SECTION SF 1449 - CONTINUATION SHEET
Clarification to Amendment 0007
1. The responses in AMD 007 for Q2 and Q10 regarding subcontractor submission of Attachment 3 – Employee Total Compensation Plan Pricing Sheet are in direct conflict with each other.
Q2 States: Subcontrator is required to submit Total Compensation Plan if the Prime is utilizing any of the subcontractor rates
Q10 States: Offeror is required to complete Attachment 3 - Employee Total Compensation Plan Pricing Sheet is only for seven (7) professional LCATs. The Government is requesting for all subcontractors, prime, and teaming partners to submit Attachment 3.
From Q2, generally workshare is not part of the teaming agreements because as an IDIQ and not having Task Orders to bid, no subcontractor would be designated in advance for a 25% workshare. Additionally, when bidding an IDIQ, the Prime determines the appropriate target rates (which is discussed in the Price Narrative) and verifies they are acceptable with the subcontractors (subcontractors that cannot meet a specific rate generally do not bid LCATS for that rate in subsequent Task Orders and it is the prime’s responsibility to ensure the expertise requested is available on the team within the rates bid on each Task Order.
We do understand the TCPPE’s are required only for the Professional LCATS discussed in Q10. However, we are not using subcontractor rates in our bid, we are now unsure if they are required from our teammates (subcontractors).
Would the government please clarify – ARE TCPPEs and associated information (Revised Proposal Preparation Instructions from 29 Dec 2020, Factor 5 - Price, Tab C items i through iv) required from ALL subcontractors and Teaming Partners?
Response: Attachment 3 – Employee Total Compensation Plan Pricing Sheet is required for ALL prime, subcontractors, and Teaming Partners.
2. Amendment 7 Question 2 Response indicates subcontractors are only required to submit the Attachment 3 TCPPE if the Prime is utilizing any subcontractor rates.
Amendment 7 Question 10 Response states “The Government is requesting for all subcontractors, prime, and teaming partners to submit Attachment 3.
Is Question 2 Correct or is Question 10 Correct?
Response: The response at Amendment 0007 Question 10 is correct.
3. Amendment 7 Question 9 Response: Seven (7) ceiling rates for the Professional Employees will be evaluated. The Government is requesting ceiling rates for professional and non-professional labor categories to be proposed at the “Top Level and Hours” found in Attachment 1 – Pricing Worksheet.
We interpret this to mean we will submit seven (7) ceiling rates for the following professional (Base) labor categories.
Program Manager Cyber Instructor Signal Instructor Cyber TRAP Instructor Signal TRAP Instructor Doctrine Support Training Developers
Each of these seven (7) professional labor categories will require an Attachment 3 TCPPE from both the Prime and All Subcontractors depending on the answer to Question 2 or Question 10 (please clarify). Is this correct?
Response: Correct. Each of the seven (7) professional labor categories will require an Attachment 3 - Employee Total Compensation Plan Pricing Sheet from the Prime, all subcontractors, and Teaming Partners.
4. Amendment 7 Question 8 Response: The government’s expectation is for the offerors to propose their ceiling rates for the labor categories and estimated hours as listed in Attachment 1- Pricing Worksheet.
We interpret this to mean we will provide TE 6 Labor Category ceiling rates under each of the seven (Base Labor Categories) in Attachment 1. Those TE 6 ceiling rates will then become part of the awarded ID/IQ. Is this correct?
Response: Yes. Offerors must provide ceiling rates under each of the labor categories listed in Attachment 1 – Pricing Worksheet. Please note that the Government is requesting for rates for the Base Year and four (4) Option Years. The ceiling rates will become part of the awarded ID/IQ. It will be reflected in the CLIN Pricing for the Schedule of Supplies/Services, which shall carry over the totals from Attachment 1 - Pricing Worksheet.
5. Finally, if our interpretation of the Amendment 7 Question 8 response is correct.
Would a blended rate for each Base Labor Categories be the rate used for the seven Attachment 3 TCPPEs?
If we use the highest ceiling rate from TE 6 under each of the seven Base Labor Categories, it will artificially inflate the Total Contract Value in Attachment 1.
Example: The total Cyber Instructor cost (TE 6 labor categories) totaled and then divided by the total Cyber Instructor Hours to provide a “blended rate” which would be the total rate in the TCPPE?
