ALL INFORMATION NEEDED TO SUBMIT SF 330 DOCUMENTS IS CONTAINED HEREIN. NO SOLICITATION PACKAGE, TECHNICAL INFORMATION, OR BIDDER/PLAN HOLDER LIST WILL BE ISSUED.

THERE WILL BE NO SITE VISITS ARRANGED DURING THIS PHASE OF THE REQUIREMENT.

THIS PROJECT IS SUBJECT TO AVAILABILITY OF FUNDS. The Government will not pay, nor reimburse, any costs associated with responding to this request. The Government is under no obligation to award a contract as a result of this announcement.

Federal Acquisitions Regulation (FAR) 36.6 selection procedures apply. Firms that design or prepare specifications in conjunction with this contract are prohibited from participating on any future contracts based on those documents.

1. GENERAL INFORMATION:

The Department of Veterans Affairs, Atlanta Veterans Administration Medical Center (VAMC), is seeking sources and intends to award a firm fixed-price contract for Architect/Engineering (A/E) services for the development of complete construction documents, which include working drawings, specifications, reports, and construction period services, for Project 521-19-108 - A/E Design Main Kitchen. The A/E Services listed herein is being procured in accordance with the Federal Acquisition Regulation (FAR) 36.6 and VAAR 836.6. All submissions will be evaluated in accordance with the evaluation selection criteria as specified herein.

1. PROJECT INFORMATION

The NAICS Code for this procurement is 541330 Engineering Services and the annual small business size standard is $16.5M. The projected award date for the anticipated A/E contract is on or before April 16, 2021.

The anticipated period of performance for completion of design is 330 calendar days after Notice to Proceed.

The NAICS code for the anticipated Construction project is projected to be 236220 and magnitude of construction is predicted to be between $5 Million and $10 Million. The anticipated award date of the construction phase of the project is projected to be by Jan 31, 2022

An Architect & Engineer (A/E) contract will be negotiated for the development of complete construction documents which include working drawings, specifications, reports, and construction period services. The A/E will be given written information; participate in project planning meetings, pre-proposal meeting, and pre-construction meeting as required; communicate with VA personnel via telephone or e-mail; and is expected to coordinate so that the final documents include all requirements in accordance with industry standard practices, VA standards, VA design manuals, and review comments.

1. STATEMENT OF TASK/SCOPE OF WORK

1. A/E SELECTION PROCESS:

Responsive firms submitting SF 330’s in response to this announcement, not later than the closing date and time specified herein and in accordance with submission requirements, will be considered for initial selection evaluation. Following initial evaluation, no less than three firms that are selected as the most highly qualified based on the selection criteria responses, will be selected for interviews. Selected firms will be notified by telephone or email of selection and provided further instructions.

Evaluating past performance and experience may include information provided by the firm, customer inquiries, Government databases, and publicly available sources. Failure to provide requested data, accessible points of contact or valid phone numbers could result in a firm being considered less qualified. All projects provided in the SF330 must be completed by the office/branch/individual team member actually performing the work under this contract.

1. SELECTION CRITERIA: Evaluation and selection of firms will be based on submissions and direct responses to the following criteria which are numbered in descending order of importance:

Per FAR 36.602-1

1) Professional qualifications necessary for satisfactory performance of required service and working together as a team (in-house and/or consultants(s)). Provide brief resumes of proposed team members who will specifically serve as the Project Managers and Designers of Record. The Designers of Record shall perform and direct the design within their respective discipline and shall sign and seal the drawings. All Designers of Record must be professionally registered in their discipline. Each resume shall include a minimum of two (2) specific completed projects that best illustrate the individual team members experience relevant to this contract scope.

2) Specialized experience and technical competence in the type of work required, including, where appropriate on similar projects: experience in energy conservation, pollution prevention, waste reduction, and the use of recovered materials (include Government and private Experience). Technical competence includes design quality management procedures, CADD, equipment resources, and laboratory requirements of the prime firm and any subcontractors. In addition, provide information on the effectiveness of the proposed project team (including management structure; coordination of disciplines, offices and/or subcontractors; and prior working relationships).

