About this file
This is a Title VI Assurances document establishing nondiscrimination compliance requirements for the City of Pasadena's Holly Street Bridge Seismic Retrofit and Rehabilitation Project, which is federally funded through the Highway Bridge Program administered by the California Department of Transportation and the U.S. Department of Transportation. The document outlines mandatory compliance provisions that the selected construction management consultant and all subcontractors must incorporate into their work performance and contractual agreements. The consultant is required to adhere to federal nondiscrimination regulations under Title 49, Code of Federal Regulations, Part 21, and must ensure that no discrimination occurs based on race, color, sex, national origin, religion, age, or disability during work performance, personnel selection, retention, procurement of materials, or equipment leasing. All subcontractors and suppliers must be notified of these nondiscrimination obligations, and the consultant is obligated to provide required information and reports to verify compliance with applicable regulations.
The document establishes enforcement mechanisms through which the City of Pasadena or the Federal Highway Administration may impose sanctions for noncompliance, including withholding of payments for up to 90 days or partial or complete cancellation, termination, or suspension of the contract. The assurances encompass compliance with multiple federal statutes and authorities, including the Civil Rights Act of 1964, the Rehabilitation Act of 1973, the Age Discrimination Act of 1975, the Americans with Disabilities Act, Executive Order 13166 regarding Limited English Proficiency access, and Title IX of the Education Amendments of 1972. The consultant must include all applicable Title VI Assurance provisions in every subcontract unless otherwise exempted by federal directive and must permit access to books, records, accounts, and facilities for compliance verification purposes.
