The Contracting Office does not have control over this process, and it is not a factor employed by the Contracting Office in its qualitative evaluation of proposals. European companies only need to prove technical and financial solvency to perform the solicitated work. These two paragraphs appear to be in conflict. Does a contractor have to comply with both paragraphs or can a non-Spanish Company of the European Union be solely be vetted by the Permanent Committee? How would the Permanent Committee evaluate a contractor for work outside of Spain which is in the scope of this contract?

INSTRUCTIO

Paragraph 5.2 of Section 112100 states that:

ELECTRONIC/FACSIMILE

SUBMISSION OF PROPOSALS WILL

NOT BE ACCEPTED

PROPOSALS MAY NOT BE HAND

DELIVERED. ALL PROPOSALS MUST

BE MAILED VIA POSTAL SERVICES

OR COMMERCIAL COURIERS SUCH

AS FEDEX, DHL, OR UPS

Since the proposal will be mailed from outside the USA the only option is to have the package delivered via an international commercial courier.

However, the international courier service companies contacted abroad do not guarantee delivery of packages in the USA on a specific date and time.

In fact, we account for a similar situation where the mailing of a solicitation proposal to the USA failed when the package was late by the company. Fortunately, a second mailing of the package via a different company succeeded in the timely delivery.

The pandemic situation this time seems to be worse for international mail deliveries.

We would request that you consider acceptance of an electronic submission of the proposal before the due date, provided it includes a voucher of the mailed original proposal package via a commercial courier.

No change will be made to the RFP in this regard. Bid per RFP requirements.

We would request consideration to adjust requirement in Factor 3 Corporate Experience for (a) Recency to eight (8) years based on the justification below.

N NOTES:

Note 3

The explosive for ATFP is defined as Explosive Weight II, and a standoff distance of "9140" is given. Furthermore, Note 3 says that the blast pressure and impulse must be calculated by the Blast Engineering Firm, based on the "actual standoff distance from parking and roadways". However, pressure and impulse values for the ATFP blast loads are given in the Notes. So, it is not clear whether the ATFP blast loads should be taken as the provided pressure and impulse values, or if the ATFP blast load should be calculated based on Explosive Weight II at the "actual standoff" QUESTION : and, if the above is correct, The Blast Engineer must confirm the ATFP pressures and impulses indicated on Drawing S-003. The 9140 represents the minimum stand-off dimension required to meet ATFP requirements.

The level of protection for ATFP is shown as "Low / Very Low" in Sheet S-003, But drawing S-001 shows LOW. It is not clear which one is it: is it "Low" or "Very Low" (they correspond to different response limits) QUESTION. Please confirm if this means that it is "Low" for the ATFP blast load, and "Very Low" for the higher Accidental Explosion blast loads. Please confirm. In addition is required this confrimation considering some security criterias, as: the location of the new Facilities and the vicinity to the Port ESQD, the standoff and orientation to parking areas and last but not less, the distances from the new Facilities to the base secured perimeter.

Finally, The level of protection or response criteria (response limits) for the Accidental Blast loads is not specified. Please confirm.

N NOTES

The Accidental Explosion blast loads are defined in terms of given pressure and impulse values (reflected and incident).

However, the orientation of the buildings relative to the origin/direction of the blast load needs to be known, so that the Blast Engineers can determine which elevations of the buildings will be subject to the reflected loads and which elevations will be subject to the incident loads.

QUESTION: Please could Government/Designer confirm the origin/direction of the Blast Load?

The origin of accidental explosion blast loads is the harbor. The Government will provide specific locations to the successful bidder.

It is our understanding Bid Option #3 (CLIN 0004) describes the bid option to construct the concrete hardstanding area located on the west and south side of the Port Ops Facility. (Please confirm our understanding is correct.) Our question is: In the event the Government decides not to exercise CLIN 0004, is the OWS to be left with only backfill around and on top of the surface of the subject OWS?