3) Capacity to accomplish work in the required time. This factor evaluates firm's experience with similar size projects and the available capacity of key disciplines when evaluating the capacity of a firm to perform the work in the required time. The general workload and staffing capacity of the design office will be evaluated. List current projects with similar design fee being designed in the firms’ office. Indicate the firms present workload and the availability of the project team (including sub-consultants) for the specified contract performance period; Describe experience in successfully delivering projects per performance schedule, providing timely construction support, and successfully completing multiple projects with similar delivery dates

4) Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work, and compliance with performance schedules. VISN7 will evaluate past performance on recent and relevant contracts with government agencies (emphasis on VA work) and private industry in terms of cost control, quality of work, compliance with performance schedules and a record of significant claims against the firm due to improper or incomplete engineering services (references required).

Recent is defined as performance occurring within 5 years of the date of this Sources Sought, except that ongoing projects must have begun no less than one (1) year prior to the issuance of this Sources Sought.

Relevancy is defined as performance of work on projects that are similar in scope to the types of projects anticipated under the resultant contracts.

Respondents with no previous past performance shall state this when addressing the selection criteria. Where there is no record of past performance, the proposal will be evaluated neither favorably nor unfavorably. Superior performance ratings on relevant projects may be considered more favorably in the evaluation.

Submission Requirements:

Submit a minimal of three (3) references; any of the following evaluations are acceptable:

· A-E Contractor Appraisal Support System (ACASS),

· Contractor Performance Assessment Report System (CPARS), or

· Past Performance Questionnaire (PPQ) evaluation for each project submitted under Criterion 2.

If a completed CPARS evaluation is available, it shall be submitted with the completed SF330 package. If there is not a completed ACASS/CPARS evaluation, the PPQ included with this notice is provided for the Offeror or its team members to submit for each project included in criterion (2). If a PPQ is submitted, but an official ACASS/CPARS evaluation is found for that project in government databases, the official evaluation will take precedence. If an ACASS/CPARS evaluation is not available, ensure correct phone numbers and email addresses are provided for each contract customer/reference. Completed PPQs should be submitted with your SF330. If the A-E is unable to obtain a completed PPQ from a contract customer/reference for a project before the response date set forth in this notice, the A-E should complete and submit with their response the first page of the PPQ (Attachment #1), including contract and point of contact information for the respective projects.

A-Es should follow-up with references to ensure timely submittal of questionnaires. At the reference s request, questionnaires may be submitted directly to the Governments Point of Contact, Department of Veterans Affairs (10N7NLO), Attn: Evonne Huggins, Contracting Officer via email at Evonne.Huggins@va.gov, prior to the response date. A-Es shall not incorporate by references into their response ACASS/CPARS or PPQ evaluations previously submitted in response to other A-E services procurements. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. Submitted ACASS/CPARS and PPQ evaluations will not be counted as part of the 30-page limitation and shall be attached to the SF330, behind the SF330 Part II document

5) Location in general geographical area of the project and knowledge of the locality of the project; The area of consideration for offeror is a 350-mile driving radius between offeror location and the Birmingham VA Medical Center, located at 700 S. 19th Street Birmingham, AL 35233 (Determination of mileage eligibility will be based on www.mapquest.com)

6) Subcontracting with Small Businesses - The extent to which potential contractors identify and commit to the use of service-disabled Veteran-owned small businesses, Veteran-owned small businesses, and other types of small businesses as subcontractors.

7) Experience in construction period services to include professional field inspections during the construction period, review of construction submittals, support in answering requests for information during the construction period, and support of construction contract changes to include drafting statements of work, and cost estimates shall be included as an evaluation criterion when construction period services is included in the statement of work for A-E services.

1. SUBMISSION CRITERIA/REQUIREMENTS:

Interested firms having the capabilities to perform this work must submit:

ONE (1) ELECTRONIC SF 330, including Parts I and II, and attachments (if any) electronically to Evonne.Huggins@va.gov no later than 10 am Eastern Standard Time on January 4, 2021.

Interested firms are responsible for ensuring electronic delivery of submission by the time and the date specified. It is highly recommended interested firms confirm electronic submissions have been received by the Contracting Officer.

Size limits of e-mails are restricted to 5MB. If more than one email is sent, please number emails in Subjects as “1 of n”. (Example: SF330 Submission, # 36C24719R0028 – Project 508-19-101 “Correct Critical Elevator Deficiencies” 1 of n, 2 of n, etc.).

