SECTION 00 21 16 - INSTRUCTIONS TO PROPOSERS

The following have been modified:

PROPOSAL SUBMISSION

PROPOSAL SUBMISSION (SECTION 00 21 16)

For clarity, the addressed section shall reference the Solicitation. The identified sections are IAW the Construction Specifications Institute (CSI) pursuant to U.S. Army Corps of Engineers Desk Guide (UDG) 5114.201-1.

Section 00 21 16 of the Solicitation (Request for Proposal (RFP)) contains the proposal submission instructions.

Section 00 21 16 includes specific information on what must be furnished with the offer and identifies evaluation criteria that will be used in evaluating proposals received. Section 00 22 16 contains the proposal basis of the award and evaluation methods/ratings.

1. INTRODUCTION

1.1. The Solicitation is an unrestricted full and open competition acquisition using the best-value tradeoff

(BVTO) source selection process to award a firm-fixed-price (FFP) type contract.

1.2. Pursuant to DFARS 236.204, the magnitude of the construction project is between $10 million and $25 million.

1.3. The primary North American Industry Classification System (NAICS) code for the acquisition is 335312 – Motor and Generator Manufacturing. Size Standard 1,250 employees.

1.4. Selection will be made based on the responsible Offeror whose proposal conforms to the Solicitation requirements, demonstrating high technical capability and low risk, presenting the most advantageous offer to the Government in accordance with (IAW) the Federal Acquisition Regulation

(FAR) Part 15, Contracting by Negotiations and the Solicitation. The Government reserves the right to accept other than the lowest-priced offer or to reject all proposals.

1.5. The Government intends to make an award without discussions but reserves the right to conduct discussions should the contracting officer decide discussions necessary or advantageous to the Government. Because the Government does not intend to hold discussions, the Offeror is encouraged to put forth their best proposal.

1.6. The Government will not reimburse any cost incurred or associated with preparing and submitting any responses to the Solicitation. Oral explanations or instructions to Offerors are not binding. Any information given to an Offeror which impacts the Solicitation and/or offers will be provided in the form of a written amendment to the Solicitation. It is the Offeror’s responsibility to acknowledge all amendments in its proposal submission.

1.7. The Offeror should not modify the terms and conditions of the Solicitation in their technical proposals or add conditions or qualifications to their offers. Should an Offeror include terms and conditions that conflict with the terms and conditions of the Solicitation, the Offeror may be determined ineligible for award. Any questions related to specific terms and conditions contained within the Solicitation should be resolved prior to the submission of an offer.

1.8. All proposals received will be considered complete and final. The evaluation board will not consider any information or data incorporated by reference or referred to other sources outside the respective proposal volumes and factors responses. The successful Offeror will be selected solely based on the evaluation factors below. Accordingly, proposals submitted in response to the Solicitation should provide clear, complete, concise, and straightforward responses to the evaluation factors. Elaborate proposals, color brochures, and other excesses are discouraged.

1.9. Proposals that reiterate “Parroting” the contents of the Solicitation, or contain only superficial responses, may be considered unacceptable. Evidence of experience, capability, and qualifications demonstrating and supporting the Offeror’s claims is essential. The absence of such evidence will adversely influence the evaluation of the proposal.

1.10. References to “confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can be provided to the Government as part of the Offeror’s technical proposal. The Offeror including confidential information in its proposal that they do not want to be disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall clearly mark their proposals IAW the instructions at FAR Clause 52.215- 1, Instructions to Offerors –Competitive Acquisition, paragraph (e), Restriction on disclosure and use of data.

1.11. Use of the words “shall” or “must” indicate a mandatory requirement for which failure to comply at the time and date for submission of proposals may result in the Offeror’s proposal being disqualified from consideration for the award, or a deficiency or weakness being assessed for the factor. Failure to comply with non-pricing or pricing requirements annotated with the words “should” or “may” can result in an unacceptable proposal. If stated as a number of days, time periods are calendar days unless otherwise specified.

2. E-BUSINESS REGISTRATION REQUIREMENTS

2.1. System for Award Management (SAM). The Offeror shall be registered in SAM at the time an offer is submitted. Failure to have an active and completed registration in SAM [https://sam.gov/] may determine an Offeror ineligible for the award and removed from the competition. A successful Offeror with incomplete or expired registrations at the time of award may not be eligible for a contract. Information contained within an Offeror’s registration shall be current and valid. The https://sam.gov/ responsibility of maintaining current information contained in an Offeror’s registration rests solely on the Offeror.

2.2. Procurement Integrated Enterprise Environment (PIEE). The Offerors shall submit its proposal through the PIEE Solicitation Module [https://piee.eb.mil/].

2.3. Joint Venture. A joint venture (JV) is defined as a legal business entity formed between two or more companies to undertake the performance activities of a contract together. The Offerors proposing as JV shall provide evidence that the JV as a legal entity has been duly formed. The JV shall include a copy of the legal JV agreement signed by an authorized officer from each of the firms comprising the JV, with the Chief Executive of each entity identified. The Government will not evaluate the capability of any firms that are not included in the JV agreement. If submitting a proposal as a JV, the experience of each of the JV partners can be submitted for the JV entity. The experience of either JV partner will be considered the experience of the JV entity. Prospective Offerors that submit proposals may not change their JV firms, if selected for award. If an Offeror is a joint venture (JV), the JV entity shall have a valid registration representing the JV as one business/firm/entity in SAM.

