About this file

This document is Federal Acquisition Regulation (FAR) provision 52.212-2, which establishes the evaluation criteria and award basis for a commercial products and services solicitation using the Lowest Price Technically Acceptable (LPTA) selection process.

The Government will award a contract to the responsible offeror with the lowest evaluated price who receives an "Acceptable" rating in technical capability. Evaluation will be based on three factors: (1) Technical Capability, (2) Past Performance, and (3) Price. All offerors must receive an "Acceptable" rating for each factor and sub-task to be eligible for award; any unacceptable rating or deficiency renders the response ineligible. Technical Capability evaluations assess the quoter's ability to meet minimum requirements across four tasks: Phase In Period (personnel onboarding within 10 days of award), Mobilization Plan to Establish Services (comprehensive schedule for personnel and equipment deployment with full operational status by July 15), Compliance with Sustainment and Maintenance Plan (24-hour availability for repairs and emergency services), and Capability to Surge Base Life Support Services (surge support for 700 to 1,500 personnel within 14 days). Past Performance evaluation considers relevant experience from contracts completed within five years, with offerors submitting no more than three references similar in scope, magnitude, and complexity to the solicitation requirements. Price evaluation uses price analysis to ensure fair and reasonable pricing; the Government will calculate Total Evaluated Price by adding all Contract Line Item Numbers except Defense Base Act Insurance and will assess potential unbalanced pricing. Clarifications are permitted with all offerors, and the LPTA process does not permit tradeoffs between price and non-price factors.

52.212-2 - EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

(NOV 2021)

Basis for Award. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:

a) Technical Capability

b) Past Performance

c) Price

This competitive best value selection will be conducted using the Lowest Price Technically Acceptable (LPTA) selection process in accordance with Federal Acquisition Regulation (FAR) part 13, Simplified Acquisition Procedures and FAR part 12, Acquisition of Commercial Items.

Although the technical capability factor is of paramount consideration in the award of the contract, past performance and price are also important to the overall contract award decision.

One award will be made to the offeror who is deemed responsible in accordance with FAR Part 9, whose quote conforms to the solicitations requirements and is the lowest evaluated price with an “Acceptable” rating in the technical capability assessment.

Quotes that exceed the evaluation criteria will not receive higher ratings. If an offeror fails to meet all solicitation requirements, the Government may not make an award to that offeror. The LPTA source selection process does not permit tradeoffs between price and non-price factors.

The Government intends to evaluate quotes and award a contract with clarifications permitted with all offerors. The offeror’s initial quote should contain the offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct clarifications if the Contracting Officer (KO) later determines them to be necessary.

An Offeror must receive a rating of acceptable for each factor and sub-task. Failure to meet the criteria will render the response not eligible for award. The Government will not make an award to any Offeror with an unacceptable rating or a deficiency in ANY factor or sub-task.

(a) Factor 1 – Technical Capability:

The technical plan reflects the degree to which the offeror’s quote meets or does not meet the operational requirements. The government will evaluate the technical plan for each task listed below to ensure it is acceptable. Technical Capability evaluations provide an assessment of the quoter’s capability to satisfy the Government’s minimum requirements.

Task A: Phase In Period: Contractor’s ability to have personnel on board during the first ten (10) days after contract award date so the contractor can become familiar with performance requirements to commence full performance of services at the end of the phase-in period.

Task B: Mobilization Plan to Establish Services. This task involves the offeror providing a comprehensive schedule for how personnel and equipment will be mobilized to provide services on-site. All services need to be fully operational by 15 July. Your schedule must indicate the priority for providing sufficient billeting, power, and fuel capabilities immediately.

Task C: Compliance with Sustainment and Maintenance Plan. Offeror provides a plan that includes a schedule for sustaining services for all scheduled and unscheduled maintenance. Contractor must also provide a plan for 24-hour availability to respond and perform repairs, emergency services, and mission-critical maintenance necessary to sustain Base Life Support operations on-site.

Task D: Capability to Surge Base Life Support Services. The contractor outlines their capability to provide surge support for all base life support services for up to 700 to 1500 personnel within a (14) day timeframe (as outlined in PWS 5.13).

Technical Approach - Acceptable / Unacceptable Rating Rating Description

Acceptable Technical Plan clearly meets the minimum requirements of the solicitation

Unacceptable Technical Plan does not clearly meets the minimum requirements of the solicitation

(b) Factor 2 - Past Performance:

The Government will assess the quoter’s recent and relevant past experience and performance as a measure of the Government’s confidence in the likelihood of the quoter to successfully performing based on previous and current contract efforts.

Recent past performance is defined as five (5) years or less from the solicitation release date; relevant in terms of size, scope, and complexity.

• Offerors shall include relevant past performance information in their technical plan for evaluation.

• Offerors must submit no more than three (3) past performance references for contracts completed within the past five (5) years. References must be similar in scope, magnitude, and complexity to the requirements set forth in this solicitation. Offerors can include references in their technical plan.

The Government will evaluate past performance based on information and references provided by the offeror, other relevant past performance information obtained from other sources known to the Government, and any information supplied by the offeror concerning problems encountered on the identified contracts, as well as corrective action taken.

Past Performance - Acceptable / Unacceptable Rating Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown

(c) Factor 3 – Price:

Price will be evaluated using the price analysis process to ensure the Government receives a fair, reasonable and balanced price. If the Government cannot determine the proposed pricing to be fair and reasonable, then “Other Than Certified Cost and Pricing Data” will be obtained from the offeror. The Government will evaluate offers for award purposes by adding the total price for all Contract Line Item Numbers (CLINS). In addition to the price analysis, price quotations will be analyzed to identify any potential unbalanced pricing. If the Government sees a wide variation in proposed contract line item prices, the Contracting Officer will engage with the vendor as soon as possible during the initial evaluation of quotes so the appropriate personnel may seek clarity through offeror clarifications. Absent any issues related to the stated requirement, unbalanced pricing may pose an unacceptable risk to the Government and may be a reason to reject an offeror’s quote.

There is an expectation of competition for this requirement. Offerors are cautioned to present their best price quote. The offeror’s price quote shall represent the offeror’s best effort to respond to the requirement.

The Government will evaluate proposals for award purposes by adding the price for all CLINs except Defense Base Act Insurance to calculate the Total Evaluated Price.