All SF330 submissions shall be clearly indicated in subject line, displaying the procurement number and project title (abbreviated or shortened is okay).

Interested firms are responsible for ensuring delivery of submission.

All SF 330 submissions must include the following information either on the SF 330 or by accompanying document:

1) Cage Code

2) Dun & Bradstreet Number

3) Tax ID Number

4) The E-mail address and Phone number of the Primary Point of Contact

5) A copy of the firms VetBiz Registry

6) SF 330 MUST INDICATE THE PERCENTAGE of the contract performance cost that will be expended by the prime firm’s employees and in which discipline(s) and subcontracted percentage of contract performance cost to be expended (and in what disciplines). Any subcontracted or otherwise business entity must be identified by name, office location and size/type of business (i.e. SDVOSB, VOSB, 8(a), large, etc.). This is to assure compliance with FAR Clause 52.219-14(b)(1) Limitations on Subcontracting. Failure to provide this information may deem the Firm as nonresponsive and preclude SF 330 submittal from being included further in the evaluation process.

NOTE: In order for a Service-Disabled Veteran Owned Small Business (SDVOSB) to be considered as a proposed contractor, the firm must be verified and visible by VETbiz (www.vetbiz.gov) and registered in the System for Award Management (SAM) database (www.sam.gov) at time of submission of their qualifications AND at time of award. Failure of a proposed SDVOSB to be verified by the CVE at the time the SF 330 is submitted shall result in elimination from consideration as a proposed contractor.

All Joint Ventures must be CVE verified at time of submission and submit agreements that comply with 13CFR 125.15 prior to contract award.

Electronic submittals received after the date and time specified will not be considered. Late proposal rules per FAR 15.208 will be followed for late submittals. Firms not providing the required information may not be considered. All information must be included in the SF330 submission package.

A/E STATEMENT OF WORK
PROJECT #521-19-108

Correct Kitchen, Equipment and Gas System Deficiencies

1. GENERAL:

A. The Architect/Engineer (A/E) shall provide professional technical services, including construction period and commissioning services for the complete design for Project No. 521-19-108, Correct Kitchen, Equipment and Gas System Deficiencies. Required documents typically include schematics preliminary plans, working drawings, specifications, cost estimates, and construction documents (final drawings, specifications, and cost estimate). The purpose of this project is to address identified failing plumbing facility conditions. Project will include the renovation of the entire Food and Nutrition Service area, including the main kitchen, existing retherm room and administrative spaces. The intent of the project is to create a modern, state of the art facility that meets all sanitation and infection control measures, upgrades existing equipment and utilities, and maintains a logical flow within the space. To the greatest extent possible, project will be phased to allow the main kitchen to continue operations in order to provide meals to patients, at all times, in some capacity. Project will correct specific identified failing FCA issues associated with the main kitchen area of the facility that are in need of correction. In addition, provide construction period services for hazardous material abatement, demolition, construction, inspection, and testing of all work for project 521-19-108 Correct Kitchen, Equipment and Gas System Deficiencies. Contractor personnel shall specialize in hospital enhanced dining systems development and have a minimum of 5 years experience working as contractors for VA healthcare facilities in the area of enhanced dining systems. A list of at least three references consisting of current and prior clients will be required. Work may include, but is not limited to, architectural, electrical, HVAC, fire protection and plumbing.

B. The A/E shall prepare all documents for this project from interaction and planning with the VA Engineering Service staff, as well as in accordance with the attached concept drawings. The A/E shall meet with the VAMC staff as required to accomplish the task described in the scope of work. The A/E shall make site surveys, verify as-built drawings, analyze existing utility systems as necessary, and complete any and all work necessary to furnish complete Construction Documents in accordance with VA Program Guide PG-08-15, Volume C, "A/E Submissions Instructions for Minor and NRM Construction Programs (Available at http://www.va.gov/facmgt/standard/).

2. CONSTRUCTION GUIDELINES:

A. At minimum, the A/E shall utilize VA Construction Standards, VA Master Construction Specifications, VA Standard Details, VA Design Guides, VA Design Manuals, VA Design Alerts, and VA Design and Construction Procedures in preparation of the contract documents. These items may be downloaded from the VA website, http://www.va.gov/facmgt/standard/.

