About this file

This document contains a Justification and Approval for Other Than Full and Open Competition for a federal contract opportunity to renovate primary PACT buildings 340 and 341 at the Dayton VA Medical Center. The project includes construction of a new building with architectural walls and finishes, roofing, heating, plumbing, and electrical work. The justification specifies that Chicago Faucets' electronic AC faucets with internal temperature control mixers are required to reduce water consumption and the potential for transmission of bacteria or viruses by minimizing contact with faucets. Only Chicago Faucets can provide a system that fully integrates with and is compatible with the Dayton VAMC's existing faucet and water distribution system. The contracting officer has determined the anticipated costs to the government will be fair and reasonable.

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: 36C250-21-AP-4469

1. Contracting Activity: Department of Veterans Affairs, NCO 10, Dayton VA Medical Center 2237: 552-22-1-6932-0002

2. Nature and/or Description of the Action Being Processed:

Requirement of the contractor to use “Chicago Faucets” Electronic -AC Faucets. This project is named “Renovate Primary PACT Bldg. 340 & 341” and the purpose is to construct a new building on the Dayton VA campus at which legionella infection is a major concern. The project includes the construction of a new building with architectural walls and finishes, roofing, heating, plumbing and electrical work to support the proposed renovation.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

As part of a project to “Renovate Primary PACT Bldg. 340 & 341” at the Dayton VAMC, the building will be receiving new infrastructure. This will require providing a plumbing system compatible with the campus existing systems. The “Chicago Faucets”, Electronic -AC Faucet, with internal temperature control mixer is required to reduce water consumption, as well as the potential for transmission of bacteria, viruses, and other microbes by minimizing contact with the faucet.

Therefore, the system, when properly integrated, can significantly reduce or eliminate the potential for bacteria growth.

4. Statutory Authority Permitting Other than Full and Open Competition:

41 USC §3304(a)(1), as implemented by FAR 6.302-1.

( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The medical center needs to have an effective way of limiting the potential for bacteria growth inside their plumbing fixtures. This product provides the solution of a thermal disinfection, at the dispenser which is currently not available from other manufacturers.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

This procurement will be competed/synopsized on Contract Opportunities and will indicate the requirement for brand name specification regarding the Automated Water Dispensers. Since the construction contract is being awarded as a firm fixed price contract through competitive sealed bidding, the bidders are incentivized to locate the supplier that will provide the item at the most economical price. Other faucet manufacturers do not provide the availability and compatibility needed at the Dayton VAMC, full integration and compatibility cannot be achieved through other available manufacturers.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable:

It is in the best interest of the government to use this product.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

The Chicago Faucet system has been established and maintained here at Dayton VAMC. This facility has multiple devices and each one must be standardized to function properly for patient safety and facility maintenance efficiency. A system of this size would be unmanageable without standardization.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

This manufacturer is the only one that will provide integration to the existing faucet and water distribution system and reasonable delivery time at this location. The availability of this type of system has been an issue with other manufacturers.
