About this file
This document appears to be Amendment 2 to the solicitation for the Fire Island Inlet to Moriches Inlet (FIMI) Reach PL 84-99, PIR 2024 Project. The project aims to repair and restore the eroded shoreline in Suffolk County, New York, through beach fill restoration of approximately 1.7 million CY, replacement of 35,202 ft of sand fencing, planting of 31 acres of dune grass, repair of 6-10 elevated timber dune crossover structures, and repair of two vehicular crossovers. The sand will be dredged from the Atlantic Ocean Sand Borrow Area 2C. The estimated construction cost range is between $50,000,000 and $100,000,000. The U.S. Army Corps of Engineers, New York District, is the federal agency responsible for this defense-related project.

Re: DEC #: 1-4799-00023/00009 Fire Island Inlet to Moriches Inlet
PL 84-99 Rehabilitation Project Water Quality Certificate (WQC)
Dear Mr. Weppler:
In conformance with the requirements of the State Uniform Procedures Act (Article 70, ECL) and its implementing regulations (6NYCRR, Part 621) we are enclosing your approved Water Quality Certification. This approval follows recent discussions held on site on June 7, 2024, during which NYSDEC staff emphasized that additional information was required for review if dredging was proposed within the Atlantic Sturgeon restriction window that extends from September 1 to November 30 inclusive. The specific information was a description of the temporal and spatial parameters for dredging the borrow area, and the completed Sturgeon Avoidance of Monitoring Plan (Plan) template that had been provided to the Corps in April 2024. Both pieces are necessary in order to determine potential impacts on the sturgeon by the dredge operation during a time when sturgeon are typically known to be in the area.
Your June 11, 2024 email responded in part regarding one aspect of the dredging procedure, but did not provide the Plan template for work proposed within the restriction window. Subsequent discussions held today revealed that such a plan may be shortly forthcoming for NYSDEC review, but as of this letter, it has not been received.
NYSDEC staff are certainly aware of the many challenges on numerous fronts presented by this project and look to continue with our efforts to work with the Corps in order to authorize the required work in a manner that sufficiently protects our sensitive natural resources.
Therefore, with understanding that the Corps needs the approved WQC no later than June 18, 2024, we have issued the WQC today with the standard restriction windows, and anticipate receipt of a sufficient Plan for 2024 which DEC staff understand is subject to the constraints of time and funding as determined by the Corps’ response under PL 84-99 to repair the damages after the storm events from January 7-13, 2024 within the Ocean Bay Park to Davis Park section of Fire Island. Upon receipt the 2024 Plan and request to work within the Sturgeon restriction window for this immediate 2024 project, we expect to issue a WQC modification in a very expedient manner.
Please carefully read all permit conditions and special permit conditions contained in the permit to ensure compliance during the term of the permit. If you are unable to comply with any conditions, please contact us at the above address.
Also enclosed please find a permit sign which is to be conspicuously posted at the project site and protected from the weather
Please contact me at 631-444-0369, or at kevin.kispert@dec.ny.gov if you have any questions, or need to discuss this matter. Thank you for your continued cooperation.
Sincerely, Kevin Kispert Permit Administrator Enclosures cc: NYSDEC Review Team mailto:kevin.kispert@dec.ny.gov

Facility Location: In MULTIPLE TOWNS in SUFFOLK COUNTY Facility Principal Reference Point: NYTM-E: 660.5 NYTM-N: 4502.3
Latitude: 40°39'21.5" Longitude: 73°06'05.3" Authorized Activity: Undertake a project to stabilize and restore the beach berm and primary dune at various locations along the length of Fire Island which are eroded during coastal storms. The proposed work is within the scope of the previous US Army Corps of Engineers (USACE) permit 1- 4799-00023/00008, and includes the removal, via hopper dredge, of up to 7 million cubic yards of sand from three offshore borrow areas and the placement of the material according to several beach berm construction and dune construction templates at various locations along the barrier beach from Robert Moses State Park to Moriches Inlet. The approximate total linear footage of beach berm and dune construction is about 16.12 miles, which will be undertaken in phases as needed.
Work on the overall project will take place on lands located in the towns of Brookhaven and Islip; and the incorporated villages of Ocean Beach and Saltaire; including the parkland of Suffolk County and New York State; and the federally-owned parcel containing the Fire Island Lighthouse.
The three offshore borrow areas from which the sand for the overall project will be obtained are designated USACE Borrow Areas 2C, 4C and 5B. Borrow Area 2C is an irregularly shaped area of approximate dimensions 2.6 miles long by 0.85 miles wide located about two miles off Point O' Woods and will be deepened by approximately 10-12 feet. Borrow Area 4C is an approximately 60 acre area located about 1 mile off Westhampton Beach which will be deepened by about 10 feet. Borrow Area 5B is an approximately 555 acre area located about 1.8 miles off Quogue which will be deepened by 10-12 feet.
The initial phase starts with Ocean Bay Park to Davis Park section of Fire island that spans 44,150 ft between those communities. The beachfill includes a beach berm at elevation +8.5 ft NAVD88, backed by a dune with a height of +14ft NAVD88. The dune will have a crest width of 25 ft and 1V:5H side slopes on both landward and seaward sides. The design berm width will be 90 ft plus advance nourishment fill, with a design onshore slope of 1V:12H to elevation +1ft NAVD88 and a design offshore slope of approximately 1V:40H to ocean bottom. The project’s fill template with approximately 1.7 million cubic yards of sand obtained from previously used Atlantic Ocean Borrow Area 2C. The project also includes replacement of approximately 35,202 ft of sand fencing, planting of approximately 31 acres of American Beach Grass (Ammophila breviligulata), repair of approximately 6- 10 elevated timber dune crossover structures, and repair of approximately two vehicular crossovers.
The plan view and cross-section drawing sets for each subsequent phase of the project will be submitted for DEC review and approval at least 30 days prior to construction commencement of the phase.
