52.212-1 - Instructions, Conditions, and Notices to Offerors
1. PROPOSAL PREPARATION INSTRUCTIONS
To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of the volumes as identified in Table 2 in this addendum. It is the offeror’s responsibility to ensure the completeness of the proposal.
Evaluation of a proposal will be conducted on the basis of the information contained within it and the Government will not assume that an offeror possesses any capabilities not specified; this does not, however, limit the Government from evaluating Past Performance data obtained from other sources in accordance with paragraph 3.2 of this addendum.
Market research indicated a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, if in the Contracting Officer's opinion, adequate price competition exists, no additional data will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit other than certified cost and pricing data to the extent necessary for the contracting officer to determine the reasonableness of the price.
1.1. PERIOD OF PERFORMANCE
The Building 500 Maintenance and Repair contract award will consist of a 12-month base year (11 months + 30 day moblization), four one-year option periods, and a 6-month extension period, to begin after the contract award.
1.2. POINTS OF CONTACT (POCS)
The Contracting Officer and Contract Administrator are the sole points of contact for this acquisition.

Offerors will receive a notice of receipt. If they do not, it is their responsibility to follow up by contacting the Contracting Officer or Contract Administrator (phone numbers listed above). 1.3. PROPOSAL ACCEPTANCE PERIOD AND DUE DATE
The proposal due dates are specified in Table 2 of this addendum and proposals shall be submitted in accordance with the instructions in 52.212-1. The offeror shall make a clear statement that its offer is valid for at least 300 days beyond the due date. Late proposals will be handled IAW FAR 15.208. If any proposal is received late, the Contracting Officer will promptly notify the offeror that its proposal was received late and whether the proposal will still be considered. It is the offeror’s responsibility to confirm the Government has received the proposal. A receipt e-mail will be sent to the offeror. If the offeror does not receive a confirmation, it is their responsibility to contact the POC.
1.4. BROCHURES, DOCUMENTATION, AND ARTWORK
Elaborate brochures or documentation, detailed artwork, or other embellishments are unnecessary and are not desired.
1.5. DISCREPANCIES
If an offeror believes the requirements in these instructions contain an error, omission, or are otherwise unsound, the offeror shall immediately notify the Contracting Officer/Contracting Administrator in writing with supporting rationale, prior to proposal submission.
1.6. DISPOSITION OF PROPOSALS
In accordance with FAR Subpart 4.8, Government Contract Files, the Government will retain the “original” copy of all proposals and supplemental documents provided. Unless the offeror requests otherwise, the Government will destroy all extra copies of proposals and additional documents submitted.
1.7. PROPOSAL CLARITY
The proposal shall be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal shall not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the offeror intends to meet the requirements. The offeror shall assume that the Government has no prior knowledge of the offeror’s capabilities and experience, and will base its evaluation on the information presented in its proposal. This does not, however, limit the Government from evaluating Past Performance data obtained from other sources in accordance with the Addendum to 52.212-2 paragraph 3.2. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussions.
1.8. RESTRICTIONS ON DISCLOSURE AND USE OF PROPOSAL
A proposal may include data, such as technical designs or concepts, financial data, or management plans that the offeror does not want disclosed to the public for any reason, or used by the Government for any purpose other than proposal evaluation and contract award. If the offeror wishes to restrict the proposal, the offeror shall mark it in accordance with FAR 52.215-1. Any unmarked information may be releasable under the Freedom of Information Act.
1.9. SECURITY REQUIREMENTS
The PWS Section 5.1 identifies the security requirements for this contract.
1.10. DEBRIEFINGS
The Contracting Officer will promptly notify offerors of any decision to exclude them from the competitive range, whereupon they may request and receive a debriefing in accordance with FAR 15.505, Preaward Debriefing of offerors. The Contracting Officer will also notify unsuccessful offerors in the competitive range of the source selection decision in accordance with FAR 15.503, Notifications to Unsuccessful offerors. Upon such notification, unsuccessful offerors may request and receive a debriefing. Offerors desiring a debriefing must make their request in accordance with the requirements of FAR 15.506, Postaward Debriefing of offerors, as applicable. At the offeror’s request, the preaward debriefing may be delayed until after award; offerors are entitled to no more than one debriefing (either preaward, if applicable, or postaward).
