About this file

This document is a Sole Source Justification (SSJ) for a contract modification with the National Center for Missing and Exploited Children (NCMEC) by the United States Marshals Service (USMS). The modification extends the current contract (15M10320PA4100221) for nine days from 09/21/2025 to 09/30/2025, utilizing FAR clause 52.217-8. The contract involves the Sex Offender Tracking Team (SOTT), which provides specialized analytical resources to support the Investigative Operations Division (IOD) and Sex Offender Investigative Branch (SOIB) in locating missing and exploited children, tracking non-compliant sex offenders, and supporting law enforcement agencies.

The justification emphasizes NCMEC's unique qualifications, including its congressionally mandated mission, Department of Justice funding, and specialized analytical capabilities. The total cost for ten NCMEC analysts for nine days is $26,262.52, with the government anticipating approximately 5% cost savings. The document notes that no other vendors are authorized to perform these services, and competition is not sought due to the USMS's discretionary authority to assist in child protection under the Justice for Victims of Trafficking Act of 2015. The contract will be posted on Sam.gov 14 days after full execution.

Contractor’s unique qualifications

The proposed contract action is to use the authority of FAR 6.302-1 (41 USC 3304(a)(1)) to exercise FAR 52.217-8.

FAR 52.217-8 was included in the RFQ 15M10320PA4100221. However, due to an inadvertent error, the option to extend services was not priced at the time of the award.

The original period of performance (PoP) was one base year with four one-year options from 09/21/2020 – 9/20/2025 with the option to extend services for up to an additional six months via 52.217-8. The solicitation stated the total duration shall not exceed 5 years and 6 months.

The National Center for Missing & Exploited Children (NCMEC) is a private, non-profit corporation established in 1984 by John and Reve Walsh and other child advocates. In October 2018, the Missing Children’s Assistance Act of 2018 (Public Law 115-267) amended and updated the Missing Children’s Assistance Act and reauthorized appropriations for NCMEC through 2023. It was reauthorized through 2028 (Public Law 118-65). In 1984, the Department of Justice passed the Missing Children's Assistance Act, establishing a National Resource Center and Clearinghouse on Missing & Exploited Children. It is administered by the Department of Justice through the Office of Juvenile Justice and Delinquency Prevention.

NCMEC’s mission is to help find missing children, reduce child sexual exploitation, and prevent child victimization.

NCMEC works with families, victims, private industry, law enforcement, and the public to assist with preventing child abductions, recovering missing children, and providing services to deter and combat child sexual exploitation.

Under the Missing Children’s Assistance Act of 2018, NCMEC is mandated to work with the USMS and other agencies to find missing children and to prevent child victimization.

NCMEC created the Sex Offender Tracking Team (SOTT) in 2006 following the signing of the Adam Walsh Child Protection and Safety Act. SOTT is made up of analysts dedicated to supporting the USMS, state/territory sex offender registries, and other federal, state, local, tribal, and territorial law enforcement agencies to assist in identifying and locating non-compliant registered sex offenders. As a national clearinghouse for the public and law enforcement, SOTT is in a unique position to assist and view the issue Accessing information about child abductions, attempted abductions, child exploitation cases, and noncompliant sex offenders enables a broader approach and the ability to identify trends and patterns on a national scale. on a national scale.

SOTT analysts are highly skilled in performing searches of multiple public records databases, NCIC/Nlets, open-source Internet sites, and NCMEC's own internal systems (link analysis) and providing search results in a comprehensive analytical report for law enforcement use.

In addition to processing technical assistance reports for law enforcement, a SOTT analyst balances a multitude of other daily responsibilities and long-term projects.

Routinely, SOTT analysts are responsible for gathering feedback details from law enforcement regarding TAs processed for noncompliant offenders. This feedback provides various information, including arrests, changes in compliance status, and information about how the provided report assisted with law enforcement, which helps us improve/tailor our resources. The increasing number of received requests necessitates the dissemination, entry, and tracking of feedback solicitations. Responding to requests for feedback is voluntary for law enforcement. Once law enforcement receives a request, the work continues. SOTT analysts continue to run searches and provide assistance until the offender is located or arrested.

SOTT has seen an increased need to evolve their current processes to meet the demands and needs of law enforcement at any stage of their investigation. SOTT has the capability to conduct specified searches to provide law enforcement agencies with information to meet their needs. Upon the request of law enforcement, SOTT analysts also participate in case reviews and the development stages of large operations regarding sex offenders.

SOTT analysts also assist with a variety of law enforcement training. SOTT has been asked to provide training to law enforcement regarding how to conduct searches in public records databases, online and social networking searches, as well as in-depth resources training at Sex Offender Registry conferences and USMS trainings regarding the resources of NCMEC and SOTT.

As a result of the significant Department of Justice (DOJ) resources allocated to NCMEC, its tremendous reach into and coordination of resources from other government and public/private entity domains, and its wide umbrella of specialty analytic and technical resources in the missing child and related arenas, the Investigative Operations Division (IOD) and Sex Offender Investigative Branch (SOIB) seek exclusive use of NCMEC’s SOTT as a provider of analytic resources to augment other SOIB analytical and investigative activities.

Based on the NCMEC’s unmatched skills, congressionally mandated and DOJ-funded positioning, the SOTT stands as the most strategic and well-resourced ally for the SOIB to partner with in the USMS missions to combat sex offender registration, international travel compliance, and location of missing and exploited children.

The NCMEC is the only responsible source that can satisfy agency requirements. Since this procurement is a follow-on requirement, only the original source can provide the services.

This modification is needed to ensure the continuity of services and mission-critical readiness. Ultimately, a lapse in service would jeopardize the enforcement of sex offender regulations. The absence of contractor support would directly impact the IOD's SOIB mission, which includes assisting in the prevention of child abductions, recovering missing children, and providing services to deter and combat child sexual exploitation.

Based on the above, it is in the government’s best interest to utilize FAR 52.217-8. The new PoP will be 09/21/2025 – 09/30/2025.

Efforts made to Promote Competition

Due to the law enforcement sensitivity, the Contracting Officer (CO) has determined that FAR 5.202(a)(1) applies for this contract action because such disclosure would compromise national security.

Method for Determining Fair and Reasonable Pricing

A Google search of Indeed, Glassdoor, and Salary.com revealed pricing comparable to this requirement. As a result, the average salary range for one NCMEC analyst is approximately $58,502.00-$96,000.00. The price for ten NCMEC Inc. analysts for nine (9) days is $26,262.52.

The Government's anticipated cost savings will be approximately 5%. The contract file contains the results of a Google search.

Based on the above, the Contracting Officer has determined that the anticipated cost is fair and reasonable based on a comparison of similar prices through market research.

Market Research Due to the uniqueness of this requirement, market research shows that no other vendors have authorization to perform these services for the USMS.

Actions to Increase Competition:

Since the USMS has discretionary authority to assist other law enforcement agencies with the recovery of missing, endangered, or abducted children under the Justice for Victims of Trafficking Act of 2015, there will not be actions to increase competition to other vendors because the USMS will always support the NCMEC Inc.

to protect children from victimization by providing assistance to federal, state, and local law enforcement agencies until reauthorized appropriation ends.