B. Other guidelines that the A/E shall utilize are the National Electric Code (NFPA-70), Life Safety Code (NFPA-101), National Building Code, and any other applicable codes and/or standards. All codes and standards used in the design of this project shall be the latest editions in effect at time of contract award.

C. All projects shall be designed to achieve an energy consumption level that is at least 30% below the level achieved under ASHRAE Standard 90.1-2004, if life-cycle cost effective. Use Appendix G of ASHRAE Standard 90.1-2004 to document the energy savings.

Should the 30% reduction in energy consumption prove not to be life-cycle cost effective, then the A/E shall evaluate alternative designs at 5% successive decrements in order to identify the most energy-efficient design that is life-cycle cost effective.

The following parameters shall be used for performing the analysis:

1. 20 year life-cycle period for system comparison

1. Use Public domain programs such as TRACE, E-CUBE, Carrier E20-II, EnergyPlus, etc.

1. 3% Discount Factor

1. Do not include taxes or insurance while computing costs.

3. DESIGN SUBMISSION/REVIEW SCHEDULE:

A. The A/E shall conduct an initial programming meeting with VA Engineering Service staff and others, be on site taking field notes, and verifying VA furnished drawings and other planning documents within 15 calendar days after receiving notification to proceed. Period of performance for design activities is 330 calendar days after receipt of notice to proceed.

B. The A/E shall provide the required submissions as indicated below:

(1) Design Development Submission #1 (DD#1, Construction Documents (35%)) in accordance with VA Program Guide PG-08-15, Volume C is due 90 days after acknowledgment of notification to proceed. VA will return review comments and approvals or disapprovals within 15 calendar days of submission.

(2) Construction Documents Submission #1 (CD#1, Construction Documents (65%)) in accordance with VA Program Guide PG-08-15, Volume C is due 90 days after approval of first submission. VA will return review comments and approvals or disapprovals within 15 calendar days of submission.

(3) Construction Documents Submission #2 (CD#2, Construction Documents (100%)) in accordance with VA Program Guide PG-08-15, Volume C is due 90 days after approval of second submission. VA will return review comments and approvals or disapprovals within 15 calendar days of submission.

After final VA comments have been incorporated in the Construction Documents, the A/E shall furnish 2 sets of the technical specifications, 5 sets of black and white drawings, and 1 full set of drawing files on CD-ROM (in latest ACAD and .pdf format) or ZIP disk for computer storage purposes. Specifications shall be typewritten on 8 ½" x 11" unbound bond paper, single-sided, with the upper right corner of each page blank (free of any headers). Provide corresponding electronic files on CD-ROM in ‘Microsoft Word’ format. Furnish three copies of the detailed cost estimate. Provide corresponding electronic files on CD-ROM in ‘Excel’ format. All documents shall be furnished 14 days after receipt of VA final documents.

4. VAMC RESPONSIBILITY:

The VAMC will prepare advertisement for bids, instructions to bidders, General and Special Conditions, General Requirements and other related material of the non-technical nature. The VAMC shall select the contractor, award and administer the construction contract and provide interim on-site observation during construction period.

5. CONSTRUCTION PERIOD SERVICE AND SITE VISIT: (Optional Service).

a. The A/E shall provide construction period service which will include:

(1) Timely review of shop drawings and material submittals.

(2) Answer inquiries and provide clarifications on design and contract issues.

(3) Preparation of cost estimates for any change order or extra work required.

b. An estimated nine (9) A/E site visits will be required, in addition to the final inspection and site visits made necessary by clarification of design, contract, or existing conditions not properly addressed in the contract documents. On each visit a field inspection of all contract work will be conducted and assessment of progress made, and a written inspection report prepared and submitted to the VA Medical Center.

c. The A/E shall participate in the final inspection of the project work upon completion by the contractor.

d. The A/E shall submit a written report to the Contracting Officer or his Representative for each site visit performed. Additionally, the A/E shall maintain a record of site visits, recording thereon the date of each visit, the hours thereof, the purpose of the visit, their personnel involved, VA personnel contacted, and conversations made. The site visits made by the A/E for his own benefit or because of deficiencies in the A/E's performance shall be at no additional expense to the government.

e. Estimated period of performance for Construction Period Services is 500 calendar days after notice to proceed is issued to construction contractor.