1.11. ORGANIZATION OF PROPOSALS
The offeror shall prepare the proposal as set forth in Table 2 below. The titles and contents of the volumes shall be as defined in this table, all of which shall be within the required page limits and with the number of copies as specified in Table 2. The volumes identified in the table shall be separately bound IAW 52.212-1 paragraph 1.12.5. ELECTRONIC MEDIA. The proposal organization shall be as follows:

1.12. PROPOSAL FORMAT AND CONTENT
1.12.1. PAGE LIMITATIONS
Page limitations shall be treated as maximums. If exceeded, the excess pages will not be read or considered in the evaluation of the proposal. No hidden fields, macros, comments, etc. will be read. All information must be written clearly and be easily accessible. Page limitations may also be placed on Evaluation Notices (ENs), if required. The page limitations for ENs, if any, will be identified in the correspondence forwarding the ENs to the offerors. Each page shall be counted except: cover pages, table of contents, and tab indexes (defined in paragraph 1.12.6), and glossaries of terms (defined in paragraph 1.12.7).
1.12.2. PAGE SIZE
Page size shall be 8.5 x 11 inches, not including “foldouts” as noted in paragraph 1.12.3. Pages shall be single-spaced. Except for the reproduced sections of the solicitation document, the text size shall be no less than Times New Roman 10 point. Use at least 1-inch margins on all sides of each page. Pages shall be numbered sequentially by volume. If there are discrepancies in page counts between CD-ROM volumes and e-mail submittals, the CD-ROM shall take precedence.
1.12.3. TABLES, CHARTS, GRAPHS, AND FIGURES
Tables, charts, graphs, and figures shall be uncomplicated, legible, and shall not exceed 11 by 17 inches in size when printed. These types of pages will count as two pages and may only be used for large tables, charts, graphs, diagrams and schematics, and not for pages of text. For tables, charts, graphs, and figures only, the text shall be no smaller than 8 point using either Times New Roman or Arial font.
1.12.4. CLASSIFIED INFORMATION
Proposals shall not contain classified information.
1.12.5. ELECTRONIC MEDIA
Offeror shall submit all volumes in electronic format, using MS Windows-compatible, virus-free CD- ROM(s). On each CD-ROM indicate the offeror’s name, solicitation number, volume, and title. One CD-ROM containing all volumes with all documents is preferred, but multiple CD-ROMs are acceptable.
Compressed files (i.e., .zip, .rar, etc.) will not be considered. The electronic copies of the proposal shall be submitted in a format readable, searchable, and usable by Microsoft Office 2013 (MS Word, MS Excel, PowerPoint or PDF format viewable with standard Adobe Acrobat Reader X). Hidden fields, comments, macros, etc. shall be omitted, and read passwords on files shall not be used. The files shall be consistent and uniformly named to allow for easy distinction between Volume, Tab, etc. Inclusion of company name or abbreviation is acceptable. The receipt of the CD-ROM copy shall constitute the timely receipt of the formal proposal.
1.12.6. TABLE OF CONTENTS AND TAB INDEXING
Each volume shall contain a detailed table of contents to delineate the subparagraphs within that volume.
Table of contents does not count against the page limitations for their respective volumes.
1.12.7. GLOSSARY OF TERMS
Each volume shall contain a glossary of all abbreviations, acronyms and/or terms used, with an explanation for each. Glossaries do not count against the page limitations for their respective volumes.
1.12.8. LABELING
A cover sheet shall be included in each volume, clearly marked as to volume number, title, copy number, solicitation identification and the offeror's name. Be sure to apply all appropriate markings including those prescribed in accordance with FAR 52.215-1(e), Restriction on Disclosure and Use of Data, and FAR 3.104-4, Disclosure, Protection, and Marking of Contractor Bid or Proposal Information and Source Selection Information.
