BIDDER’S QUESTIONS AND GOVERNMENT REPLY

1. (Questions that may be of general interest to all Bidders and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the bidders “For Information Only” and do not revise the solicitation, plans or specifications.)

Bidder Inquiry 01: Specifications are 95% classification. Please provide final specifications.

Government Response: Revised specifications included in Amendment 2.

Bidder Inquiry 02: Are contractors allowed to place pipeline and move equipment between STA 642+00 and 654+00 at their discretion?

Government Response: STA 642+00 to 654+00 are part of NPS jurisdiction. Please see Special Use Permit.

Bidder Inquiry 03: When is the anticipated date of Award and NTP?

Government Response: Award on/around 31 July. NTP on/around 15 August.

Bidder Inquiry 04: Will the contractors be allowed to transit the beach between Seaview and Davis Park without restriction at their discretion?

Government Response: Please review provided SUP and WQC.

Bidder Inquiry 05: Solicitation Form 1442 and Specifications do not match.

Government Response: Solicitation Form 1442 will be revised to match specifications.

Bidder Inquiry 06: How does the Government anticipate the Contractor working around the trap bags, whether above or below Grade?

Government Response: Existing bags are to be buried. Surveys indicated bags were below proposed elevations.

Bidder Inquiry 07: Please confirm that the mobilization phase of the project is regarded as a critical path activity, regardless if dredge is onsite.

Government Response: Yes, mob/demob are critical path. Critical Path is a continuous series of work items provided on an approved schedule. Breaks between Start dates constitute float and may affect the evaluation of the critical path and applicability of weather delays.

Bidder Inquiry 08: Section 34 21 00 suggest upland sites or Contractor provided disposal sites may/will be used, including diking, weirs and containment construction. Please advise.

Government Response: Upland disposal sites are referenced in Section 31 24 00 para 3.2.4 for any Floatable Material excavated or Debris encountered within beach fill placement area. Dikes, weirs, and containment structures for construction as necessary mentioned in Para 1.6 e. do not conflict.

Bidder Inquiry 09: Section 00 31 24 states that the Water Quality Certificate will be provided.

Section 31 24 00 references an attached WQC.

Government Response: Please refer to revised specifications.

Bidder Inquiry 10: Section 31 24 00.00 18 Paragraph 2.1 Character of Materials states that any debris larger than two (2) inches in diameter which is excavated and placed on the beach will be removed by the Contractor, totally at his own cost. We request this language be revised to not include “natural material” such as shell or rock. “ Government Response: This change will not be made. Please see revised specification.

Bidder Inquiry 11:

Government Response: +3.0’ elevation is in reference to the elevation to which the design grades must be met. Below +3.0’ - as noted in the specifications - if construction is not achievable (as it sometimes is not below MHW), the contractor has flexibility on placement design as long as the volume is met.

Bidder Inquiry 12: Section 35 20 23 Paragraph suggest this is a navigation channel project.

Please advise Final Examination and Acceptance.

Government Response: Concur. Section 35 20 23 Para 1.2.1 to be removed as this project is borrow area dredging.

Bidder Inquiry 13: Can the Government please confirm approved/allowable work window dates?

Government Response: Contractor should refer to applicable permits.

Bidder Inquiry 14: Can the Government please provide breakdown of costs for Tier 1 and Tier 2 Liquidated Damages? What Government cost/work does each tier amount include (number of individuals, classifications, overhead, etc.)?

Government Response: Liquidated damages will be assessed in accordance with the contract requirements. Tier 1 will be used when contract work has not been completed by the designated completion date. Tier 2 will only be used after substantial completion. Please see liquidated damages document.

Bidder Inquiry 15: If beachfill is not complete by the April 1 window, will Liquidated Damages be assessed during the window through to Sept 1? Which Tier?

Government Response: Please see response to bidder inquiry 14.

Bidder Inquiry 16: If beachfill is not complete by the April 1 window due to conditions outside Contractor/Government control, will any remobilization efforts be handled via an REA?

Government Response: We cannot respond to hypotheticals. Each situation will be addressed by Contracting Officer on their own merits.

Bidder Inquiry 17: Contract drawings show material to be placed on backside of some dunes, while the front side may exist above grade. Areas existing above grade are not to be disturbed.

How is contractor to access backside of dune without disturbing areas existing above grade?