6. RECORDS MANAGEMENT

1. Contractor shall comply with all applicable records management laws and regulations, as well as National Archives and Records Administration (NARA) records policies, including but not limited to the Federal Records Act (44 U.S.C. chs. 21, 29, 31, 33), NARA regulations at 36 CFR Chapter XII Subchapter B, and those policies associated with the safeguarding of records covered by the Privacy Act of 1974 (5 U.S.C. 552a). These policies include the preservation of all records, regardless of form or characteristics, mode of transmission, or state of completion.

1. In accordance with 36 CFR 1222.32, all data created for Government use and delivered to, or falling under the legal control of, the Government are Federal records subject to the provisions of 44 U.S.C. chapters 21, 29, 31, and 33, the Freedom of Information Act (FOIA) (5 U.S.C. 552), as amended, and the Privacy Act of 1974 (5 U.S.C. 552a), as amended and must be managed and scheduled for disposition only as permitted by statute or regulation.

1. In accordance with 36 CFR 1222.32, Contractor shall maintain all records created for Government use or created in the course of performing the contract and/or delivered to, or under the legal control of the Government and must be managed in accordance with Federal law. Electronic records and associated metadata must be accompanied by sufficient technical documentation to permit understanding and use of the records and data.

1. Birmingham VAMC and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Records may not be removed from the legal custody of Birmingham VAMC or destroyed except for in accordance with the provisions of the agency records schedules and with the written concurrence of the Head of the Contracting Activity. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. In the event of any unlawful or accidental removal, defacing, alteration, or destruction of records, Contractor must report to Birmingham VAMC. The agency must report promptly to NARA in accordance with 36 CFR 1230.

1. The Contractor shall immediately notify the appropriate Contracting Officer upon discovery of any inadvertent or unauthorized disclosures of information, data, documentary materials, records or equipment. Disclosure of non-public information is limited to authorized personnel with a need-to-know as described in the [contract vehicle]. The Contractor shall ensure that the appropriate personnel, administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, documentary material, records and/or equipment is properly protected. The Contractor shall not remove material from Government facilities or systems, or facilities or systems operated or maintained on the Government’s behalf, without the express written permission of the Head of the Contracting Activity. When information, data, documentary material, records and/or equipment is no longer required, it shall be returned to Birmingham VAMC control or the Contractor must hold it until otherwise directed. Items returned to the Government shall be hand carried, mailed, emailed, or securely electronically transmitted to the Contracting Officer or address prescribed in the [contract vehicle]. Destruction of records is EXPRESSLY PROHIBITED unless in accordance with Paragraph (4).

1. The Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, contracts. The Contractor (and any sub-contractor) is required to abide by Government and Birmingham VAMC guidance for protecting sensitive, proprietary information, classified, and controlled unclassified information.

1. The Contractor shall only use Government IT equipment for purposes specifically tied to or authorized by the contract and in accordance with Birmingham VAMC policy.

1. The Contractor shall not create or maintain any records containing any non-public Birmingham VAMC information that are not specifically tied to or authorized by the contract.

1. The Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected from public disclosure by an exemption to the Freedom of Information Act.

1. The Birmingham VAMC owns the rights to all data and records produced as part of this contract. All deliverables under the contract are the property of the U.S. Government for which Birmingham VAMC shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Any Contractor rights in the data or deliverables must be identified as required by FAR 52.227-11 through FAR 52.227-20.

1. Training. All Contractor employees assigned to this contract who create, work with, or otherwise handle records are required to take VHA-provided records management training. The Contractor is responsible for confirming training has been completed according to agency policies, including initial training and any annual or refresher training.

1. [Note: To the extent an agency requires contractors to complete records management training, the agency must provide the training to the contractor.]

1. Flow down of requirements to Subcontractors

1. The Contractor shall incorporate the substance of this clause, its terms and requirements including this paragraph, in all subcontracts under this [contract vehicle], and require written subcontractor acknowledgment of same.

1. Violation by a subcontractor of any provision set forth in this clause will be attributed to the Contractor.