The Government will not accept separate registrations and licenses from each separate entity representing the JV.

2.4. Subcontractors. Approval of substitutions will not be given unless the PCO considers the proposed substitute equal or better in all respects to the originally proposed subcontractor and that the substitution is in the Government's best interests. If the Offeror's proposal includes the use of subcontractors, the Offeror may only change subcontractors with the PCO approval. If the Offeror proposes to change subcontractors after award, the Offeror may not change subcontractors or Letter of Commitment (LOC) without the PCO's approval.

3. PROPOSAL VOLUME INSTRUCTIONS, REQUIREMENTS, CONTENTS, AND FORMAT

3.1. Content – General.

An Offeror’s proposal without the minimum content may be determined ineligible for award and removed from the competition. The Government will not make assumptions concerning intent, capabilities, or experiences. Clear identification of proposal details shall be the sole responsibility of the Offeror. The Government may reject incomplete proposals after initial evaluation without further consideration.

All information intended to be evaluated as part of the technical proposal shall be submitted within the technical proposal. Do not include references to material or information not found within its respective volumes. Element 3: Past Performance References (Tab 2c)

The Government seeks an Offeror who maintains a strong commitment to customer satisfaction and superior performance. It is the Offeror’s responsibility to affirmatively document these qualities in its technical proposal.

Note, if a completed Contractor Performance Assessment Report System (CPARS) evaluation is available, it shall be submitted with the proposal. If there is not a completed CPARS evaluation, then the Offeror shall submit Attachment B – Past Performance Data Sheet, and Attachment C – Past Performance Questionnaire (PPQ) for each project included in Factor 3.

The definitions for this element shall not be confused with the language addressed under Factor 1 and 2. The definition of recent and relevant, as it pertains to past performance is defined below.

a . Recent, as defined under this factor, is a contract in process or completed within twelve (12) years of the Solicitation closing date. Information on recent and relevant subcontracts and/or commercial contracts may be submitted.

b. Relevant, as defined under this element, is a contract that is of similar in size, scope, magnitude, and complexity to the requirements as set forth in the Solicitation.

• Size: Design, manufacture, supply, and install digital static excitation systems for a hydro generator rated 45 MVA or greater.

• Scope: The Offeror’s submitted contract examples cover the areas defined in the scope of the project.

• Magnitude: The measure of the similarity of the volume, dollar value, and/or duration of the work actually performed under the Offeror’s submitted contracts to the scope of the project.

• Complexity: The measure of the similarity of technical difficulty, managerial intricacy, and/or required coordination of efforts and disciplines performed by the efforts in its submitted contracts to the scope of the project. For complexity, not only will the task performed by the Offeror be considered, but also the Offeror’s ability to coordinate task (e.g., concurrent performance requirements).

A Past Performance Data Sheet (Attachment B) is requested to be submitted for each contract to be considered an example of past performance, with exceptions to contracts that have a completed

CPARS.

The Offeror shall provide a detailed explanation demonstrating the similarity of the contract to the requirements of the Solicitation; a detailed description of the work performed for the contract; and role performed (e.g., Prime or subcontractor). The Offeror is responsible for the accuracy of all data provided. Past Performance information regarding predecessor companies, key personnel who have relevant experience, and/or subcontractors that will perform major or critical aspects of the Solicitation requirements may be provided as a past performance submissions.

For each contract(s) the Offeror describes in a Performance Data Sheet (Attachment B), the Offeror is requested to provide a PPQ (Attachment C) to a reference at the organization that awarded the contract. It is requested that the reference, not the Offeror, email the completed PPQ BEFORE THE DUE DATE FOR PROPOSALS directly to Contract Specialist Hien Ho, via email at Hien.Ho@usace.army.mil. Fax submittals will not be considered.

The Offeror shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other RFPs; however, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. The Offeror shall instruct its clients to reference the Solicitation Number in the subject line when submitting its PPQ(s). The PPQ is Source Selection materials. If the client submits a PPQ directly to the Government's point of contact, all successfully submitted PPQ(s) will receive an e-mail confirmation upon receipt. If the Offeror does not receive the confirmation, it is their responsibility to follow up to ensure the Government has received the information.

The Government intends to assess the relative risks associated with the Offeror’s performance based on the past performance information provided in its proposal and, if applicable, information obtained from available sources identified previously. A significant achievement, unexplained or unresolved problem, or lack of relevant data may significantly impact the risk rating by the Government.

Therefore, it is incumbent upon the Offeror to include all relevant information, including demonstrated corrective actions, in its proposal.

If any contracts were terminated, whether for default or cause, the Offeror shall list each, providing the contract number, title, brief type of work effort, and the reason for the termination.
