About this file
This Performance Bond document is issued by the City of St. Cloud, Florida for the 17th Street T-Ball and Baseball Field Improvements project (ITB No. 2023-143). The bond is a legal instrument that guarantees the contractor's full and faithful performance of the contract, with a bond amount equal to 100% of the contract value. The performance bond provides protection for the city in case of contractor default, outlining specific remedies such as the surety's ability to complete the contract within 210 calendar days or obtain new bids to finish the project.
The bond includes specific provisions required by Florida Statute 255.05, which outline the rights of claimants who have not received payment for labor, materials, or supplies. Claimants must provide written notices within specified timeframes: a preliminary notice within 45 days of beginning work, and a final notice within 90 days after completing labor or delivering materials. The bond also stipulates that no action can be instituted against the principal or surety after one year from the performance of labor or delivery of materials, except for actions brought by the owner.