1.13. DISTRIBUTION

2. VOLUME I – FACTOR 1: TECHNICAL VOLUME
2.1. GENERAL
The purpose of the Technical Volume is to provide the Government the ability to evaluate the management and technical capability of the offeror to perform the Building 500 Maintenance and Repair requirements. At a minimum, the Technical Volume shall consist of the following:

- Subfactor 1: Technical Approach
- Subfactor 2: Mobilization Approach
2.2. PROPOSAL STRUCTURE SUMMARY
The purpose of this section is to provide the Government evaluators with a clear and concise introduction to the content and structure of the Technical Proposal. The format of the Proposal Structure Summary is at the discretion of the offeror, but shall include a Master Table of Contents of the entire proposal that identifies where material may be found for each evaluation factor and/or sub-factor as described in this RFP. Any information presented in the summary shall not be considered as meeting the requirements of any portions of other volumes of the proposal. Within the Proposal Structure Summary, the offeror shall state that its proposal is valid for the timeframe designated in paragraph 1.3 above, Proposal Acceptance Period and Due Date. The offeror shall identify those personnel authorized to negotiate on behalf of the company along with the telephone number, fax number, mailing address, and e-mail address.
Furthermore, the offeror shall also provide the person to contact if the Government initiates discussions and who to contact if the offeror is awarded the contract (provide at a minimum, contact’s name, title, phone number, and e-mail address). The Proposal Structure Summary will not count towards the maximum page count for Volume I, Technical. Technical information should not be included in the Proposal Structure Summary and if technical information is in this section it shall not be evaluated.
2.3. SUBFACTOR 1 – TECHNICAL APPROACH
2.3.1. MANAGEMENT OF HUMAN RESOURCES: MANNING SCHEDULE AND
ORGANIZATION STRUCTURE
Provide a narrative and/or supporting graphics, descriptions, etc. to demonstrate the ability to support the manpower requirements with organization structure (org chart) which shows Full or Part Time Equivalents sufficient to accomplish the projected workload provided in the PWS detailed to the “shop/function” level, and how the offeror will maintain a qualified work force. The organization structure at a minimum shall display the expertise of project manager/superintendents/foreman and skills craftsmen.
2.3.2. MANAGE AND MAINTAIN CUSTOMER SERVICE FOCAL POINT 24/7
Provide a narrative and/or supporting graphics, descriptions, etc. to demonstrate the ability of maintaining a high standard of professionalism and ensuring high customer satisfaction for service and support issues 24 hours a day, 7 days a week. The offeror also demonstrates the approach to provide emergency on-site response within 1 hour in accordance with the PWS.
2.3.3. APPROACH FOR CONTINUOUS OPERATIONS SUPPORT TO MEET MISSION
Provide a narrative and/or supporting graphics, descriptions, etc. to demonstrate an approach for continuous operations support to meet the mission during peacetime, contingency, and strike situations.
2.3.4. QUALITY CONTROL PLAN
Provide a narrative and/or supporting graphics, descriptions, etc. to demonstrate a proposed sufficient Quality Control Plan, including lines of authority that will successfully evaluate compliance, find and document problems and monitor corrective actions to ensure a timely resolution. The offeror shall address how recurring problems will be prevented.
2.3.5. TOOL/EQUIPMENT CONTROL PLAN
Provide a narrative and/or supporting graphics, descriptions, etc. to demonstrate the ability of tool tracking and equipment management system. The offeror shall provide a detailed, verifiable, and documented approach of contractor provided tools and equipment (quantity and type) to accomplish the requirement of the PWS.
2.3.6. MAINTANNACE AND REPAIRS PLAN
Provide a narrative and/or supporting graphics, description, etc. to demonstrate the ability to maintain and repair all equipment/infrastructure within Bldg. 500 complex. The offer shall provide a detailed approach using the Work BreakDown Structure (WBS) concept to account for equipment/infrastructure against man hours to meet the requirement of the PWS.
2.3.7. TRACK AND REPORT WORK IN PROGRESS
Provide a narrative and/or supporting graphics, descriptions, etc. to demonstrate the ability to track and report work in progress to the Government’s representatives.
