GENERAL BID NOTES
a. Award will be evaluated on the total proposed price for Line Items 0001 – 0004, Base Price and the sum of all Option Item prices. The subtotal of Line Item 0001A-0001I is included in Line Item 0001.
b. The Government reserves the unilateral right to award any or all of Line Items 0002 through 0003 to the Contractor at the proposed price within 365 calendar days after the contract award and in accordance with all bid notes. A firm fixed proposed price is required for Line Items 0001-0004. No provision is made for economic price adjustment. The Contract Completion
Date (CDD) does not change if any or all of Line Items 0002 through 0004 are exercised.
c. Quantities on the bid schedule that are followed by an asterisk (*) are estimated quantities. If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 15 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting
Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting
Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the
Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.
d. Evaluations of Options (JUL 1990). Except when it is determined in accordance with RFO 17.202 (b) not to be in the
Government's best interest, the Government will evaluate offers for award purposes by adding the Total Price for Line Items
0002 through 0004 to the Total Price for the Base Bid, (Line Item 0001). Evaluation of options will not obligate the
Government to exercise the Option(s). (RFO 52.217-5).
e. The Government may reject an offer as non-responsive if it is materially unbalanced as to prices for the basic requirement and the option quantities. An offer is unbalanced when it is based on prices significantly understated for some work and prices which are significantly overstated for other work.
f. Failure to enter a price for any Line Item will result in a proposal being rejected.
g. For bid items where unit prices are indicated as required, bidders shall enter unit prices and extended totals in spaces provided. If there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid and the extended total recomputed accordingly. If an Offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.
h. If any or all of Line Item 0002 through 0004 is exercised, additional bonding and consent of surety is required. Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all items.
BID NOTES FOR FF&E (LINE ITEM 0004 ONLY)
a. The estimated amount for FF&E has been supplied by the Government, to provide offerors with the projected magnitude of effort. The estimated amount includes the actual cost of the FF&E including freight and installation charges. The
Government FF&E Estimate is only an estimated amount.
b. If awarded, line item will be funded separately after completion of FF&E design package review by the Government, and receipt of appropriate funding by the Government. Requirements and details are provided in E20, FURNISHINGS and
E10, EQUIPMENT
c. Bonding
1) Bonding is not required for the design, procurement and installation of FF&E at time of Construction Contract
Award.
RFO 28.102-1(a) requires that performance and payment bonds be included in all construction contracts exceeding the SAT, except under the conditions listed. Since the FF&E Option Item is not part of the original contract award, the Construction Contractor must not be required to secure bond for the FF&E at the time the basic contract is awarded.
2) Additional Bond at FF&E Option Item Award
RFO 28.102-2(d) requires the Government to secure additional bond from the Construction Contractor for any contract price increases. Therefore, an increase to the original contract bond is required at the time of the FF&E
Option Item award, to protect the Government against the Construction Contractor not providing FF&E ordered and to ensure that the FF&E vendor(s) receive payment if the Construction Contractor goes out of business. The increased cost of the bond must come from the FF&E funding source and is not a part of the Construction
Contractor’s HAR.
3) Bonds Required by the Construction Contractor
If the Construction Contractor requires bonding from the FF&E subcontractor(s), the cost must be covered in the
Construction Contractor’s HAR.
d. Offerors may propose a Handling and Administration Rate (HAR) for the FF&E not to exceed 5 percent. This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E. The proposed
HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E. The proposed HAR is a fixed rate.
e. The Government is not obligated to award the Option line item. Should the Government choose to award Line Item 0004
(Option Item No. 3), the line item will be awarded as a negotiated modification to the contract. The Contractor's proposed
HAR will be applied to all vendor/supplier costs for the FF&E.
f. If awarded, the FF&E option will be awarded at least nine months prior to the contract completion date. A minimum of nine months is required for the Contractor to purchase, deliver, and install the FF&E without impacting the overall completion date of the project. The Contractor's schedule must assume the award of the FF&E as an option. No schedule extensions will be granted if the option is awarded at least nine months prior to the contract completion date. If the
Government decides to negotiate and award the furniture option with less than nine months prior to the contact completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor demonstrates that an accepted Final
FF&E package was submitted within the approved schedule deadlines and sufficient lead time for the FF&E is not available and the Government's award of the option is in the last nine months of the contract.
g. The Contractor and the Contractor's Interior Designer must strictly adhere to the FF&E submittal schedule defined prior to the 35% design development to ensure that the final FF&E package endorsement is completed at least nine months prior to
Beneficial Occupancy Date (BOD). If projected final FF&E package endorsement date falls between 15 July and 15
November, then endorsement must occur no later than 10 July for any given calendar year.
h. Other notes: Obtain the services for an Interior Designer, certified by the National Council for Interior Design
Qualification (NCIDQ), to prepare supporting plans and procurement data, in accordance with the design schedule. Tasks shall include but are not limited to: gathering the Activity’s project FF&E; execution of the FF&E Best Value
Determination process; coordination of the building systems; development of Final FF&E Package to include furniture/equipment plans, procurement data sheets, cost summary, 8.5”x11” FF&E finish boards and any supplementary documentation; attend meetings with the Activity and NAVFAC MIDLANT; and perform final FF&E walk-through and punch list(s). Refer to specification section 12 00 01.00 20 DESIGN, PROCUREMENT AND INSTALLATION OF
FURNITURE, FIXTURES AND EQUIPMENT in Administrative Requirements.
