About this file

This is a Price Schedule for NAVFAC Contract N4008526R0138 for the P-1550 SOF Marine Raider Battalion Company and Teams Facilities at Marine Corps Base Camp Lejeune, North Carolina. The schedule establishes pricing for a Design-Bid-Build fixed-price construction contract with a base requirement (CLIN 0001) consisting of nine sub-line items totaling the entire work for four facilities and associated sitework: SOF Battalion Headquarters facility (0001A), two Company/Team facilities (0001B and 0001C), Company Storage facility (0001D), project sitework including utility extensions (0001E), Communications Extension (0001F), Force Main Extension (0001G), geotechnically unsuitable subgrade soil removal and replacement at unit price of $_____ per cubic yard for 4,000 cubic yards (0001H), non-hazardous contaminated soil handling and disposal at unit price of $_____ per ton for 130,000 tons (0001I), and unforeseen buried debris removal at unit price of $_____ per ton for 100 tons (0001J). The contract includes four option items: Option 1 (CLIN 0002) for contaminated soil disposal including petroleum, PFAS, VOCs, PAHs, and metals at $_____ per ton for 55,000 tons with a 270-calendar-day exercise period; Option 2 (CLIN 0003) for construction dewatering effluent treatment at $_____ per gallon for 500,000 gallons; Option 3 (CLIN 0004) for Audio Visual equipment with a Government Estimated Price of $2,175,534 plus a Handling and Administration Rate (HAR) not to exceed five percent; and Option 4 (CLIN 0005) for Furniture, Fixtures, and Equipment (FF&E) with a Government Estimated Price of $8,526,854.03 plus a HAR not to exceed five percent. The Government reserves the unilateral right to award Options CLINs 0002 and 0003 within 270 calendar days after contract award, and CLINs 0004 and 0005 at least six months prior to the contract completion date of 1,246 calendar days. Offers will be evaluated for award purposes by adding all option prices to the base CLIN 0001 price, though evaluation does not obligate the Government to exercise options. For unit-priced items (0001H, 0001I, 0001J), if a discrepancy exists between unit price and extended total, the unit price controls. Contractors proposing option CLINs 0002 and 0003 must provide firm fixed prices with no economic price adjustment provision. Additional performance and payment bonding will be required if A/V and FF&E options are exercised, with bonding costs for the options funded separately from the contractor's HAR. All work must comply with drawings, specifications, and applicable state and federal environmental policies, including the OSD PFAS Disposal Policy Guidance.

GENERAL BID NOTES

a. Award will be made on the total sum of Contract Line Item (CLIN) 0001, which includes subtotals of CLINs 0001A through 0001J. For CLINs 0001H, 0001I, and 0001J, enter unit prices and extended totals in spaces provided. If there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid and the total recomputed accordingly. If an Offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.

b. The Government reserves the unilateral right to award CLINs 0002 and 0003 to the Contractor at the proposed price within 270 calendar days after the contract award. A firm fixed proposed price is required for CLINs 0002 and 0003. No provision is made for economic price adjustment. If any of these Options are exercised, the contract completion date remains 1,246 calendar days after award of the contract or any accepted proposed shorter duration.

c. Evaluation of Options (JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the price for the option(s) (CLINs 0002-0005) to the total price for CLIN 0001. In accordance with FAR 52.217-5 Evaluation of Options, evaluation of options will not obligate the Government to exercise the option(s).

d. In FAR 52.217-7; Option for Increased Quantity-Separately Priced Line Item (Mar 1989), the Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.

e. The Government may reject an offer as nonresponsive if it is materially unbalanced as to prices for the basic requirement and the option quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.

f. If CLINs 0002-0003 are exercised, additional bonding and consent of surety is required. Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all Items.

g. These notes apply to subCLIN(s) 0001H, 0001I, and 0001J.

1) For CLIN 0001H: Geotechnically Unsuitable Subgrade Soil Removal, temporary stockpiling, and Replacement: Unit price for all work in connection with the removal, and replacement of geotechnically unsuitable subgrade soil (i.e. soft subgrade soils) with imported structural backfill or imported aggregate as specified. Disposal of unsuitable subgrade soils is covered under CLIN 0001I. Unsuitable subgrade soil determinations shall be made by the Government Geotechnical Engineer and approved by the Contracting Officer. The price shall include removal of geotechnically unsuitable soils encountered at the planned footing subgrades or identified during proof rolling of planned subgrades, disposal at the specified disposal facility, and backfilling the excavation with compacted imported Structural Fill or imported No. 57 crushed stone. Soils disturbed by the contractor’s construction activities, or that are excessively wet and soft due to lack of proper site maintenance and protection measures, and lack of specified drainage or excavation dewatering will not be considered unsuitable. Unit price shall include all handling and transportation. The volume of material removed and imported backfill required shall be neat quantities determined based on field measurements (length x width x depth) of the completed excavation to remove the unsuitable soil as approved by the Contracting Officer. Any work under this CLIN will not proceed without prior written approval of the Contracting Officer and direction of the Government Geotechnical Engineer.

