About this file
This document is a limited source justification for ballistic shields. The US Marshals Service requires National Level IIIA Ballistic Armor Shields from Atlantic Diving Supply, Inc., the current contract holder under GS-07F-5965P. The justification utilizes FAR 52.217-8 to bridge a six-month extension from September 21, 2023 to March 20, 2024 while the Federal Bureau of Investigation evaluates a potential Department of Justice-wide ballistic shields contract. Market research found Atlantic Diving Supply, Inc. is currently the only vendor that can meet USMS requirements for NIJ 0108.01 and NIJ STD 01001.06 standards. Awarding competitively at this time is not expected to yield savings. The total estimated value of the six-month extension is redacted.

Description of Supply or Service
Atlantic Diving Supply (ADS), Inc. is the current contract holder that provides National Level IIIA Ballistic Armor Shields for various USMS Districts and Divisions throughout the agency. The required equipment will provide added protection for Deputy U.S. Marshals to ensure operational effectiveness as well as enhance law enforcement safety.
Estimated Total Value The total estimated value of the 6-months 52-217-8 extension is
Vendor’s / Brand Name ADS, Inc., GSA Contract Number: GS-07F-5965P
Indicate Authority for Limiting Sources FAR 8.405-6(a)(1)(B) Only one source is capable of providing the supplies or services required at the level of quality required.
Reason for Soliciting Only One Source
The proposed contract action is a bridge action using the authority of FAR 8.405-6(a)(1)(B) to exercise 52.217-8.
FAR 52.217-8 was initially included in 15M104-18-Q-A41-00017.
However, due to an inadvertent administrative error the option to extend services was not priced at the time of award.
The original period of performance is one year base with four one-year options from 9/21/2018 – 9/20/2023, with the option to extend services for up to an additional six months via FAR 52.217-8. The total period of performance is not to exceed 5 years and six months.
During this contract period, the Training Division (TD) has been working with the Federal Bureau of Investigation (FBI) on exploring a Department of Justice (DOJ) Wide Ballistic Armor Shields contract.
At this time the DOJ Wide contract for these supplies is under evaluation. TD was notified that the FBI released its Ballistic Shields solicitation, and it was officially posted on SAM.gov until 6/30/2023.
This bridge action is necessary to ensure the continuation of the ability to purchase Ballistic Shields while the FBI contract is pending award.
ADS, Inc is currently delivering these products to USMS. An informal analysis of the market was conducted on July 17, 2023, using Google.
The research indicates that there are vendors that can meet the USMS ballistic shield requirements of NIJ 0108.01 and NIJ STD 01001.06, however it was determined that competitively awarding this work to a new contractor for the period covered by 52.217-8 is not expected to result in any saving to the USMS.
FAR Part 8 LSJ for Ballistic Shields Incorporate 52.217-8 Action - M-23-A46-R-000114
Based on the above, it is in the government’s best interest to utilize FAR 52.217-8 for the period of 9/21/2023 – 3/20/2024.
