Contemplated Acquisition Strategy FAR 16.5 multiple-award IDV contract (MAC), similar to successful FTSS I, FTSS II, FTSS III, and FTSS IV MACs

Partial Small Business Set Aside* Lot 1-Unrestricted- programs suitable for Large Business Lot 2-Partial Small Business set-aside- programs suitable for Small Business

5-year base ordering period, followed by three additional 1-year options to extend

Approximately $1B ceiling, with minimum guarantees

Each Lot will have its own set of contractors, scope of work, terms and conditions, etc.

Pool of MAC contract awardees will then compete for future task orders within scope

For future task order competitions, all MAC contractors will be provided a fair opportunity for award pursuant to FAR 16.505, unless a FAR 16.505(b)(2) exception applies and is documented IAW local procedures.

*Small businesses may submit an offer on either or both the set-aside or non set-aside portion of the contract

(i) The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays;

(ii) Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized;

(iii) The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

(iv) It is necessary to place an order to satisfy a minimum guarantee.

SOURCE:

POC: NAME; PH#

SLIDE TYPE: TITLE

Contemplated Acquisition Strategy Any size firm could compete to become an awardee in the Complex Lot 1. Only small businesses could compete to become awardees in the suitable for Small Business Lot 2.

For each Lot:

The Government contemplates making a MAC award to all qualifying Offerors in accordance with 10 U.S. Code 2305(a)(3)(C). A qualifying Offeror is an Offeror that is determined to be a responsible source, submits a proposal that conforms to the requirements of the solicitation, and the PCO has no reason to believe would be likely to offer other than fair and reasonable pricing.

Task Orders are not contemplated in the FTSS V MAC award. They are planned to be separate competitions after MAC award.

FAR 15 Best-Value / Highest Technically Rated competition

Intend to award w/o discussions Don't assume you can improve your position during discussions (make your best offer right off the bat…) The Government will reserve the right to enter discussions.

Contemplated evaluation criteria:

Gate 1 (Go/No Go): Corporate Experience including Administrative Compliances. Small Business Participation also included for all offerors in Lot 1 & Lot 2.

Gate 2: Past Performance (Pass/Fail) Technical and Price deferred to subsequent Task Order competitions Note: Order of importance is not indicated or implied

Under the 2017 National Defense Authorization Act, the DoD now has the discretion to forego a price or cost evaluation in connection with the award of certain multiple award contracts.

The 2017 NDAA amended statute 10 U.S.C. 2305(a)(3)(C) which provides that the Federal Government need not consider cost/price at the Government’s discretion for certain MAC awards.

First, the MAC must be for the same or similar services. As we are in iteration V for FTSS services we have the ability to capitalize on this statute which has come about since the FTSS IV MAC award.

Second, the agency must intend to make a contract award to each qualifying offeror. The statute provides that tan offeror is a “qualifying offeror” under the proposed statute if:

It is a responsible source 2)its proposal conforms to the solicitation requirements, and, The contracting officer has no reason to believe that the contractor would offer anything other than a fair and reasonable price.

Advantages of this approach:

Eases the burden on both the Government and contactors alike.

Eliminates the need for hypothetical sample task orders that may not accurately reflect much of the work that the Government later procures and may tempt offerors to underbid.

Minimizes Evaluation factors to streamline and hasten the evaluation process.
