About this file
This document is an Other Transaction Agreement (OTA) Attachments & Templates file for a Department of the Air Force contract for the "Resilient, Relocatable Expeditionary Facility Prototype Demonstration" project with Elements Industrial Storage Limited under Agreement No. FA8003-26-9-B004, dated May 2026. The agreement includes seven attachments providing templates and requirements for contract execution, covering milestone payments, reporting, domestic content, data rights, patent rights, and insurance.
The project is structured in two phases with multiple milestones spanning from kickoff through final closeout. Phase 1 includes design reviews and closeout activities occurring within 120 days of the effective date, with milestones for a Project Management Plan (M-1.1), 30% Preliminary Design Review (M-1.2), 90% Final Design Review (M-1.3), and Phase 1 closeout with Guaranteed Maximum Price establishment (M-1.4). Phase 2 covers construction activities including site preparation and foundation works (M-2.1), procurement of structural components (M-2.2), structural assembly (M-2.3), mechanical/electrical/plumbing installation (M-2.4), system integration and testing (M-2.5), and final closeout and handover (M-2.6). Payment is milestone-based upon formal written acceptance by the Agreements Officer's Representative and Agreements Officer, with invoicing through WAWF following signed Milestone Completion Certificates. The participant must maintain comprehensive reporting including monthly progress reports, domestic content identification ledgers (requiring 60% U.S. content for materials), as-built documentation, and operations manuals. Insurance requirements include Workers' Compensation (statutory Hawaii requirements), Commercial General Liability ($2,000,000 per occurrence/$4,000,000 aggregate), Automobile Liability ($1,000,000 combined single limit), and Builder's Risk Insurance at full completed construction value.