2.3.8. SAFETY PLANS AND PAST SAFETY HISTORY
Provide a narrative and/or supporting graphics, descriptions, etc. to demonstrate an approach to ensure compliance with Occupational Safety and Health Act (OSHA), Environmental Protection Agency (EPA), National Fire Protection Association (NFPA), International Plumbing Code (IPC), National Electrical Code (NEC), National Plumbing Code, Unified Facilities Criteria (UFC), DoD, AF, Federal, state and local codes, local environmental regulation and instructions. For safety history, provide safety history such as OSHA 300 log, and any other safety records.
2.3.9. EXPERIENCE
Provide a narrative and/or supporting documents, etc. that demonstrates facility (500,000 square feet or larger) maintenance and repair as a prime contractor (to include Heating Ventilation and Air Conditioning, plumbing, electrical, fire suppression, structural, alarms, roofing maintenance, general maintenance &repair, and work request management).
2.4. SUBFACTOR 2 – MOBILIZATION APPROACH
2.4.1. ABILITY TO RECRUIT/TRAIN/CERTIFY/QUALIFY PERSONNEL IN 30-DAY PERIOD
Provide a narrative and/or supporting graphics, descriptions, etc. to demonstrate the ability to recruit, train and certify qualify personnel during the 30-day mobilization period and have contingency plans if local recruiters aren’t available.
2.4.2. MATERIAL/EQUIPMENT/VEHICLE AVAILABILITY TO BEGIN PERFORMANCE
Provide a narrative and/or supporting graphics, descriptions, etc. to demonstrate an approach to have all materials, equipment and vehicles (quantity/type) for which the service provider is responsible for available on the first day of the basic contract period.
2.4.3. TIMELINE FOR HR PROCESS (HIRE/TRAIN/CERTIFY)
Provide a narrative and/or supporting graphics, descriptions, etc. to provide a timeline schedule with sound rationale, which addresses the start and completion of each event (e.g., interviewing, hiring, human resource actions, training, and start work dates)
2.4.4. TRANSITION SCHEDULE
Provide a narrative and/or supporting graphics, descriptions, etc. to outline the transition schedule; at a minimum, the schedule shall show the key events from contract award to pre-mobilization activities to full performance.
2.4.5. PROVIDE A WORK BREAKDOWN STRUCTURE (WBS)
Provide WBS to show critical work elements, man power, and equipment to meet the standards set forth in the PWS.
3. VOLUME II – FACTOR 2: PAST PERFORMANCE VOLUME
3.1. GENERAL
Offeror shall provide past performance information for evaluation. Failure to provide the information may result in the offeror being removed from consideration for award. Note: An offeror with no past performance experience should submit the Volume with an explanation that they have no recent or relevant experience.

The Table of Contents shall list all documents contained in the Past Performance Volume.
3.2.2. SUMMARY
The Summary shall describe the role (for the proposed BUILDING 500 MAINTENANCE AND REPAIR requirement) of the offeror and each subcontractor, teaming partner/joint venture partner that the offeror is required to provide Past Performance Information Documents pursuant to the paragraph below.
3.2.3. OFFEROR’S PAST PERFORMANCE INFORMATION DOCUMENTS
Offerors should provide past performance information on three (3) contracts considered most relevant in demonstrating their ability to perform the BUILDING 500 MAINTENANCE AND REPAIR requirements. Include rationale supporting your assertion of relevance, however, the Government is not bound by the offeror's opinion of relevancy. Offerors are required to explain what aspects of the contracts are deemed relevant to the proposed effort. Provide any information currently available (letters, metrics, customer surveys, independent surveys, etc.) which demonstrates customer satisfaction with overall job performance and quality of completed product for relevant past efforts/contracts (similar in scope and magnitude of effort and complexities this solicitation requires). This may include a discussion of efforts accomplished by the offeror to resolve problems encountered on prior contracts as well as past efforts to identify and manage program risk. In addition, explain corrective actions taken in the past, if any, for substandard performance and any current performance problems such as cost overruns, extended performance periods, numerous warranty calls, etc. Where problems existed, clearly demonstrate management actions employed in overcoming these problems and the effects of those actions, in terms of improvements achieved or problems rectified. The evaluation of past performance will take into account past performance information regarding predecessor companies or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the current acquisition.
