About this file

This is a Questions and Answers document for Defense Logistics Agency (DLA) Energy Solicitation No. SPE603-25-R-0512 related to corrective action taken after a bid protest pre-filing notice was received at the United States Court of Federal Claims on April 10, 2026. DLA Energy took corrective action on July 17, 2026, through Amendment 0010, placing previously-awarded contracts under a Stop-Work Order pursuant to FAR 52.233-3 while the agency reconsidered the points raised. No formal protest was filed, and no Freedom of Information request was received. The Government will conduct discussions with offerors and provide competitor pricing information during that process to ensure fair competition.

The corrective action required DLA Energy to further specify solicitation requirements, specifically the minimum number of trucks and capacity needed to perform contract requirements. This information was derived from pre-solicitation market research and an Independent Government Cost Estimate but was omitted from the original Performance Work Statement, limiting offerors' ability to compete equally. Offerors previously deemed unacceptable may now revise their proposals to meet the newly specified minimum truck and capacity requirements to achieve technical acceptability. All offerors in the competitive range will submit Final Proposal Revisions and have their proposals evaluated. Offerors must use current Collective Bargaining Agreements (CBAs) for Randolph AFB (expiring September 30, 2026) and Laughlin AFB (expiring November 30, 2026) as baseline pricing, with future CBA changes incorporated through contract modifications with equitable price adjustments per FAR 52.222-43. The contractor must maintain sufficient operational vehicles to ensure the minimum specified fleet remains operational at all times across respective service locations.

QUESTIONS AND ANSWERS

1. Did DLA Energy receive a notice of a bid protest filing?

Yes, DLA energy received, after contract award, a notice of protest pre-filing at the United States Court of Federal Claims (COFC) on April 10, 2026. The points raised led the Government to take corrective action on July 17, 2026.

2. If a protest was filed, is this action (Amendment 0010) a direct reason, or even resolution, for that protest?

DLA Energy took corrective action as a result of our independent assessment of the points raised. No protest was ever filed.

3. Did the COFC cause a FOIA request to be made for competitors’ proposal?

No, DLA Energy has not received a Freedom of Information request.

4. How is the Government conducting discussions when Solicitation No. SPE603-25-R- 0512 has resulted in award?

The previously-awarded contracts from solicitation No. SPE603-25-R-0512 are under a Stop-Work Order pursuant to FAR 52.233-3 (Protest After Award), which suspends performance while the agency considered the points raised in the pre-filing notice. If another offeror is selected after discussions/the corrective action has concluded, the Government will terminate all of the previously issued contract awards of SPE603-25-R- 0512 for Convenience (e.g., FAR 52.212-4(l)).

5. How can a solicitation still be open after a contract is awarded and signed?

See the response to Question 4.

6. Can competitors anticipate the release of all competitors’ pricing in order to ensure that there is fair competition? be released to ensure level competition?

The Government will be providing this information during discussions

7. Why is the number of trucks and capacity suddenly specified?

The corrective action requires DLA Energy to further specify the solicitation requirements. DLA Energy determined that providing information about the trucks and capacity promotes full and open competition.

8. Where did the Government get the number of trucks and capacity from? Did the Government formulate the minimum number of trucks after the solicitation was awarded and signed?

Before the solicitation was released DLA Energy performed market research and created an Independent Government Cost Estimate. The Government already estimated the minimum number of vehicles needed to perform the requirements of the contract before the solicitation was released. However, DLA Energy did not provide the information in the Performance Work Statement (PWS), which, it has determined, limited offerors’ ability to understand the Government’s needs and, therefore, to compete on an equal basis and for that reason, may have discouraged potential competitors from joining the competition.

9. Did offerors have the opportunity to correct their proposals with their FPR, submitted in November 2025?

Yes. Final Proposal Revisions from the original solicitation did allow all offerors in the competitive range to submit an FPR and correct deficiencies from the initial evaluation.

10. Does the amendment to the Performance Work Statement (PWS), minimum number requirement for trucks and capacity, mean that Offerors must provide the minimum number of tracks and capacities described in the PWS in order to be considered “technically acceptable”?

Yes, all offerors must meet the minimum requirement for trucks and capacities as it is described in the PWS to be considered technically acceptable. All offerors that ignore or do not meet the requirement as stated in the PWS will be deemed technically Unacceptable.

