PART 1 GENERAL
1.1 SUMMARY
The Contractor shall provide personnel as needed to perform all required services including, but not limited to those described in this solicitation. The services described or specified shall not be deemed to constitute a comprehensive specification, having the effect of excluding services not specifically mentioned. The Contractor must assign and maintain a team with the expertise and capability to manage and coordinate the timely and orderly design assistance and construction of the proposed project.
This project requires Early Contractor Involvement (ECI). The initial contract will include a price for pre-construction services, an initial target price for construction and an initial target profit for construction. The Contractor shall provide preconstruction services to assist the Government in the development of a constructible, life-cycle cost effective facility. Preconstruction services include, without limitation, advice on the time and cost consequences of AE design decisions, market conditions, material availability, constructability and sequencing, in order to execute the project in accordance with the project schedule, and within the Ceiling Price. Ensure incorporation of these goals in project delivery. Consider all stages of the building lifecycle, including deconstruction, rehabilitation, re-purposing, or demolition.
The Government (NAVFAC SE) will design this project In-House and will be the A/E of record.
Upon completion of the Pre-Final design package, the Government will request a firm fixed price proposal from the Contractor for the associated construction/deconstruction effort. The Government and Contractor will negotiate a firm fixed price for the construction/deconstruction effort with the appropriate profit adjustments, in accordance with FAR 52.216-17.
The Government may then award the construction/deconstruction effort.
1.2 PROJECT DESCRIPTION
This project constructs an Advanced Helicopter Training System (AHTS) compliant aircraft maintenance hangar, with capacity for servicing 37 new helicopters being procured for the AHTS, and space for maintenance crews and three helicopter pilot training squadrons. The building consists of one, drive-through, high bay optimization hangar (OH), with additional spaces for crew and equipment, training areas, administrative areas, data network areas and a limited food vending area. Construction will consist of a steel framed super structure bearing on shallow concrete foundations.
Exterior wall systems include brick veneer, insulated metal wall panels and insulated translucent wall panels. Interior wall systems include a combination of concrete masonry unit walls and gypsum board on cold-formed metal supports walls. A low slope standing seam metal roofing system will be provided, as well as two sets of hangar sliding doors.
DOCUMENT 00 22 12 Page 3
1.3 ANTICIPATED AWARD PERIOD
The Government anticipates award of this contract by August 2021. Award of construction option for work described is tentatively planned for Feb 2023.
Exercising the construction option is subject, in part, to authorization and appropriation of funds for the project by Congress and successful negotiation of final pricing with the contractor. The Government does not guarantee award of option within the time periods stated above nor shall the Government be liable for any contractor costs should the option be exercised before or after the time periods, or not at all.
1.4 EXERCISING THE CONSTRUCTION OPTION
The government reserves the absolute right to exercise or not exercise the construction option. Exercising the construction option is contingent on several factors, which may include, but are not limited to the following:
a) The ability to negotiate a firm fixed price for construction within funds available. If a negotiated price within the funds available for the project cannot be reached, the government reserves the right to not exercise the construction option and issue the project for competitive bidding.
b) Congressional authorization and appropriation. This project is line item appropriated by Congress. If Congress does not authorize and appropriate funds for the project, the construction option will not be exercised or will be delayed until Congress approves the project.
c) Participation of the contractor during the preconstruction services. If the contractor does not participate at an acceptable level during design in all phases as outlined in this solicitation, the government reserves the right to not exercise the construction option and issue the project for competitive bidding.
1.5 CONTRACTOR RESPONSIBILITIES
The Contractor shall provide the Government with sound management advice regarding the approach to the project, how to achieve the best value in the work being accomplished, necessary actions to minimize cost and risk, schedule control, alternative ideas, problem/claim prevention, and budgeting. The Government design team will retain complete responsibility of the design documents. The Contractor is not authorized to perform any design services related to the performance of their duties.
The Contractor shall have complete responsibility for construction of the facility if the construction option is exercised, including, without limitation, coordination of regular construction meetings, scheduling, maintaining construction records, including daily logs and monthly reports, total building commissioning and turnover to designated facility management staff.
Contractor responsibilities during preconstruction include, but are not limited to, providing construction cost estimate and anticipated construction schedule, review and evaluation of the design documents for constructability, operability, value engineering, risk management and identification of any problems or errors in the design and design documentation. Also included are consultation during construction document production, assistance in defining bid packages and construction phasing, integration of IT and development of subcontractor and supplier interest.

