17) Provide answers to the following questions:
NOTE: Attachment numbers for Section J and Section L attachments were renumbered due to additional attachments being added to the solicitation. The revised Section J List of Attachments and the revised Section L List of Attachments include the updated attachment numbers.
Q.1: On the solicitation for NIH0F2013536, Attachment L2, the date appears to be incorrect for when questionnaires are supposed to be returned. It states February 28, 2013 at 4:30pm. Should it be the actual proposal due date of February 18, 2014 at 4:30pm?
A.1: Yes it should be the same date as the proposal due date. In reviewing Attachment L2, there was also a reference to an old title instead of the “Multiple Award Task Order Contract (MATOC)” as the title of the project. See attached revised Attachment L2. Offerors shall utilize Attachment L2 – Past Performance Transmittal Letter – Revision 1.
Q.2: Please advise of the location of the subject pre-proposal conference.
A.2: The location was inadvertently omitted in the paragraph about the Pre-Proposal Conference (Section L.1.e). Additionally, information as to registering participants for the Pre-Proposal Conference has been added. See attached revised paragraph.
Q.3: What is the estimated range of the MATOC?
A.3: Per Article B.2. Prices/Costs, “The Contractor shall be reimbursed by the Government in an amount not less than a total of $25,000 (minimum) nor more than a total of $25,000,000 (maximum) for successful performance of this contract.” To clarify this further, each contractor that is awarded an IDIQ contract under the MATOC will be awarded at least one (1) task order for an amount not less than $25,000. The combined total of all task order awards, for all contractors, made under the MATOC will not be more than $25,000,000.
Q.4: What is the price range for the individual task orders for this MATOC?
A.4: Per Article I.4., FAR Clause 52.216-19, Order Limitations, the minimum order is $3,000 and the maximum order is $5,000,000.
Q.5: What are the three statements of work (other than the one date 12/6/13) that are attached to the solicitation? Are these to be used for the pricing part of the proposal package? If not, what is to be priced in volume 3 of the proposal package?
A.5: The three statements of work (TOR 13-00 SOW, TOR 214-20 SOW, and TOR 214-26 SOW) are the statements of work for the task orders that will be used in the price proposal (Volume 3). Offerors shall use the Task Order Pricing Template for each individual Task Order Request to provide a price for the task order. The Task Order Pricing Templates for TOR 214-20 and TOR 214-26 were inadvertently omitted in the RFP and have been included with this amendment. The Task Order Pricing Template that was included in the solicitation was the one for TOR 13-00.
Q.6: Page 85 of solicitation package, item 3.a.1.: Please clarify the purpose of the consent letter.
A.6: Past performance information concerning subcontractors, teaming partners, and/or joint venture partners cannot be disclosed to a private party without the subcontractor’s/teaming partner’s/joint venture partner’s consent. Because a prime contractor is a private party, a Government entity that is providing past performance on a subcontractor/teaming partner/joint venture partner will need that consent before disclosing present and past performance information to the prime contractor.
Q.7: Article C.3 states that task orders under this contract may be performed at any of the NIH facilities listed, however, the inspection and approval will take place at the RTP location. Also, the FBO post states that the place of performance will be RTP, NC. Please clarify location of this contract.
A.7: The location of the vast majority of task order awards (possibly all task orders) will be the Research Triangle Park, NC location. All other locations in NIH have access to the MATOC and the individual IDIQ contracts that will be awarded to the contractors selected for award. That is why all the individual locations are listed in Article C.3. Inspection and acceptance will be performed at the location identified in the task order award. See attached revised Section E for updated language pertaining to inspection and acceptance.
Q.8: Page 85 item 3.b.: It is requested that Vol. 1 be submitted early by 11 February 2014. Are the PPQs to be submitted by our references by this date also?
A.8: Past Performance Questionnaires may be submitted at any time up to and including the proposal due date.
