Justification and Approval for Other Than Full and Open Competition

1. Contracting Activity:

173D Contracting Flight 211 Arnold Ave, Suite 35 Kingsley Field ANGB Klamath Falls, OR 97603

2. Description of Action: A new competitive firm fixed price construction contract for project which includes “Brand Name Only” component for the Fire Alarm Panel/Transmitter - Monaco Fire Detection and Alarms System. The funding source will be MILCON.

3. Description of Supplies/Services: ANG Project # KJAQ119006, Construct Corrosion Control Hangar– Kingsley Field, OR included one Brand Name for the Fire Alarm Panel/Transmitter- Monaco Fire Detection and Alarm including the Panel, Transmitter and all associated installation by a certified installer, commissioning and training requirements for the implementation of a complete Fire Alarm Panel and Mass Notification System. MILCON funds will be utilized for this requirement.

4. Authority Cited: 10 United States Code 2304(c) (1), as implemented in Federal Acquisition Regulation 6.302-1 Only one responsible source and no other responsible source and no other supplies or services will satisfy agency requirements - it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.

5. Reason for Authority Cited: Only one responsible source, Monaco Enterprises, Inc and no other source of supply will satisfy agency requirement for the Fire Alarm System. The 173d Civil Engineering Squadron currently uses the Monaco Fire Alarms System at Kingsley ANGB.

The new fire station will need to fully integrate with the existing Fire Alarm System. The central supervising station receiving equipment is Monaco D2100 and the transceiver must be fully compatible with this equipment. Acquiring a different alarm system as a whole would incur the additional cost of training as well as doubling maintenance and equipment costs due to maintaining two different systems. By procuring an identical system, maintaining will be standardized and costs would be easier to control. Kingsley Field currently send 3 personnel to annual Monaco training at a cost of approximately annually. Procuring a different panel would add an additional annual training requirement that Kingsley Field’s travel authorizations may not be able to guarantee.

6. Efforts to Obtain Competition: The solicitation for the construction contract is being issued as a total small business set aside competitive Invitation for Bid. The brand name components represent a small portion (0.01%) of the overall construction project that is being competed.

7. Actions to Increase Competition: None.

8. Market Research: The following market research techniques (FAR Part 10) were conducted within the previous 6 months:

a. Contacted knowledgeable individuals in the Government, including the ORANG Base Civil Engineer and Deputy Base Civil Engineer, Fire Prevention Officer, Base Electricians and the ANG Civil Engineer Technical Support Center regarding the market capabilities to meet the requirements.

Querying the Government wide database of contracts and other procurement instruments intended for use by multiple agencies that provide information relevant to agency acquisitions. Search of www.fbo.gov indicated within the last 12 months that the Departments of the Army and Air Force has posted similar justifications for brand name requirements for their applicable construction contracts.

In addition, the pre-solicitation notice specifying the intent to purchase this brand name equipment will be posted to FebBizOpps. This notice will invite persons who may have interest or capability to provide compatible equipment to respond accordingly. Any responses will be evaluation accordantly.

9. Interested Sources: There are no known alternative systems that are fully compatible with the aforementioned systems based upon lessons learned and expert judgement by the subject matter experts and experience of the Oregon Air National Guard, National Guard Bureau, and Air Force.
