Final or Duplicate of Q# Section Category 1 Category 2 Document Section Reference Question Answer Answered By Date 001 Final L, M Submission/
Evaluation Pass/Fail Gateway Criteria - FCL
Solicitation Section L2.2.B. Are subconsultants required to have their own cleared facility (FCL) to participate, or can they use under sponsorship the cleared facility of another team member with an FCL? In speaking of the offeror it says the offeror must…”The pass/fail criteria are…L2.2.B Secret Facility Clearance (FCL) by the proposal due date,” Here it’s clear the offeror must have the FCL already. But it’s not clear if all subs must have one. Cleared personnel of subs could be sponsored by and work at the Offeror's FCL.
Subconsultant FCL status is not evaluated as part of the pass/fail gateway criteria.
The contractual relationship is between the Government and the prime contractor. The prime contractor is responsible for means and methods to accomplish the work consistent with contract requirements.

Pass/Fail Gateway Criteria - Key Personnel
Solicitation Section L.2.2.D.; Exhibit A.III.U. Key Personnel
“All members of the Contractor’s design team must have, at minimum, a “SECRET” or Interim Secret security clearance.” Curiously, the SOW Section 2.0 does not indicate key personnel must have security clearances, nor does Attachment 11 qualifications. It appears a secret security clearance is not required to propose nor is it asked for in the qualifications document, but only to work on Raven Rock projects will it be needed. This issue is important because the offeror may choose to have some cleared personnel work on Raven Rock and other non-cleared work at Pentagon or at non-secure facilities.
Key Personnel requirements are established at the task order level. See Section J Exhibit A for the seed project SOW. Key Personnel requirements are described in section III.U. Key Personnel. The Key Personnel proposed are evaluated on a pass/fail basis against the stated requirements.

In regards to the project WHS MACC II [HQ003421R0003], would the government consider extending the experience relevancy requirements to 8 or 10 years for design-build projects.
No, we will not extend the experience relevancy time stated in the RFP.

Will the Government consider extending the RFI cut off deadline of June 2nd to June 7th to provide offerors more time with the Holiday weekend to distribute plans to key subcontractors to properly evaluate the Project Documents to generate complete RFIs?
Yes. Amendment 0002 issued 27 May 2021 extended the RFI due date.

Please clarify your definition of Designer of Record – Is it:
1. An individual responsible for the overall design of the project (Section 3.5 states (emphasis added): “They must also obtain the services of a designated Registered Architect/Professional Engineer, as defined in the UFC, to serve as the Designer of Record. “
2. The company employing the designers of record: Section 3.4 references that the QFPE and LEED Professional must work for the DOR implying that the DOR is the company, not an individual. Qualifications in Section 3.5 state “Active Licensed Professional Registration in Virginia, Maryland, District of Columbia, or Pennsylvania,” but not all 4 areas implying a Design Project Manager not a DOR who will need to be registered in all 4 areas to comply with seed project requirements.
3. The design manager as stated in Section U of the seed project: “3. Design Project Manager. (DPM): The Contractor shall assemble and manage a full-service team of licensed professionals as required to carry out all applicable disciplines and phases of the project. They shall also provide a Registered Architect/Professional Engineer defined in UFC 1300-09N Section 2-7 Registration to serve as the Designer of Record (DOR). This implies a DOR separate from the DPM.
Please clarify if Section L is actually requesting a DPM to oversee the overall design that is prepared by DOR’s in their respective disciplines.
Clarified.
The DOR for Key Personnel purposes is the Professional Engineer or Registered Architect member of the design-build team, as defined in the UFC, that leads the design team that ensures design submittals comply with contract requirements and appropriate design team members check, approve, sign, date, certify, and stamp design-build submittals as required. Solicitation Exhibit A.III.U. Key Personnel
There appears to be a conflict between the solicitation and the seed project for key personnel requirements. The seed project requires a Program Manager, but the Solicitation SOW section does not mention a Program Manager.
1. Is a Program Manager required as a key person in this proposal as part of the Section L and Volume IV requirements or just in the Seed Project?
2. The Seed Project requires a Design Project Manager (DPM) and the Solicitation requires a Designer of Record (DOR). Will a resume for a Design Project Manager satisfy the requirement?
Amendment 0003 corrects the language.
No program manager is required.
The seed project requires a DOR. Solicitation Section L6.5.A.2. Facility Clearance
The RFP list a FCL is required at submission on 06/23. We are already going thru the security process for another Gov’t contract. However, with limitations due to COVID Pandemic and the last 15 months of difficult challenging times, this requirement is putting restrictions on a lot of qualified contractors, by having an active FCL clearance in place at the time of submission. Can the RFP be amended to require the FCL be in place at the time of AWARD thus allowing more competition for the proposal process.