Past performance on ID/IQ type contracts shall be submitted at the delivery/task order level, unless performance is only assessed for the ID/IQ contract as a whole. In that case, the offeror shall explain that performance on individual orders is not assessed and provide the using activity’s single point of contact that can verify the Offeror’s performance. For all ID/IQ contracts, submit only the dollar values on the individual task orders regardless of whether past performance is assessed for individual task orders or for the contract as a whole. For past performance references submitted at the delivery/task order level, each delivery/task order submitted shall be counted as one reference.
If a teaming arrangement is contemplated, provide complete information as to the arrangement, including any relevant and recent past performance information on previous teaming arrangements with same partner. A Past Performance Information Document is required on the Prime offeror or joint venture, and subcontractors or teaming partners that will perform 10% or more of this acquisition. Offerors shall submit no more than three (3) Past Performance Information Documents, at least one of which is for the Prime offeror, for work performed by the Prime offeror or joint venture. The Government will not evaluate more than three (3) total offeror-provided references. Each Past Performance Information Document is limited to three (3) pages. (NOTE: The Government reserves the right to evaluate more references that it locates through past performance evaluation research.) A sample format of the Past Performance Information document is provided as Attachment 12.
3.2.4. PAST PERFORMANCE QUESTIONNAIRE TRACKING RECORD
The offeror is responsible for the distribution tracking of the Past and Present Performance Questionnaire that is included as Attachment 14. A sample Past Performance Tracking Record is also included as Attachment 15. For each questionnaire distributed include a letter, printed on company letterhead, containing substantially the same information as that included in Attachment 13 entitled Sample Past and Present Performance Questionnaire Cover Letter. To avoid potential conflicts, offerors are exempt from sending Past and Present Performance Questionnaires to other potential competitors of this acquisition.
In this situation, it is the offeror’s responsibility to find an alternative method of providing the Government the same or similar information. The offeror shall exert its best efforts to ensure that at least two points of contact (Procuring Contracting Officer, Program/Project Manager, Administrative Contracting Officer, or equivalent) per relevant contract submit a completed Past and Present Performance Questionnaire directly to the Government not later than the due date for the past performance proposal volume. The offeror is responsible for distributing the questionnaire packages and providing the tracking record that shows to whom they were sent and the contact information for these individuals (the Government will take follow-up actions as needed). Each of the offeror’s points of contact (POC) shall email the completed Past Performance Questionnaire to 2d Lt Steven C. Hedgepeth at steven.hedgepeth@us.af.mil and Mr. Eric J. Mahowald at eric.mahowald@us.af.mil. If the offeror’s POC does not receive a confirmation email or do not have the capability to send the documents electronically, please fax it directly to Lt Hedgepeth and Mr. Mahowald at fax number (402) 294-7280. Please have your POCs call Lt Hedgepeth at (402) 294-2628 or Mr. Mahowald at (402) 232-2371 before faxing their response. Once the Past and Present Performance Questionnaires are completed by your POCs, the information contained therein shall be considered sensitive and shall not be released.
3.2.5. CONSENT LETTERS
Past performance information concerning subcontractors and teaming partners cannot be disclosed to a private party without the subcontractor’s or teaming partner’s consent. Because the offeror is a private party, the Government will need that consent before disclosing subcontractor/teaming partner past performance information to the offeror during exchanges. (Reference Attachment 16:
Subcontracting/Teaming Partner Consent Letter for the Release of Past and Present Performance Information to the Prime Contractor) In an effort to assist the Government in evaluating past performance, request the sample consent letter be completed by the major subcontractors/teaming partners identified in your proposal. The completed consent letter shall be submitted as part of the Past Performance Information Volume, but will not be considered in the page count of this Volume. Should the offeror not submit a completed Consent Letter for major subcontractors or teaming partners, the Government will only discuss past performance information directly with the prospective subcontractor or teaming partner that is being reviewed. If there is a problem with the proposed subcontractor’s or teaming partner’s past performance, the offeror can be notified of a problem, but no details may be discussed without the subcontractor’s/teaming partner’s permission. For each identified effort for a commercial customer, the offeror shall also submit a client authorization letter, authorizing release to the Government of requested information on the offeror's performance. (Reference Attachment 17: Client Authorization Letter.)
