Controlled Unclassified Information Nondisclosure Agreement
I____________________________, an individual official, employee, consultant, contractor, subcontractor, or potential contractor of or to USSTRATCOM, intending to be legally bound, hereby consent to the terms in this Agreement in consideration of my being granted conditional access to certain information, that is owned by, produced by, or in the possession of the United States Government.
As used in this Agreement, certain types of unclassified information require application of access and distribution controls and protective measures for a variety of reasons. This information is referred to collectively as Controlled Unclassified Information (CUI) (i.e., For Official Use Only (FOUO), Law Enforcement Sensitive (LES), DoD Unclassified Controlled Nuclear Information (DoD UCNI), and LIMITED DISTRIBUTION). DoDM 5200.01-V4, DoD Information Security Program: Controlled Unclassified Information (CUI) identifies the controls and protective measures developed for DoD CUI and some identifiers used by other government agencies to categorize information as CUI. The contractor shall reference Enclosure 3, paragraph 2.e, Protection of FOUO Information, for guidance relating to security of FOUO information, to including marking, secure handling, and dissemination of hard copy materials and documents.
Additionally, you shall comply with guidance outlined in DODI 8582.01, Security of Unclassified DoD Information on Non-DoD Information Systems. In DODI 8582.01, the contractor shall reference Enclosure 3, Procedures, for guidance relating to security of electronic (soft copy) information processed or stored on automated information systems
Furthermore, I understand that when not under the continued control and supervision of a person authorized access to such material, it must be, at a minimum, maintained under locked conditions. At the end of the contracting solicitation process, the Government and Offerors shall make every reasonable attempt to regain custody of all CUI documents which are no longer needed. Hard copy documents and digital media (e.g.
CD’s or DVD’s) shall be collected and returned by registered mail or physically delivered to the Government for destruction. Electronic files on automated information systems shall be deleted and the media sanitized to prevent the files from being recovered or restored.
I attest that I am familiar with, and will comply with the standards for access, dissemination, handling, and safeguarding of the information to which I am granted access as cited in this Agreement and in accordance with the guidance provided to me relative to the specific category of information.
I certify that I am aware that any unauthorized disclosure or failure by me to sufficiently identify CUI or material may result in damage to official relationships, monetary or other loss to individuals or firms, embarrassment to USSTRATCOM, and/or criminal prosecution.
I have read this Agreement carefully and my questions, if any, have been answered. I acknowledge that the briefing officer has made available to me any laws, regulations, or directives referenced in this document so that I may read them at this time, if I so choose.