Cyber Instructor 165,030 $75.74 $12,500,000.00
Operating Systems Instructor/Content Developer 11,520
Networking Instructor/Content Developer 11,520 $100.00 $1,52,000.00
Information Security Instructor/Content Developer 11,520
CEMA Instructor (Instructor/Writer) 11,520
ULO Instructor (Instructor/Writer) 11,520
17E Instructor (Instructor/Writer) 11,520
170B Instructor (Instructor/Writer) 11,520
WOAC Instructor 11,520
17B Instructor 11,520
Range Facilitator 11,520
Training Section Manager 7,680
Training Operations Manager 1,920
Instructor Shift Leads 19,200
Training Support Lead 9,600
Instructor 11,430
Response: This is not a Lowest Price Technically Acceptable Solicitation; we will be conducting a Trade-Off. Offerors will need to provide the highest ceiling rate for the ID/IQ level. At the task order level, offerors can provide a lower rate to be competitive.
6. Amendment 0007 Offerors' questions # 1, 3, 8, and 9 describe the complication experienced by offerors in developing a single ceiling rate that encompasses multiple labor categories with a wide variety of qualification requirements and labor pool availability. Many offerors have asked for more historical workload data so we can accurately develop a weighted composite ceiling rate for the Instructor (4 categories), Doctrine Support, and Training Developer. The Government has declined to provide the information all offerors need in a competitive environment. Please reconsider providing that workload data so all offerors develop fair and reasonable ceiling rates.
Response: The Government has provided all the necessary and available workload data. Please refer to Technical Exhibit 6 Rev-2.
7. The Government's answers to Amendment 0007 questions #2, 5, 10, 11, 14 provide conflicting responses regarding the need for subcontractors to submit Attachment 3 - Employee Total Compensation Plan Pricing Sheet. The answer to #2 says subcontractors need only submit Attachment 3 if the Prime used the subcontractor's rates. The answers to #5, 10, 11, and 14 requires "All Subcontractors, Prime, and Teaming Partners are required to submit Attachment 3 - Employee Total Compensation Plan Pricing Sheet." Please clarify whether subcontractors/teaming partners are required to submit Attachment 3 if the Prime does not use subcontractor prices to establish the proposed ceiling rate.
Response: Attachment 3 – Employee Total Compensation Plan Pricing Sheet is required for ALL prime, subcontractors, and Teaming Partners.
8. Amendment 0007 Page 2, Response to #2; Page 5, Response to # 11; Page 6 Response to # 14 - The response to Question #2 states “the a subcontractor is required to submit a Total Compensation Plan (TCPPE) if the Prime is utilizing any of the subcontractor rates.” However, the Response to Questions #11 and #14 indicates that subcontractors are required to submit a TCPPE regardless. If the Prime is NOT using any of the subcontractor rates, (the subcontractor has agreed to utilized its Prime’s rates), the Response to Question #2 does not required a TCPPE from the subcontractor. Please confirm that this is correct. The issue of whether a TCPPE is due from the subcontractor is not entirely clear based on the response to Question #2.
Response: Attachment 3 – Employee Total Compensation Plan Pricing Sheet is required for ALL prime, subcontractors, and Teaming Partners.
9. Can you please confirm which of the following is correct: If the offeror is intending on only using their own rates and NOT using their subcontractors’ rates, that they DO NOT need to have their Subcontractors submit separate Total Compensation Plans for each of the seven professional labor categories.
Or
If the offeror is intending on only using their own rates and NOT using their subcontractors’ rates, that they STILL MUST have their Subcontractors submit separate Total Compensation Plans for each of the seven professional labor categories.
Response: Attachment 3 – Employee Total Compensation Plan Pricing Sheet is required for ALL prime, subcontractors, and Teaming Partners. If the offeror is intending on only using their own rates and not using their subcontractors’ rates, they still must have their Subcontractors submit separate Total Compensation Plans for each of the seven professional labor categories.
10. Amendment 00007 Question #2 states that subcontractors/teaming partners need only submit a TCP if the Prime is utilizing their rates. However question 14 states “Subcontractors, Prime, and Teaming Partners are required to submit Attachment 3 - Employee Total Compensation Plan Pricing Sheet.” Is it the Governments intent to only receive TCPs from subcontractors/teaming partners where their pricing is included in the Prime submission?
Response: Attachment 3 – Employee Total Compensation Plan Pricing Sheet is required for ALL prime, subcontractors, and Teaming Partners.
11. Amendment 007, questions #2, #10, #11, and #14 appear to contradict each other with regards to who is required to submit a TCPPE. Please confirm that a subcontractor is required to submit a TCPPE only if the Prime is utilizing any of its rates, otherwise a TCPPE is not required for that subcontractor.
Response: Attachment 3 – Employee Total Compensation Plan Pricing Sheet is required for ALL prime, subcontractors, and Teaming Partners.