Q.9: The SOW for the Triple Module Lab Renovation mentions attached Construction Documents, however no Construction Documents can be found. Please issue the referenced Construction Documents.
A.9: The referenced construction documents are now included within the revised SOW.
Q.10: TOR 214-20 – Are the costs to design the system to be included?
A.10: No design effort is anticipated. Please note the change in the beginning paragraph of the SOW stating “construction only” and in paragraph I.A. no design services are being requested.
Q.11: TOR 214-20 – Where in the Task Order Pricing Template should the design costs be included?
A.11: Please reference Q10 above. However, if an offeror believes design costs are required to perform the work then please account for these by adding a line to the pricing template. Please include a narrative explaining any additions made to the pricing template. A separate pricing template is provided for each task order.
Q.12: TOR 214-20 – There is not sufficient time to prepare the design (site visits, as-built research, etc.) prior to the proposal due date. Therefore please provide the information needed to price the systems (Size Tanks, Data on Softener System, Pipe Size, etc.).
A.12: Additional sizing information has been provided in SOW (Part III. A. 2., Part III. B., and Part III. C.).
Q.13: TOR 214-20 – Are there any hazardous materials in the Softeners and Resin?
A.13: Please refer to existing water softener installation and operating manual (Attachment 4) for additional information on existing system. For any new material installed reference manufacturers Safety Data Sheet (SDS).
Q.14: TOR 214-26 – Are the costs to design the system to be included?
A.14: The task order is for construction only. The intended work covers replacing the existing valves with new valves (as specified in the SOW) and reinsulating the air separator system (as specified in the SOW).
Q.15: TOR 214-26 – Where in the Task Order Pricing Template should the design costs be included?
A.15: Please reference Q14 above. However, if an offeror believes design costs are required to perform the work then please account for these by adding a line to the pricing template. Please include a narrative explaining any additions made to the pricing template. A separate pricing template is provided for each task order.
Q.16: TOR 214-26 – There is not sufficient time to prepare the design (site visits, as-built research, etc.) prior to the proposal due date.
A.16: Design is not anticipated and therefore the proposal due date remains unchanged at this time.
Q.17: TOR 214-26 – Should separate Task Order Pricing Templates be provided for the Base Work and one for each Option?
A.17: Provide separate pricing templates for Base and each option.
Q.18: Should separate Task Order Pricing Templates be submitted for each year (Base Year and then one per Option Year)?
A.18: Separate Task Order Pricing Templates should be submitted for each individual task order. The Task Order Pricing Templates for TOR 214-20 and TOR 214-26 were inadvertently omitted in the RFP and have been included with this amendment. The Task Order Pricing Template that was included in the solicitation was the one for TOR 213-00. No separate pricing is required for each year.
Q.19: Please provide the Specifications Referenced in the Air Separator Valves and Water Softener SOWs.
A.19: The statements of work (SOW) did not include specifications however additional information has been provided in the revised SOWs.
Q.20: Should the "Lab Renovation" be priced based on staffing with the 3 Individuals (Superintend, QC, and Safety or are the positions to be combined? If so what positions can be combined?
A.20: The TOR has been updated to reflect what positions may be combined. Please reference paragraph I.F.
Q.21: Will CAD versions of Design Drawings be made available after award of Design/Bid/Build Task Orders?
A.21: Yes. However, some construction only task orders do not have full design drawings to accompany them based on the complexity of the work. If a work plan (e.g. shop drawings) of the work is identified in the SOW, then an AutoCAD floor plan including building system piping and equipment will be provided for your use.
Q.22: Pricing for Demolition Work on Task Order Pricing Template – Should it be priced for the Government to take possession of the material/equipment or should it be priced for Contractor to dispose of (See IDIQA Specifications/Work Statement Paragraph 6.1.11)?
A.22: Demolition for minor construction related waste will be disposed of in Government provided dumpsters located on the NIEHS campus. Large equipment or significant construction waste will be addressed on an individual task order basis. The demolition cost should be priced per the requirements of the individual TOR. We do not have any forward pricing for specific items of work in this contract.
