52.236-5 Material and Workmanship (Apr 1984)
(a) All equipment, material, and articles incorporated into the work covered by this contract shall be new and of the most suitable grade for the purpose intended, unless otherwise specifically provided in this contract. References in the specifications to equipment, material, articles, or patented processes by trade name, make, or catalog number, shall be regarded as establishing a standard of quality and shall not be construed as limiting competition. The Contractor may, at its option, use any equipment, C-89a

(b) The Contractor shall obtain the Contracting Officer’s approval of the machinery and mechanical and other equipment to be incorporated into the work. When requesting approval, the Contractor shall furnish to the Contracting Officer the name of the manufacturer, the model number, and other information concerning the performance, capacity, nature, and rating of the machinery and mechanical and other equipment. When required by this contract or by the Contracting Officer, the Contractor shall also obtain the Contracting Officer’s approval of the material or articles which the Contractor contemplates

Section 108. — PROSECUTION AND PROGRESS
04/20/18– FP-14
108.01 Commencement, Prosecution, and Completion of Work. Add the following:
Furnish at least 48 hours advance notice before changing the current work schedule. Work schedule changes that include additional shifts require 14 days’ notice.
Perform work under this contract according to the following:
(a) No onsite work can start until the contractor has secured an agreement with BNSF in accordance with the BNSF Overpass Agreement (See Section K) and SCR 107.01.
(b) Do not perform construction from Friday at 6:00 pm to Monday at 7:00 am.
(c) Limit site work prior to May 1, 2019 and after September 30, 2019 to a maximum of 10 hour work shifts, Monday through Friday, day light hours only unless otherwise approved the
CO.
(d) Do not perform construction operations on Pier 3, Span 4, or Abutment 2(shafts and cap) between October 1 and December 31 unless otherwise approved in writing from BNSF and approved by the CO.
(e) Do not perform construction operations between 6:00 p.m. Thursday and 6:00 p.m. Friday over the Birdfest /Bluegrass event. Contact the CO for schedule dates. In 2019 the event date is; October 5th and 6th.
(f) Limit work as provided in Section 107.
(g) Limit work as provided in Section 156.
(h) Open the new bridge to public traffic no later than February 28th, 2020 at noon.
(i) Complete Ground Improvements at Abutment 1, prior to constructing West Approach fills and Abutment 1 Drilled Shafts.
108.01A Labor. (Added Subsection).
Follow the requirements of FAR Clause 52.222-6 Construction Wage Rate Requirements.
Adjacent or virtually adjacent work sites, as used in FAR Clause 52.222-6, are defined to be work sites within ½ mile of the project. Application of Construction Wage Rate Requirements (Davis- Bacon Act) for work sites beyond ½ mile of the project will be determined by the CO.

156.04A Accommodating River Navigation Traffic During Work. (Added Subsection)
The contractor is responsible for compliance with US Coast Guard Bridge Permit (see Section H) and all applicable United States Coast Guard statutes, rules, regulations and guidance (hereinafter collectively referred to as “requirements”).
The contractor must develop and submit a work plan directly to the United States Coast Guard for evaluation and approval. In general, the work plan must provide adequate safety for the mariner and the reasonable needs of navigation. United States Coast Guard requirements do not allow the project to close or modify the current River Navigation channel without permission of the United States Coast Guard. . The contractor is responsible for determining how it will meet United States Coast Guard requirements. Allow a minimum of 20 days from the time the submitted work plan is deemed complete by US Coast Guard for review and approval.