3.2.6. ORGANIZATION STRUCTURE CHANGE HISTORY
Many companies have acquired, been acquired by, or otherwise merged with other companies, and/or reorganized their divisions, business groups, subsidiary companies, etc. Explain how these changes impact the relevance of any efforts you identify for past performance evaluation/performance confidence assessment. Since the Government intends to consider past performance information provided by other sources as well as that provided by the offeror(s), your "roadmap" should be both specifically applicable to the efforts you identify and general enough to apply to efforts on which the Government receives information from other sources. This information is required on the offeror, teaming partners and/or joint venture partners, and major subcontractors, as necessary.
3.2.7. RECENCY AND RELEVANCY OF PAST PERFORMANCE
3.2.7.1. RECENCY
To be recent, the effort must be ongoing or must have been performed during the past three (3) years from release of the RFP. Performance of less than 6 months from the Past Performance Volume submission date will not be considered or evaluated due to limited performance history of these efforts.
3.2.7.2. RELEVANCY
Offerors shall include the rationale supporting the assertion of relevance on the contracts submitted for consideration in demonstrating their ability to perform the proposed effort. The offeror shall provide a matrix marking the past performance subfactors that the offeror considers relevant to each of the contracts submitted. The Government is not bound by the offeror’s interpretation of relevancy. The Government may contact references other than those identified by the offeror and use the information received to evaluate the offeror's past performance. For a description of the characteristics or aspects the Government will consider in determining relevance, see the Addendum to 52.212-2 paragraph 3.2.2.2 Relevancy.
3.2.8. DETERMINATION OF RESPONSIBILITY
Past performance information obtained in the course of the source selection may be used to support a responsibility determination IAW FAR 9.1, Responsible Prospective Contractors.
4. VOLUME III – FACTOR 3: PRICE
All price information shall be addressed within the price volume only. All offerors shall complete and submit the, Attachment 2, BUILDING 500 MAINTENANCE AND REPAIR Pricing Model (Excel spreadsheet), for all CLINs. Each offeror’s proposal shall represent its best efforts to respond to the BUILDING 500 MAINTENANCE AND REPAIR requirements. Proving the credibility of proposed price rests with the offeror. Any inconsistency between proposed performance and price shall be explained in the proposal. For example, if unique and innovative approaches are the basis for the estimate, the nature of these approaches and their impact on price must be explained. A significant inconsistency, if unexplained, may raise a question of the offeror’s understanding of the nature and scope of the work required and its ability to perform within the proposed price constraints, which may cause the proposal to be rejected. The information requested in the proposal is required to enable the Government to determine if all proposed CLINs are fair and reasonable.

The total evaluated price will be inclusive of all CLINs for the base period, all option periods, and the 6-month extension period. The 6-month extension period should be at the same rates as the last option period IAW FAR 52.217-8. The Government will evaluate whether the total evaluated price is fair and reasonable.
The Government cannot accurately forecast RPIE Work Orders Other Than Direct Costs and RPSE/Non- RPIE Work Order Other Than Direct Costs; therefore, the Government will populate CLINs X003 and X006 with estimated amounts. When completing Attachment 2 (Pricing Model), offerors are instructed to include Government pre-populated dollar amounts for each period as shown in the tables below. Include the following amounts:

5. VOLUME IV – CONTRACT DOCUMENTATION
5.1. CONTRACT DOCUMENTS
The purpose of this volume is to provide information to the Government for preparing the contract document and supporting file(s). The offeror's Contract Documentation volume shall include a completed/signed copy of the SF 1449 cover page of solicitation (to include any amendments), the offeror’s representations and certifications or provide notice that these are available electronically via the System for Award Management (SAM) website (replacement for ORCA), applicable Attachments, Mission Essential Plan (5.6 below), Commercial Warranty Policy (5.7 below) and any other data the offeror chooses to bring to the attention of the Contracting Officer.