11. Can offers that were determined before to be ‘Unacceptable’ now have a chance to correct their proposals after award?

Yes.

12. Since trucks and capacities came into question during an apparently, open and active solicitation, why weren’t the questions and answers posted to SAM.gov?

The pre-filing notice of protest was not filed until after award. Accordingly, no notice was posted on SAM.gov.

13. Concerning solicitation SPE603-25-R-0512; what are the current number of employees and labor categories?

DLA Energy cannot provide this information. The current solicitation is not dependent upon the current number of employees and labor categories. Offerors must submit their offers based on solicitation No. SPE603-25-R-0512 PWS requirements. Each Offeror’s offer should include the number of employees and labor categories based on the current solicitation PWS requirements. The Government is evaluating offerors based on the current solicitation requirements not past solicitation requirements.

14. Will the Government engage in Evaluation Notices of the Contractor’s submitted Final Proposal Revision (FPR)? Or is the Contractor’s FPR considered the Best and Final Offer?

Yes, all proposals from offerors in competitive range will be evaluated.

15. Reference Appendix M, Aircraft Workload Information: The Government lined through the 99th T-1 Jayhawk aircraft and number of servicing’s. Will the Contractor be required to provide services on day 1 or is this no longer a requirement to be performed by the contractor?

This is no longer a requirement to be performed by the contractor.

16. Please confirm DLA Energy’s intent that Contractors need to only revise truck information (quantity and capacity) in Sub-factor 8 as instructed in Amendment 0010.

As stated in amendment 0010, offerors are to revise any portions of their proposals affected by the provision of minimum truck requirements to include the associated technical/Management volume and Price volume.

17. Appendix M for Laughlin AB retail service station is now marked as N/A, which is a change from the PWS/Appendix M dated 8 May 2025. Service station facility number 2109 is listed in Table (5) IP (Facilities) of the old PWS/Appendix M and Randolph AB Appendix M also has changes highlighted for “Hours of Operations”, the average number of Jet A tank truck receipts and deletion of the 99th T-1 Jayhawk aircraft. Are these revisions accurate and no longer applicable to the requirement or do we also need to address these changes in our revised proposal?

No, not entirely. While the new COCO service station is managed by another contractor, you are still required to manage the Laughlin AFB old service station until it is officially taken out of service.

Yes, the T-1 Jayhawk aircraft are no longer located at Randolph AFB or Laughlin AFB.

You only need to revise your proposal to address the truck quantities and capacities. The tank truck receipt numbers remain exactly as they were in the initial solicitation posting.

18. Regarding the minimum operational fleet required, if a contractor proposes only the stated minimum number of trucks, any vehicle taken out of service for preventive maintenance, required inspections, repairs, or unexpected downtime could cause the contractor to fall below the minimum and become noncompliant. Could you please clarify whether offerors are expected to propose sufficient additional or backup vehicles to maintain the minimum operational fleet at all times?

In accordance with PWS Appendix M, the Contractor shall provide and maintain an operational fleet of enough vehicles to meet the minimum specified number of trucks for each respective location at all times. The stated minimum fleet must always be operational.

19. The current CBA for Randolph AFB expires on September 30, 2026, and the current CBA for Laughlin AFB expires on January 1, 2027. Because the anticipated award and performance-start dates have not been established, offerors cannot determine whether the existing CBAs, newly negotiated successor agreements, or other wage determinations should be used for pricing. Could you please clarify which CBA wage and fringe benefit rates offerors should use for each location. Additionally, please explain how the Government intends to incorporate and provide corresponding price adjustments for any new or revised CBA that becomes effective before or shortly after contract award or the start of performance.

The current CBA for Randolph AFB, TX, expires on September 30, 2026, and the CBA for Laughlin AFB, TX, expires on November 30, 2026. Please refer to solicitation amendment (SPE60326R0512 0012) for the revised period of performance dates.

Offerors must use the current CBAs issued with the solicitation as the baseline for all proposal pricing.

Upon an anniversary period following a successor CBA, the Government will issue a contract modification to incorporate the agreement in accordance with FAR 52.222-43 (Fair Labor Standards Act and Service Contract Labor Standards—Price Adjustment).

Once wages and fringe benefits are incorporated into a contract, the Government will issue a corresponding equitable price adjustment.