Q.23: TOR 13-00 – Should the countertops be priced as Formica or Epoxy Resin?
A.23: Wilson Art Laminate is the current standard, please reference the drawings included within the revised SOW.
Q.24: TOR 13-00 – Please provide the number of electric outlets.
A.24: Number of outlets shown on the elevation views, please reference the drawings included within the revised SOW.
Q.25: TOR 13-00 – Please provide the Voltage for the Outlets (120 or 208).
A.25: Voltage is specified on the drawings included within the revised SOW.
Q.26: TOR 13-00 – Are 208 vote Outlets to be single phase or triple phase?
A.26: Voltage is specified on the drawings included within the revised SOW.
Q.27: TOR 13-00 – Which size Fume Hood should be priced?
A.27: Fume hood is listed as Government Furnished Contractor Installed (GFCI) on the drawings since this is typical. The drawings are scaled and the model number for the fume hood is shown on elevation 6/A201.
Q.28: TOR 13-00 – How many Fume Hoods should be priced?
A.28: Pricing should include installation only for one (1) fume hood.
Q.29: TOR 13-00 – Are the Base Cabinets to be Steel or Corrosive Lined?
A.29: Casework is to be GFCI but to answer the question; steel, model numbers are provided on the elevation drawings in the revised SOW.
Q.30: TOR 13-00 – What options are to be included with the Fume Hoods?
A.30: Fume hood is GFCI but the only GAV connections should be provided. The model number is provided on the drawings in the revised SOW.
Q.31: TOR 13-00 – Is the sink to be in the Peninsula or the Wall Cabinets?
A.31: This is shown on the drawings in the revised SOW.
Q.32: TOR 13-00 – How many sinks should be included?
A.32: This is shown on the drawings in the revised SOW.
Q.33: TOR 13-00 – How much ductwork is to be removed?
A.33: This is shown on drawings in the revised SOW.
Q.34: TOR 13-00 – What size is the ductwork?
A.34: This is shown on drawings in the revised SOW.
Q.35: TOR 13-00 – Which Lab Elevation(s) are to be used?
A.35: This is shown on drawings in the revised SOW.
Q.36: TOR 13-00 – Should partitions be priced? If so please provide specifications for the partitions.
A.36: The details are shown on drawings in the revised SOW.
Q.37: TOR 13-00 – Which casework items are to be priced?
A.37: This is shown on the drawings in the revised SOW.
Q.38: TOR 13-00 – Should pricing include tracing and verifying circuits?
A.38: No. Less than 10% of the circuits will be affected. Any changes to circuit descriptions should be recorded and included on red-line drawing submission and electronic circuit directory submission for closeout.
Q.39: TOR 13-00 – How much conduit should be priced (distance to panels, etc.)?
A.39: Existing conduit will be re-used. Additional notes added to drawing for clarification.
Q.40: TOR 13-00 – No Telecommunications are listed on Pricing Template. Should Costs for Telecommunications be included? If so which Line Items should they be included in?
A.40: Telecommunications is installed by a third party contract. Only pull string and approved raceway is required.
Q.41: TOR 13-00 – Should Fire Alarm and/or Fire Protection be included? If so where in the Task Order Pricing Template should the costs be included?
A.41: No fire alarm modifications are required. Typical renovation would not include changes to the fire alarm system or fire protection system.
Q.42: TOR 13-00 – What type of conduit should be priced (rigid, IMC, or EMT)?
A.42: Material type shown on drawings in the revised SOW.
Q.43: TOR 13-00 – Please provide duration for the Triple Module Renovation SOW.
A.43: Statement of Work has been updated to include a 150 calendar day period of performance.
Q.44: No Task Order Pricing Templates for the Replace Water Softener SOW or Replace Air Separator Valves are included. Please provide the Task Order Pricing Templates for these SOWs.
