About this file
This is a Justification and Approval (J&A) document authorizing use of other than full and open competition for a federal construction contract.
The Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC MIDLANT) is procuring construction services under solicitation N4008526R0020, a Design-Bid-Build project for P171 Weapons Magazines at Naval Weapons Station Yorktown, Virginia. The project scope includes constructing five Containerized Long Weapons Storage Two Bay (CLWS 2B) High Explosive magazines, two segregation facilities, and one forklift charging station to support Naval Munitions Command Atlantic. The construction will utilize reinforced concrete mat foundations, walls, floors, entrance and loading aprons, with segregation facilities constructed of pile foundations and reinforced concrete components. The estimated total project value is redacted, with an unspecified portion allocated to the Engine Exhaust Removal System. Work must be completed within 1,287 calendar days after contract award and will be funded by FY24, FY26, and FY27 Military Construction, Navy (MCON) funds.
The J&A justifies a brand name specification requirement for the AIRVAC911 Engine Exhaust Removal System from Air Vacuum Corporation, citing statutory authority under 10 U.S.C. 3204(a)(1) and FAR 6.103-1. The rationale centers on the system's unique capability to meet specific explosives safety and ventilation requirements for weapons magazine buildings without requiring penetrations or hoses—a requirement no other commercially available product meets. A sources sought notice published on SAM.gov on February 10, 2026, with a response deadline of February 25, 2026, yielded no responses from alternative suppliers. The Contracting Officer will determine fair and reasonable pricing using comparisons to proposed prices, the Independent Government Cost Estimate, historical data, and market survey results prior to contract award. The solicitation notice will be publicized on SAM.gov in accordance with FAR Part 5.