5.2. EXCEPTIONS OR ASSUMPTIONS TO TERMS AND CONDITIONS
Offerors are advised that taking exception to any of the requirements specified in this solicitation may result in the proposal being eliminated from the competitive range. Since the Government reserves the right to award without discussions, offerors run the risk of their proposal being found unawardable as a result of exceptions to solicitation requirements. Clarification of Government requirements and any offeror assumptions should be handled by submitting a question/recommended change prior to proposal submission. The question/recommendation will be posted to FBO as written. Do not include any proprietary information in the question/recommendation. Additionally, any exceptions will be subject to a legal review in accordance with Air Force Installation Contracting Agency (AFICA) Mandatory Procedure (MP) 5301.602-2(S90)(ii)(C). All assumptions/clarifications must be finalized prior to Final Proposal Revision (FPR). If the offeror still finds it necessary to take exception to any of the requirements specified in this solicitation, clearly indicate each exception in the appropriate volume along with a complete explanation of why the exception was taken and what benefit accrues to the Government.
Provide a consolidated list of all exceptions and assumptions in the Contract Documentation Volume. All exceptions to the solicitation requirements (and all Attachments) and supporting rationale shall be identified as such and consolidated into an overview section of the subject volume. An overview section is only required if the offeror takes exception to any requirement in the solicitation. The overview section will not be included in the proposal page limitation described above.
The Government may reject services as non-conforming technically if exceptions/assumptions are taken.
5.3. SOLICITATION/CONTRACT FORM
When completed and signed by the offeror, this constitutes the offeror's acceptance of the terms and conditions of the proposed solicitation. Therefore, only representatives authorized to commit the offeror to contractual obligations must execute the form. Offerors shall sign the SF 1449 in Block #30b and submit it as part of and at the same time as the Contract Documentation, Volume IV.
5.4. OTHER PROPOSAL INFORMATION
The offeror must submit information required by these instructions. Failure to provide the information may result in the offeror being removed from consideration for award. Also provide company/division's street address, county and facility code; CAGE code; DUNS code; size of business; and labor surplus area designation. This same information must be provided if the work for this contract will be performed at any other location(s). List all locations where work is to be performed and indicate whether such facility is a division, affiliate, or subcontractor, and the percentage of work to be performed at each location.
The offeror must provide the date of the offeror's Affirmative Action Plan, expiration date, date of the most recent Pre-Award On-Site Equal Opportunity Review (if any), and name and address of the cognizant U.S. Department of Labor, Office of Federal Compliance Programs Office.
The offeror must provide the Organizational Conflict of Interest disclosures required by Attachment 18, Local Instructions, paragraph #7 entitled “Organizational Conflicts of Interest (OCI) Avoidance.”
Offerors are required to identify any actual or potential Conflict of Interest in their proposals, and may be required to submit a mitigation plan during the proposal period. The successful offeror will prepare an OCI mitigation plan, if required. Mitigation Plans, if required, will be evaluated IAW FAR 9.5.
The offeror shall provide the date of the offeror's most recent Federal Contractor Veterans Employment Report VETS-100 Report (Reference FAR 52.222-37).
5.5. DEPARTMENT OF LABOR EQUAL EMPLOYMENT OPPORTUNITY CLEARANCE
(EEOC)
In accordance with FAR Subpart 22.805, in order for the Contracting Officer to request clearance from the appropriate Office of Federal Contract Compliance Programs (OFCCP) regional office, Attachment 11 shall be completed and submitted with the Contract Documentation Package. Preaward clearances for contracts and subcontracts of $10 million or more are required unless the offeror is listed in OFCCP’s National Preaward Registry. If an offeror is listed in OFCCP’s National Preaward Registry, submit verification of the registry with completed Attachment 11. Verification can be verified at http://www.dol-esa.gov/preaward/.
5.6. MISSION-ESSENTIAL CONTRACTOR SERVICES PLAN
The offeror shall provide with its offer a written Mission-Essential Contractor Services Plan describing how it will continue to perform the essential contractor services identified as "mission essential" in the Performance Work Statement during periods of crisis. The plan submitted by the contractor will be incorporated in the contract IAW DFARS 252.237-7023 and shall contain the items described under DFARS 252.237-7024 in order to be considered acceptable. An acceptable plan will be required for a contractor to be deemed responsible and eligible for award.