A.44: The Task Order Pricing Templates for TOR 214-20 and TOR 214-26 were inadvertently omitted in the RFP and have been included with this amendment. The Task Order Pricing Template that was included in the solicitation was the one for TOR 213-00.
Q.45: RFP Article H.11.9 – Safety Officer to perform only Safety Duties. However; IDIQ Specifications/Work Statement states that the Superintendent can perform both functions. Which is correct?
A.45: Per RFP Article H.11.9 “The Contractor Site Safety and Health Officer(s) will be categorized as either a Full-time Safety Professional or a Collateral Duty Safety Officer based on the scope and size of the project.” The Collateral Duty Safety Officer may be held by a supervisor which is consistent with the Specifications/Work Statement. The requirement for a “Full-time Safety Professional” will be identified in the task order statement of work when applicable. Otherwise only a “Collateral Duty Safety Officer” is required.
Q.46: RFP Article H.11.9 – There is no such thing as a Competent Person Certification per OSHA (See attached OSHA definition of a Competent Person).
A.46: Correct. OSHA defines a Competent Person as “one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them" [29 CFR 1926.32(f)].” Per OSHA, “a competent person should have specific training in and be knowledgeable about their specific area of competence in order to qualify as capable.” As a result, it is expected that any such training which documents someone’s capability is maintained on file.
Q.47: RFP Article H.12.2.b states that within 10 days of Contract Award Subcontractor Security Plans are to be obtained. Due to the varying natures of the different Task Orders the trades cannot be determined until the Task Orders are issued.
A.47: The Contractor Security Plan should be amended at the time of any change in subcontractor personnel within 10 days of task order award or at other such times that warrant changes to personnel. Initial plan submission is due within 10 days of contract award.
Q.48: RFP Article H.12.3.a.3 is a similar situation to above.
A.48: List of Contractor Personnel should be amended at the time of any change in personnel within 10 days of task order award or at other such times that warrant changes to personnel. Initial submission is due within 10 days of contract award.
Q.49: Who provides the EDMS? If Contractor is to provide what are the Acceptable Programs and who are the Manufacturers?
A.49: The EDMS will be provided by the Government as required for design-build related task orders. The Government will offer initial training for contractor personnel. Any follow-on training required for additional contractor personnel will be at the contractor’s own expense.
Q.50: We intend to propose on the solicitation through our Joint Venture formed as a result of our SBA Mentor Protégé agreement with another company. In reviewing the RFP, a question was raised regarding the number of contracts, task orders and/or negotiated agreements that we should submit. The RFP states that 10 projects illustrating our past performance are required, but then the RFP seems to indicate that 10 projects from each of the Joint Venture partners would be required. Would you mind clarifying this issue? If we were to have another major teaming partner would we need to provide the requested past performance information for 30 projects (10 from each partner)?
A.50: The language in Section L has been revised (see attached). If submitting a proposal as a Joint Venture or any other type of teaming arrangement with 2 or 3 team members, the offeror shall submit at least three (3) contract citations for each team member and 10 contract citations for the team in total. Therefore, a team of 2 contractors would either have 3 contract citations for one team member and 7 contract citations for the other team member, 4 contract citations for one team member and 6 contract citations for the other team member, or 5 contract citations for each team member. A team of 3 contractors would have 3 contract citations for two of the team members and 4 contract citations for the third team member. If there are more than three team members in the Joint Venture or other type of teaming arrangement, the offeror shall submit three (3) contract citations for each team member (e.g. if there were 4 team members the offeror would submit a total of 12 contract citations).
Q.51: Please let us know whether or not the SF330s requested for the A/E subcontractors is just Part II or a full SF330.
A.51: Offerors shall submit Part I and Part II of the SF 330 for the one or two main A/E subcontractors that they will be working with during the MATOC period of performance. For specialty design work, that will be handled on a task order basis (e.g. Fire Protection).
