About this file

This is a comprehensive Technical Specifications document for the Upper Brownsville Levee and Floodplain Failure project, a flood control infrastructure rehabilitation contract solicited by the International Boundary and Water Commission (USIBWC). The project involves stabilizing an existing levee along the Rio Grande in Brownsville, Texas, with an estimated value exceeding $10 million. Key construction activities include design and installation of soil mix columns, aggregate piers, articulated concrete block mattress revetment, rock riprap placement, levee embankment replacement, and gatewell repairs.

The solicitation (RFP 191BWC25R0010) is a firm-fixed-price contract with a pre-bid site visit scheduled for May 28, 2025, at the USIBWC Mercedes Field Office. Proposals are due on July 14, 2025, at 2:00 PM MDT, with an anticipated contract award in August 2025. The project is open to small businesses under NAICS code 237990 with a size standard of $45 million. Technical specifications detail extensive quality control, safety, environmental, and construction requirements, including specific performance criteria for ground improvement techniques, erosion protection, and levee reconstruction to meet FEMA 44 CFR 65.10 standards.

1.6.B. If during review of these items, the Bidder finds discrepancies, omissions, conflicts, defects, errors, or ambiguities, they have a duty to inquire. The Bidder shall also inquire about items that are open to interpretation.

1.6.C. The Bidder shall inquire about items as soon as they are discovered, whether before deadline for submission of bidder questions, whether after deadline for submission of bidder questions, whether after submission of bids, or whether after Contract award.

1.6.D. If the Bidder fails to inquire, they forfeit their right to any claim based upon said discrepancies, omissions, conflicts, defects, errors, ambiguities, or items that are open to interpretation. The Bidder shall be proceeding at their own risk based upon only their unilateral interpretation.

1.6.E. The Bidder shall take no advantage of any item of which they have a duty to inquire.

1.7. INVESTIGATION OF SITE CONDITIONS

1.7.A. The Bidder, as well as their subcontractors, is urged to visit the worksite and project area to become fully aware as to the existing conditions affecting the work to be performed under the Contract documents. A site visit will be announced during the solicitation. Each Bidder shall attend at their own expense. The

Government will not pay for any site visits. This visit is intended to provide the potential Bidders the opportunity to observe site conditions and incorporate into their proposal any required work based on site conditions. The Bidder will have the opportunity to walk around during the site visit. Unless otherwise noted, no other opportunity will exist for visits to the site.

1.7.B. The Bidder shall be responsible for ensuring that all of its suppliers, manufactures and subcontractors have reviewed all applicable Contract documents relative to their work. The Bidder shall provide all labor, material, equipment, and services not provided by the Bidder’s suppliers, manufacturers, fabricators, and/or subcontractors but required for complete and operable facilities as described in the

Contract documents.

1.7.C. Bidder has the sole responsibility to make such independent investigation and examination as they deem necessary in order to satisfy themselves as to the conditions to be encountered in the performance of work and the quantities required to complete the work in accordance with the SOW.

1.7.D. The Government assumes no responsibility for any understanding reached or representation made concerning conditions which can affect the work by any of the Bidder's officers or agents before the execution of this Contract, unless that understanding or representation is expressly stated in the Contract documents.

1.7.E. Any failure of the Bidder to take the actions described and acknowledged in this Section will not relieve the Bidder from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work.

January 15, 2025 Instructions to Bidders USIBWC RFP 191BWC25R0010 00.21.13-Page 3

1.8. BID ITEMS

1.8.A. The Contract Line Item Numbers (CLIN) that shall be bid upon are identified in Section B (bid schedule) of the Solicitation.

1.8.B. The Bidder shall include all work related costs within its bid unit prices even if not specifically listed in the bid schedule.

1.8.C. If an error exists on the bid schedule between the CLIN total cost provided and the resultant value of the

CLIN quantity multiplied by the bid unit price, the bid unit price provided shall govern.

1.8.D. If the bid schedule includes CLINs entitled Receiving Lines, No Cost Receiving Lines, No Cost

Receiving Lines for IBWC Use Only, Receiving Lines for Internal Use Only, or similarly, then the Bidder shall not provide a bid price for this CLIN. Receiving lines are used for USIBWC's computer system to make pay estimate processing easier. These are an administrative CLIN and have no value on the

Contract.