5.7. COMMERCIAL WARRANTY POLICY
The offeror shall provide with its offer their commercial warranty policy. The offeror shall demonstrate how they will meet the one year service warranty IAW PWS paragraphs 1.2.1.7 & 1.2.2.7, and the 52.212-4 addendum. The offeror also demonstrated how it will provide commercial equipment warranties to the government.
ADDENDUM TO 52.212-2
52.212-2 - Evaluation Factors for Award
1. BASIS FOR AWARD
The Government contemplates award of a single award contract resulting from this solicitation. This is a Lowest Price Technically Acceptable (LPTA) with Acceptable Past Performance source selection conducted in accordance with Federal Acquisition Regulation (FAR) 15, Contracting by Negotiation, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), the Air Force Federal Acquisition Regulation Supplement (AFFARS), DoD Source Selection Procedures, Appendix C, 1 April 2016 and Air Force Mandatory Procedures 5315.3, 3 June 2016. These regulations are available electronically at the Air Force (AF) FARSite, http://farsite.hill.af.mil. The Government will select the proposal with the lowest evaluated price and for which all non-price factors are rated as Acceptable in accordance with established criteria in the solicitation. Contract may be awarded to the offeror who is deemed responsible in accordance with the FAR Part 9.1, as supplemented, whose proposal conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by the 52.212-1 of this solicitation) and is judged, based on the evaluation factors and subfactors, to represent the lowest price technically acceptable with acceptable past performance proposal. While the Government will strive for maximum objectivity, the source selection process, by its nature, is subjective; and therefore, professional judgment is implicit throughout the entire process.
1.1. AWARD WITHOUT DISCUSSIONS
IAW with FAR 52.215-1, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
1.2. DISCUSSIONS
If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision. If the offeror’s proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the Final Proposal Revision are subject to evaluation and may introduce risk that the offeror’s proposal will be determined unacceptable and ineligible for award.
1.3. COMPETITIVE RANGE/DISCUSSIONS
The Government reserves the right to open and conduct discussions if it deems them to be necessary.
Discussions will be held only with those offerors determined to be in the competitive range. Offerors whose proposals are not included in the competitive range will be notified as soon as practicable.
Discussions will include issuance of evaluation notices. An offeror initially included in the competitive range may be eliminated from consideration for award during discussions. At the conclusion of discussions, each offeror still within the competitive range shall be given an opportunity to submit a Final Proposal Revision (FPR). Only offerors deemed “Acceptable” in all Technical sub-factors with acceptable past performance are eligible for award.
1.4. SOLICITATION REQUIREMENTS, TERMS AND CONDITIONS
Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors or subfactors.
Failure to comply with the terms and conditions of the solicitation may result in the offeror being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and must provide complete supporting rationale. The Government reserves the right to determine any such exceptions unacceptable.
The Government reserves the right to deny a contractor FOUO documents (Certificate Pertaining to Foreign Interests (SF328) and Controlled Unclassified Information Nondisclosure Agreement, located at Attachments 5 and 6), establishing the contractor as unqualified to perform the scope of this contract.
1.4.1 MISSION-ESSENTIAL CONTRACTOR SERVICES PLAN
The offeror must provide a written Mission-Essential Contractor Services Plan (See Addendum to 52- 212-1 Para. 5.6) describing how it will continue to perform the essential contractor services identified as "mission essential" in the Performance Work Statement (1.5.8) during periods of crisis. The plan contained the items described under DFARS 252.237-7024. An acceptable plan will be required for a contractor to be deemed responsive and eligible for award.
1.4.2 COMMERCIAL WARRANTY POLICY
The offeror shall provide with its offer their commercial warranty policy (See Addendum to 52-212-1 Para. 5.7). The offeror shall demonstrate how they will meet the one year service warranty IAW PWS paragraphs 1.2.1.7 & 1.2.2.7, and the 52.212-4 addendum.
