Printed name and an appropriate applicant signature.

• Form 7-2696 – Fingerprint Privacy Rights

• All applicants regardless of investigation level are required to acknowledge the use of their collected fingerprints. This form informs them of the use and their rights.

• Easy to complete. Printed name and a signature.

• OF-306- Declaration of Federal Employment

• Items 1 through 17a must be answered.

• Applicant must sign Item 17a.

• Most common mistakes that hold up the process:

• Item 7 is skipped

• Any “YES” answers on questions 9-13 are inadequately addressed by the applicant in the narrative statement, which is required for a “YES” answer.

Credentialing Standards for Non-U.S. Citizens

• Due to limitations that apply to the employment of non-U.S. citizens and the ability to collect background investigation information in locations outside the United States, special considerations apply when a PIV credential is needed for a non-U.S. citizen.

• Non-U.S. citizens must have a minimum of 3 years of continued residency in the U.S. immediately preceding the start of Federal affiliation.

• Non-U.S. citizens with less than 3 years of continued residency immediately preceding the start of Federal affiliation are not eligible for a Low Risk (Tier 1) or Public Trust (Tier 2 & Tier 4) background investigations, thus the issuance of a PIV credential is prohibited.
