About this file
This is a Commercially Useful Function (CUF) Certification form required by the State of California Department of Cannabis Control for RFP 2026-001, issued June 19, 2026. Bidders must complete and submit this form with their proposals to demonstrate that any certified Small Business (SB), Micro Business (MB), and/or Disadvantaged Veteran Business Enterprise (DVBE) contractors, subcontractors, or suppliers meet the commercially useful function requirements mandated under California Government Code Section 14837, Military and Veterans Code Section 999, and Title II California Code of Regulations Sections 1896.4 and 1896.62. The certification applies to both prime contractors and subcontractors claiming SB, MB, or DVBE preferences.
Bidders must affirmatively answer five specific questions to establish that the certified business is responsible for executing a distinct contract element, actually performing or managing the work, conducting services normal to its business operations, controlling procurement decisions for all required goods and materials (or marking N/A for service-only contracts), and not excessively subcontracting beyond normal industry practices. A negative response to any question except question four (when marked N/A) may result in the proposal being deemed non-responsive. Bidders must provide a written statement detailing the role, services, and goods the subcontractor will provide to meet CUF requirements, or indicate "Not claiming a preference" if not pursuing SB or DVBE set-asides. The bidder's authorized representative must sign and certify compliance with these requirements, with the State retaining the option to request additional clarifying information prior to award.