1.9. SPECIFICATIONS

1.9.A. The Government does not implicitly warrant performance specifications for complete accuracy or adequacy. Typical performance type specifications set forth an objective or standard to be achieved, and the successful Bidder is expected to exercise their ingenuity in achieving that objective or standard of performance, selecting the means and assuming a corresponding responsibility for that selection.

1.9.B. When a particular product or manufacturer is identified by name, but permits substitution of ‘an approved equal,’ such a specification is ‘performance’ in nature and, as a result, carries no implied warranty.

1.9.C. The Technical Specifications are written in imperative and abbreviated form. This imperative language is directed at the Contractor, unless specifically noted otherwise. Incomplete sentences shall be completed by inserting "shall", "the Contractor shall", and "shall be" or similar mandatory phrases by inference in the same manner as they are applied to notes on the Contract Drawings. The words "shall" are to be placed by inference where a colon (:) is used within sentences or phrases. Except as worded to the contrary, the Contractor shall fulfill (perform) all indicated requirements whether stated imperatively or otherwise.

1.9.D. All equipment and facilities shall be furnished, installed, and constructed by the Contractor to provide the

Government with complete, ready to use components, systems, and facilities. All necessary materials and work required to accomplish this are the responsibility of the Contractor alone, whether or not specifically indicated on the Contract Drawings or stated in the Technical Specifications.

1.9.E. The various Sections of the Technical Specifications may contain references to standards, other specification sections, or items that do not apply to the work covered in this project. These references are to be considered for information only and can be ignored by the Contractor unless work changes and they become relevant. If conflicts arise from references or lack of references to standards or other specification sections, COR will determine the relevancy of the apparent conflicts.

1.3. GEOTECHNICAL REPORTS

1.3.A. Geotechnical analysis for this project was performed by Arcadis U.S., Inc. and summarized in Attachment

B ("Geotechnical Report, Remediation Design of Levee Floodplain Failure within the Upper Brownsville

Levee Reach, Lowe Rio Grande Flood Control Project," dated August 20, 2021) of their report entitled

"Design Documentation Report, Remediation Design of Levee and Floodplain Failure within the Upper

Brownsville Levee Reach, Lower Rio Grande Flood Control Project," dated May 5, 2022.

1. Arcadis collected summarized their inclinometer readings in reports with the following dates:

a. August 29, 2016

b. September 26, 2016

c. October 31, 2016

d. November 18, 2016

1.3.D. The data and report are not intended as a representation or warranty of continuity of conditions between soil borings nor of groundwater levels at dates and times other than date and time when measured. The

USIBWC neither warrants or guarantees the results of any geotechnical or subsurface investigations as being representative of the site, beyond the actual location of the test specimen(s) nor assumes any responsibility for the manner in which this information may be used or the conclusions reached in utilizing the information contained in these documents. Additional test borings and other exploratory operations may be made by Contractor subsequent to award of the Contract.

1.3.E. Due to the site location adjacent to the Rio Grande, groundwater levels may fluctuate, sometimes to extreme levels, based upon time of year and amount of water in the river. Higher groundwater levels than those shown in the bore logs may occur causing changes in soil saturation and strength.

1.3.F. The worksite is adjacent to the Rio Grande and is located in an area where the river flowed in the past.

Fluvial deposits can change rapidly in type (sand, silt, clay, loam, gravel, rocks, etc.) both horizontally and vertically due to depositional characteristics and channel shifting. Rocks may be present even if not visible on the ground surface. Rocks larger than the borehole would not have been captured in any logging data.

1.3.G. The Contractor is charged with the duty to read and understand the geotechnical data provided, including any data referenced within. The Contractor shall consider all geotechnical information including geotechnical reports, bore logs, and site visits as a whole. The Contractor shall consider the limitations of any geotechnical tests performed including the auger size, borehole spacing and location, consistency of borehole data, as well as the frequency of testing, results of testing, and groundwater level at time. The

USIBWC will not be responsible for interpretations or conclusions drawn by the Contractor.