2) For CLIN 0001I: Unit price for providing all work in connection with excavation, handling, temporary stockpiling, sampling, analysis, transportation, any necessary treatment and disposal of non-hazardous surplus soil media including at a permitted licensed facility. Sampling shall be performed in accordance with Specification Section 01 57 19, plus any other analytes required by the treatment/disposal facility. Unit price shall include all work in connection with removal, testing, treatment and disposal of non-hazardous surplus soil media encountered within planned excavations and within approved undercut excavations, at a permitted licensed treatment/disposal. The volume of contaminated soil removed will be based on approved truck scale measurement and the quantity will be approved by the Contracting Officer. Any work under this CLIN will not proceed without prior written approval and field verification from the Contracting Officer.

3) For CLIN 0001J: Unit price for providing all work in connection with demolition, removal and disposal of unforeseen buried structures, pipes, debris, and concrete, 1/2 CY or larger in size that is encountered within the planned excavation limits and not identified in the Contract Documents for demolition and backfill with imported Structural Fill. Buried structures, pipes, debris, and concrete smaller than 1/2 CY in size found within the planned excavation limits will be considered incidental to the work. Unit price shall include removal and disposal at an off-site licensed disposal facility. Unit price shall include handling and transportation. The volume of material removed will be determined based on certified truck scale measurement (tons) of material disposed at the receiving facility and approved by the Contracting Officer. Any work under this CLIN will not proceed without prior written approval and field verification from the Contracting Officer.

OPTION BID NOTES

a. For CLIN 0002: Unit price for providing all work in connection with handling, temporary stockpiling, sampling, analysis, transportation, and disposal of contaminant impacted surplus soil media at an off-site permitted licensed facility that meets federal, state, and local laws and the most current OSD PFAS Disposal Policy Guidance (https://www.acq.osd.mil/eie/eer/ecc/pfas/tf/policies.html). Sampling must be performed in accordance with Specification Section 01 57 19, plus any other analytes required by the contractor selected disposal facility. Unit price shall include all work in connection with evaluation and handling, any necessary storage, stockpiling and related storage maintenance and transportation, and all that entails. The volume of contaminated soil removed will be based on approved truck scale measurement at the receiving facility and the quantity will be approved by the Contracting Officer. Any work under this Line Item will not proceed without prior written approval and field verification from the Contracting Officer.

A/V and FF&E BID NOTES

These notes apply to CLINs 0004 and 0005.

a. The estimated amount for FF&E and A/V has been supplied by the Government, to provide offerors with the projected magnitude of effort. The estimated amount includes the actual cost of the FF&E and A/V including freight and installation charges. The Government FF&E and A/V Estimate is only an estimated amount.

b. If awarded, line items will be funded separately after completion of FF&E and A/V design package review by the Government, and receipt of appropriate funding by the Government.

a. Bonding

i. No Bonding for A/V and FFE at Time of Construction Contract Award

FAR 28.102-1(a) requires that performance and payment bonds be included in all construction contracts exceeding the SAT, except under the conditions listed. Since the A/V and FF&E Option Items are not part of the original contract award, the Construction Contractor must not be required to secure bond for the A/V, and FF&E at the time the basic contract is awarded.

ii. Additional Bond at A/V and FF&E Option Item Award

FAR 28.102-2(d) requires the Government to secure additional bond from the Construction Contractor for any contract price increases. Therefore, an increase to the original contract bond is required at the time of the A/V and FF&E Option Items award, to protect the Government against the Construction Contractor not providing A/V and FF&E ordered and to ensure that the vendor(s) receive payment if the Construction Contractor goes out of business. The increased cost of the bond must come from the A/V and FF&E funding source and is not a part of the Construction Contractor’s HAR.

iii. Bonds Required by the Construction Contractor

If the Construction Contractor requires bonding from the A/V and FF&E subcontractor(s), the cost must be covered in the Construction Contractor’s HAR.

c. Offerors may propose a Handling and Administration Rate (HAR) for the FF&E and A/V not to exceed five percent (5%). This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E and A/V. The proposed HAR is a fixed percentage. The Contractor’s proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E.

d. The Government is not obligated to award the Option line item(s) (CLINs 0004 and 0005). Should the Government choose to award the FF&E and A/V, the line item will be awarded as a negotiated modification to the contract/task order. The Contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E and A/V.

e. If awarded, the FF&E and A/V modifications will be awarded at least six (6) months prior to the contract completion date. A minimum of six (6) months is required for the Contractor to purchase, deliver and install the FF&E and A/V without impacting the overall completion date of the project. The Contractor's schedule must assume the award of the FF&E and A/V as a modification. No schedule extensions will be granted if the modification is awarded at least six (6) months prior to the contract completion date. If the Government decides to negotiate and award the furniture modification with less than six (6) months prior to the contact completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor clearly demonstrates, in writing, that (1) an accepted Final FF&E and A/V package was submitted within the approved schedule deadlines, and (2) sufficient lead time for the FF&E and A/V is not available and the Government's award of the modification is in the last six (6) months of the contract.

f. Adequate time for the installation of FF&E and A/V must be allotted in the Construction Schedule after all other trades have completed their work in the installation areas. The projected installation periods required by the vendors in the FF&E and A/V proposals must be honored in the construction schedule, with additional time allotted for complete FF&E and A/V punch lists, prior to building turnover. Overtime costs for FF&E and A/V installation must not be passed along to the government as part of the Options 1 and 2 costs, unless a compressed schedule has been required/approved by NAVFAC.