Bonding is not required for the design, procurement and installation of FF&E and A/V.
3.3.4.1 Handling and Administration Rate
Offerors may propose a Handling and Administration Rate (HAR) for the FF&E and A/V not to exceed 5 percent. The Contractor will only be evaluated on the HAR rate applied to the Government Estimate. The actual total cost of the awarded planned modification will be the total of the accepted Final design packages for FF&E and A/V plus their respective HAR rates included in the CLIN schedule. This fee shall account for administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E and A/V. The proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E and A/V. The proposed HAR is a fixed rate.
3.3.4.2 Government Option
The Government is not obligated to award Planned Modification line items.
Should the Government choose to award a Planned Modification, the line item will be awarded as a negotiated modification to the contract. The Contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E and A/V.
3.3.4.3 Schedule Impact
If awarded, the FF&E and A/V modifications will be awarded at least six months prior to the contract completion date. The Contractor's schedule must assume the award of the FF&E and A/V as modifications. No schedule extensions will be granted if the modification is awarded at least six months prior to the contract completion date. If the Government decides to
DOCUMENT 00 22 12 Page 11 negotiate and award a Modification less than six months prior to the contact completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor demonstrates that accepted Final FF&E and A/V packages were submitted within the approved schedule deadlines and sufficient lead time for the FF&E and A/V are not available due to cause outside the Contractor's control; or the Government's award of the modification is in the period less than the last six months of the contract.
3.3.5 Changes
Except as provided above, changes in the contract price or time to complete the project will be made only due to changes made by the Government in the work to be performed, or by delays caused by the Government.
3.3.6 Competitive Pricing of Subcontracted Work
For all CLIN 0002 subcontracted work, the Contractor should obtain competitive pricing from a minimum of three (3) independent sources. The results of competitive pricing shall be made available to the Government.
For items or work where three sources are not available due to circumstances such as uniqueness of the item, limited sources, or regional shortages, the Contractor shall substantiate this situation to the satisfaction of the Government. The Contractor shall make recommendations for change or substitution of these items to promote the maximum competition available. The Contractor shall solicit drawing and specification reviews from all sub-contractors pricing the work, and shall ensure that the sub-contractor pricing reflects the costs for resolution of any errors or omissions that were noted.
3.4 CONTRACT PLANS AND SPECIFICATIONS
The Contractor shall provide a complete and usable facility in accordance with the approved plans and specifications. The plans and specifications will be added to the contract at the time the construction option(s) is (are) exercised.

1.2 GENERAL BID NOTES
a. Award will be made on the amount of Contract Line Item 0001.
b. Upon completion of the Pre-Final design package for the remaining work, the Government will will request a firm fixed price proposal from the Contractor. The Government and Contractor will negotiate a firm fixed price for the construction effort with the appropriate profit adjustments in accordance with FAR 52.216-17. The Government may then award the construction efforts for the remaining work package. (See section 00 22 12 EARLY CONTRACTOR INVOLVEMENT).
d. Evaluation of Options (JUL 1990). Except when it is determined in accordance with FAR 17.206(b) Evaluation not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the price for the Option(s) to the total price for CLIN 0001. In accordance with FAR 52.217-5 Evaluation of Options, evaluation of options will not obligate the Government to exercise the Option(s).

1.3 PLANNED MODIFICATION BID NOTES
These notes apply to Planned Modification CLINs.
a. The estimated amount for FF&E and A/V has been supplied by the Government, to provide offerors with the projected magnitude of effort. The estimated amount includes the actual cost of the FF&E and A/V, including freight and installation charges. The Government FF&E and A/V Estimate is only an estimated amount.
b. If awarded, line items will be funded separately after completion of FF&E and A/V design package review by the Government, and receipt of appropriate funding by the Government. Requirements and details are provided in Section 01 30 01.00 23 DESIGN PROCUREMENT AND INSTALLATION
OF FURNITURE, FIXTURES, AND EQUIPMENT.
c. Bonding is not required for the procurement and installation of FF&E and A/V equipment.
d. Offerors may propose a Handling and Administration Rate (HAR) for the FF&E and A/V not to exceed 5 percent. This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E and A/V. The proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E and A/V. The proposed HAR is a fixed rate.
e. The Government is not obligated to award the Planned Modification line item(s). Should the Government choose to award the Planned Modification, the line item will be awarded as a negotiated modification to the contract/task order. The Contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E and A/V.
f. If awarded, the FF&E and A/V modification will be awarded at least six months prior to the contract completion date. A minimum of six months is required for the Contractor to purchase, deliver and install the FF&E and A/V without impacting the overall completion date of the project. The Contractor's schedule must assume the award of the FF&E and A/V as a modification. No schedule extensions will be granted if the modification is awarded at least six months prior to the contract completion date. If the Government decides to negotiate and award the furniture modification with less than six months prior to the contact completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor demonstrates that an accepted Final FF&E and A/V package was submitted within the approved schedule deadlines and sufficient lead time for the FF&E and A/V is not available and the Government's award of the modification is in the last six months of the contract.