Government Response: Contract drawings indicate proposed full dune template for reference.

Dune shall be constructed until existing ground is met. Existing dune not to be disturbed where elevations exceed proposed. Contractor is responsible for means and methods with Government approval.

Bidder Inquiry 18: Please add a Contract Line Item for debris/sand fence removal.

Government Response: Contract line item to be added for Debris Removal.

Bidder Inquiry 19: Contract Government provided laydown/staging areas and access points are not adequate. Please provide staging areas at all potential bay side access points.

Government Response: The contractor is responsible for arranging staging areas not otherwise identified in the contract documents.

Bidder Inquiry 20: What bayside access locations are provided by the Government?

Government Response: The contractor is responsible for arranging for bayside access.

Bidder Inquiry 21: The magnitude of the project differs throughout the solicitation and specifications. Please advise magnitude and funding available for this project.

Government Response: Solicitation text has been revised to reflect bid schedule (amendment).

Bid schedule amendment supersedes original post.

Bidder Inquiry 22: The Contract Duration differs from 180-250 days throughout the contract.

Please advise which is correct.

Government Response: Variation in duration reflects a dredging duration and an overall project duration. Pumping/dredging must be completed within 180 calendar days and in accordance with permits and specs. Total project features must be completed within 502 calendar days, in accordance with permits. Please see revised specification.

Bidder Inquiry 23: The National Park Permit is expired. Please provide valid permit.

Government Response: Please see updated permit.

Bidder Inquiry 24: The National Park Permit should allow access to Burma Road for personnel transit, especially for emergency situations and crew changes. While understanding all equipment and materials are to be delivered over water, daily Park access is required for crew and management.

Government Response: Contractor is responsible for beach access permits through National Parks. The government makes no commitments to vehicle access through National Parks.

Bidder Inquiry 25: If there are Emission NOx limits, please provide NOx calculator spreadsheet prior to bid.

Government Response: Calculator to be provided.

Bidder Inquiry 26: The Vibration Monitoring specifications require inside home inspections.

Some of the residents are seasonal. Please advise how these structures will be accessed/inspected.

Government Response: The government has made no prior arrangements for vibration monitoring. The contractor will need to contact homeowners.

Bidder Inquiry 27: Section 01 56 10 Paragraph 3.1.2 Note 2 states that all project vessels will have an on deck observer. Please advise if this requirement is for Hopper dredge ships only, or is to include all tugboats, crewboats and barges.

Government Response: Requirement is having the NMFS approved observer on the hopper dredge.

Bidder Inquiry 28: Insurance Section 01 30 00 Page 8 and 9 Note 10 refers contractors to see note on the Bid Schedule for capturing additional insurance costs. The Bid Schedule does not contain this note or include a Contract Line Item. Please advise.

Government Response: Please see revised bid schedule.

Bidder Inquiry 29: Is there a firm cutoff date for Question/RFIs and how are they to be submitted?

Government Response: The Government may but is not obligated to respond to RFIs sent by contractors after 28 June 2024, 11:59pm EST. RFIs are to be submitted to point(s) of contact listed on the solicitation.

Bidder Inquiry 30: Is bird monitoring required for this contract? If it is, is it the responsibility of the contractor to provide a monitor and what are the specific monitoring requirements?

Government Response: Please refer to Section 01 57 19, permits, and biological opinion to determine monitoring requirements.

Bidder Inquiry 31: In reference to Section 01 30 00, 1.4, are progress and completion photos required to be taken by a third-party photographer or is the contractor allowed to take and submit their own photographs?

Government Response: Section 01 30 00 paragraph 1.4 does not include language regarding the affiliation of the photographer.

Bidder Inquiry 32: In reference to Section 01 30 00, 1.4, what is the required frequency of aerial photographs, and can you please clarify any specific requirements for the aerial photographs?

Government Response: Requirements are as stated in Section 01 30 00 Paragraph 1.4.

Bidder Inquiry 33: Can you please provide the latest borrow area survey data in either XYZ or text format?

Government Response: Please see attachment “Borrow 2C ENElev_Navd88.txt”

Bidder Inquiry 34: Please confirm that Section 01 20 22, par 1.3.1.4 means 100’ cross sections with soundings recorded every 25’ for the pre and post construction survey and cross sections every 200’ with soundings recorded every 50’ for the weekly conditional surveys Government Response: Concur with submitted interpretation.
