About this file
This document outlines a pre-proposal conference agenda for solicitation number 140P2020R0079 from the National Park Service to reconstruct and stabilize a historic stone wall and towpath at Chesapeake and Ohio Canal National Historic Park. The solicitation seeks general construction services and will accept proposals from both large and small businesses. The pre-proposal conference provided an overview of key requirements including a mandatory subcontracting plan, wage determinations, work hours, safety management roles, and technical specifications. Offerors must submit proposals by August 4, 2020 and the agency anticipates selecting an awardee within 30 days thereafter by evaluating technical merit, past performance, and price to determine best value. The conference agenda detailed submission instructions and evaluation criteria to ensure offerors have the information necessary to submit compliant proposals for this opportunity.

Current Amendments: NoAmendments have been issued. We intend to issue at least one (1) amendment following this pre-proposal conference.
The biggest question relates to who could propose on this project.
Proposals will be accepted from all businesses Large and Small. This is a full and open unrestricted Solicitation. Refer to the 1st page of the Solicitation and applicable clauses and provisions thereafter. The confusion is understood to be a result of linking the Market Research to the actual Solicitation in the FBO system. The Market Research was seeking small business contractors to respond to see if the Solicitation could be set-aside for them. There were not enough qualified small businesses for the Government to set the project aside for small business. As a result, the Solicitation was issued as full and open unrestricted requirement.
Proposal Due Date: August 4, 2020 2:00 PM MDT / 4:00 PM MT / 6:00 PM ET. See
Solicitation Section L.

The Government will try to answer all the questions and post the questions and answers as an amendment by the end of the day July 10, 2020. Please do not wait until then to submit your questions, submit them as soon as you can so that the Government has the time to research and answer in order to help you prepare your proposals. Any questions received after that date/time there is no guarantee an answer will be provided. Answers to questions will be incorporated into the amendment with the sign in sheet for this meeting.
Proposal Question Process: DO NOT submit questions through FedConnect. Submit questions only to the Solicitation primary points of contact though email to: C.O. - Anne
LaPorta, anne_laporta@nps.gov and C.S. - Bryan Pemberton, bryan_pemberton@contractor.nps.gov. The questions need to be in writing as a matter of record. So even if you have a question that you believe could be answered over during this pre-solicitation conference, we need it documented and recorded within the contractor file as a matter of record.
Prime POCs contact information: Contract Specialist: Bryan Pemberton, bryan_pemberton@contractor.nps.gov and Anne LaPorta, Contracting Officer, anne_laporta@nps.gov.
Wage Determinations: Make sure all of your subcontractors incorporate the wage determinations into their proposals.
Work Hours: Ensure the work hours identified in Division 1 are considered when developing the proposed schedule.
Physical Data: Ensure the physical data identified in Solicitation clause 52.236-4 is considered when developing the proposed schedule.
Self-Performance: Page 128 of the Solicitation tells you that, in accordance with Solicitation clause 52.236-1, the prime contractor is required to perform on site, with its own organization
15% of the total amount of work to be performed under the contract.
Small Business Subcontracting: Page 56 of the Solicitation tells you what to submit in relation to the subcontracting plan with your proposal. The plan does not receive a rating and the award is not made until the subcontracting plan is acceptable. The clause at 52. 219-9 provides further detail. A sample plan is provided as an attachment to Solicitation.

PRE-PROPOSAL CONFERENCE AGENDA for JULY 14, 2020 7:30 AM MDT / 9:30 AM ET Pg. 4 of 6
Small Business Participation: Page 21 of the Solicitation describes this requirement. It requires a minimum of 20% of the total contract value to be performed by small business. This requirement may be met by i. Self-performance by small business prime contractors and / or
ii. Subcontracting portions of the work to small businesses. If at any point during the performance of the contract it becomes apparent that the goals will not be met a recovery plan will be requested and if upon contract completion the 20% is not obtained it will be appropriately documented in the past performance record.
Key Personnel: For this project, there are four key positions: Project Manager, Job-site
Superintendent, On-site Quality Control Manager, and On-site Safety Manager.
Only the Safety Manager position may also carry out the duties of EITHER the Site
Superintendent OR the Quality Control Manager. So, a minimum of three (3) separate personnel are required. The On-Site Superintendent and Quality Control Manager positions must be filled by separate individuals and both must be on-site at all times when work is being performed. The persons proposed as key personnel are required to be persons performing the work as proposed within the first 180 days.
Proposal Submission Requirements: The submission requirements begin on page 156 and ends on page 172 of the Solicitation and are part of Section L.
Proposal Evaluation Criteria: The evaluation criteria begins on page 173 and ends on page176 of the Solicitation and are part of Section M.
Evaluation/Selection/Award Schedule: Process will likely take 30 days at a minimum. Do not call, your firm will be notified as soon as possible.
Evaluation Process: We first do a responsibility check on the offeror to ensure they are an interested party. Next the technical proposals are reviewed and evaluated by the Technical Panel and consensus ratings are prepared. The Panel presents the finding to the Source Selection
Authority and if it is determined the evaluation was consistent and performed only against the
Solicitation requirements, the prices are revealed to the Technical Panel and the tradeoff process begin; trading the benefits against the costs to establish which offeror is the best value to the
Government.
Importance/Weights: Discuss the importance and weights identified in section M. Best Value means – the ultimate decision will be based on an assessment of whether the difference in the technical and management merit of the proposals is worth the difference in the price. Even if technical is significantly more important than price, selection of a lower-proposed price is justified if the SSA determines that the technical and management benefits offered by the higher priced offeror are not worth the higher cost.
Notice to Proceed Date: The Notice to Proceed is expected to be issued as soon as (at minimum) the bonds, insurance and accident prevention plan are received and approved. Bonds are due within the time period specified in Box 10 of the SF1442 of the Solicitation.

Advice:
▪ Review ALL Solicitation requirements so that you have time to ask questions.
▪ You will be best served by asking questions rather than making assumptions.
▪ Do not be generic and provide boiler plate narratives, be specific to this requirement.
▪ With the project experience, be clear on what you performed, do not try to present work that was not performed by your company
▪ Ensure references are the actual customer and the contact information is up to date.
▪ Ensure you review the bid sheet thoroughly and that all identified quantities and measurements seem reasonable for the proposed work.
Now is your opportunity, if you see errors (patent defects), it is your responsibility to identify them now, not after contract award. If you choose to wait until after award, you could be held responsible for the associated costs.
