About this file

This document is a federal solicitation provision (52.212-2) for evaluating commercial products and commercial services issued in November 2021. The Government will award a purchase order to the most advantageous quoter based on four key evaluation factors: 1) Delivery Schedule (earlier delivery is viewed more favorably), 2) Technical Acceptability (products must meet specified requirements and standards), 3) Warranty (length and scope of coverage), and 4) Price (evaluated for fairness and reasonableness). Non-price factors are considered significantly more important than price, and the Government may select a higher-priced quote if it offers superior delivery or warranty terms, using a comparative evaluation method in accordance with FAR 13.106-2(b)(3).

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a purchase order resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, considering price and other factors. The following factors will be used to evaluate quotes:

1. Delivery Schedule – The Government will evaluate the quoter’s ability to meet or exceed the required delivery date. Quotes offering earlier delivery will be considered more favorably.

2. Technical Acceptability – The quoted products must meet the requirements stated in the Product Description, including compliance with applicable specifications and standards.

3. Warranty – The Government will evaluate the length and scope of warranty coverage, including terms for repairs, replacements, and support.

4. Price – Price will be evaluated for fairness and reasonableness.

Non-price factors (Delivery Schedule, Technical Acceptability, and Warranty), when combined, are significantly more important than Price.

(b) The Government will use comparative evaluation of offers in accordance with FAR 13.106-2(b)(3). Quotes will be compared to determine which is most advantageous to the Government, considering the stated evaluation factors.

The Government may make award to other than the lowest-priced quote if a higher-priced quote provides a benefit to the Government in terms of faster delivery or better warranty coverage.
