(SOW, RFP, Attachment) Reference Paragraph Industry Question Government Reponse
DLM Attachments (CBA)
10, 11,12,13,& 15 &A
In the response to Questions 45, the government reiterates that a "Labor Hour year is 1,920 hours" and in Question 37 that it
"does not have this data to provide" on seniority lists.
Questions: 1) Should offerors calculate their fringe costs bid based upon the lowest tier of paid time off (PTO) acummulation in each CBA since seniority is not available and non-incumbent offerors have no accurate way to bid
PTO for a cost-type contract?
2) Will the USG approve an REA to the successful offeror for actual fringe costs once the seniority lists and updated
CBAs are provided?
3) Will the USG include a clause in the contract to fund COVID-19 supplemental paid sick leave in California/Senate
Bill No. 114 (or any other federal/state decree) for additioanl mandatory paid COVID sick leave?
4) When accounting for CBAs, all employees will have significantly more than 168 hours of time off during a productive year and many between 275 and 300 hours based upon the included CBAs. This paid time off is not-inclusive of potential COVID-19 supplemental sick leave, bereavement, jury, election, and other leaves inluded in each respective
CBA. Using Most Probable Cost (MPC) as referenced in Section M, will the USG reconsider using 1,920 as a productive man hours since it will never be achieved?
5) How will the USG determine what a MPC is, if offerors are required to bid a 1,920 productive man hour year?
6) In the previous Q&A, the USG indicated it would be releasing updated CBAs. Amendment 1 released on 7 Mar 22 did not have updated CBAs. Can the Government confirm that updated CBAs will be released before proposal submission deadline?
1) The offerors must propose in accordance with the RFP as per Ammendment 2.
2) No. Per RFP clause 5252.232-9510, payment shall be made in accordance with FAR Clauses 52.216-7, "Allowable Cost and Payment," and 52.216-8, "Fixed Fee.
3) No COVID-19 clauses will be added to the RFP.
4) The Government will conduct the evaluation as per Section L. Para 4.5.2, a work-year is defined as 1,920 hours exclusive of holidays and leave.
5) The MPC will be evaluated IAW the RFP
6) Please monitor SAM.gov for updates/changes to the RFP
