NOTICE TO BIDDERS
7/21/17–FP14
THIS PROJECT IS BEING SOLICITED AND AWARDED UNDER FP-14.
The FP-14 is a new release of FLH’s Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects. Carefully review the entire FP-14 as significant modifications have been made and new requirements added. Additionally, sections from the previous FP version may have shifted or been deleted.

The FP-14 is a dual unit document with U.S. Customary units being the primary unit shown. Metric equivalents are shown in parenthesis.
When submitting bids, drawings, calculations, and other construction documents, use only U.S. Customary units of measure, unless otherwise stated.
I. Project Location
General Location. The project work is located near Ridgefield, WA in Clark County.
Approximate Global Positioning System (GPS) coordinates for the beginning of the project are 45.807433, -122.740104.
Project Limits. Signs have not been erected to identify the project limits. No Government personnel will be available for show-me tours.
II. Pre‐bid Information.
GENERAL AND TECHNICAL QUESTIONS REGARDING PROPOSED WORK FOR
THIS PROJECT WILL BE ACCEPTED UNTIL CLOSE-OF-BUSINESS ON September 19, 2018 September 26, 2018.

“Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
“Subsidiary” means an entity in which more than 50 percent of the entity is owned—
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
(b) If the contractor reorganizes as an inverted domestic corporation or becomes a subsidiary of an inverted domestic corporation at any time during the period of performance of this contract, the Government may be prohibited from paying for Contractor activities performed after the date when it becomes an inverted domestic corporation or subsidiary. The Government may seek any available remedies in the event the Contractor fails to perform in accordance with the terms and conditions of the contract as a result of Government action under this clause.
(c) Exceptions to this prohibition are located at 9.108-2.
(d) In the event the Contractor becomes wither an inverted domestic corporation, or a subsidiary of an inverted domestic corporation during contract performance, the Contractor shall give written notice to the Contracting Officer within five business days from the date of the inversion event.
52.210-1 – Market Research (Apr 2011)
(a) Definition. As used in this clause-- “Commercial item and nondevelopmental item” have the meaning contained in Federal acquisition Regulation 2.101.
(b) Before awarding subcontracts over the simplified acquisition threshold for items other than commercial items, the Contractor shall conduct market research to--
(1) Determine if commercial items or, to the extent commercial items suitable to meet the agency’s needs are not available, nondevelopmental items are available that—
(i) Meet the agency’s requirements;
(ii) Could be modified to meet the agency’s requirements; or
(iii) Could meet the agency’s requirements if those requirements were modified to a reasonable extent; and
(2) Determine the extent to which commercial items or nondevelopmental items could be incorporated at the component level.
52.211-10 Commencement, Prosecution, and Completion of Work (Apr 1984) Alternate I (Apr 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than April 16, 2020 subject to such extensions as may be authorized. The time stated for completion shall include final cleanup of the premises.
The completion date is based on the assumption that the successful offeror will receive the notice to proceed by 11/19/2018 11/26/2018. The completion date will be extended by the number of calendar days after the above date that the contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.
52.211-12 Liquidated Damages—Construction (Sep 2000)
(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of: See Special Contract Requirements, Subsection 108.04.

52.233-4 Applicable Law for Breach of Contract Claim (Oct 2004)
United States law will apply to resolve any claim of breach of this contract.
52.236-1 Performance of Work by the Contractor (Apr 1984) (NOTE: This clause does not apply when award is made to other than the low bidder after applying the price preference for HUBZone small business concerns under FAR clause 52.219-4, in which case the percentage in clause 52.219-4 will control).
The Contractor shall perform on the site, and with its own organization, work equivalent to at least fifty (25) 25 percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.
52.236-2 Differing Site Conditions (Apr 1984)
(a) The Contractor shall promptly, and before the conditions are disturbed, give a written notice to the Contracting Officer of—
(1) Subsurface or latent physical conditions at the site which differ materially from those indicated in this contract; or
(2) Unknown physical conditions at the site, of an unusual nature, which differ materially from those ordinarily encountered and generally recognized as inhering in work of the character provided for in the contract.
(b) The Contracting Officer shall investigate the site conditions promptly after receiving the notice. If the conditions do materially so differ and cause an increase or decrease in the Contractor’s cost of, or the time required for, performing any part of the work under this contract, whether or not changed as a result of the conditions, an equitable adjustment shall be made under this clause and the contract modified in writing accordingly.
(c) No request by the Contractor for an equitable adjustment to the contract under this clause shall be allowed, unless the Contractor has given the written notice required; provided, that the time prescribed in paragraph (a) of this clause for giving written notice may be extended by the Contracting Officer.
(d) No request by the Contractor for an equitable adjustment to the contract for differing site conditions shall be allowed if made after final payment under this contract.
52.236-3 Site Investigation and Conditions Affecting the Work (Apr 1984)
(a) The Contractor acknowledges that it has taken steps reasonably necessary to ascertain the nature and location of the work, and that it has investigated and satisfied itself as to the general and local conditions which can affect the work or its cost, including but not limited to (1) conditions bearing upon transportation, disposal, handling, and storage of materials; (2) the availability of labor, water, electric power, and roads; (3) uncertainties of weather, river stages, tides, or similar physical conditions at the site; (4) the conformation and conditions of the ground; and (5) the character of equipment and facilities needed preliminary to and during work performance. The Contractor also acknowledges that it has satisfied itself as to the character, quality, and quantity of surface and subsurface materials or obstacles to be encountered insofar as this information is reasonably ascertainable from an inspection of the site, including all exploratory work done by the Government, as well as from the drawings and specifications made a part of this contract. Any failure of the Contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expense to the Government.

(b) The Government assumes no responsibility for any conclusions or interpretations made by the Contractor based on the information made available by the Government. Nor does the Government assume responsibility for any understanding reached or representation made concerning conditions which can affect the work by any of its officers or agents before the execution of this contract, unless that understanding or representation is expressly stated in this contract.
52.236-4 Physical Data (Apr 1984)
Data and information furnished or referred to below is for the Contractor’s information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.
(a) The indications of physical conditions on the drawings and in the specifications are the result of site investigations by: N/A..
(b) Weather conditions: N/A.
(c) Transportation facilities: N/A.
(d) Hydrological data consisting of flow rates, water surface elevations, velocities, and hydraulic permit information may be inspected at Western Federal Lands Highway Division, Contracts Section, 610 East Fifth Street, Vancouver, Washington 98661.

52.236-5 Material and Workmanship (Apr 1984)
(a) All equipment, material, and articles incorporated into the work covered by this contract shall be new and of the most suitable grade for the purpose intended, unless otherwise specifically provided in this contract. References in the specifications to equipment, material, articles, or patented processes by trade name, make, or catalog number, shall be regarded as establishing a standard of quality and shall not be construed as limiting competition. The Contractor may, at its option, use any equipment, material, article, or process that, in the judgment of the Contracting Officer, is equal to that named in the specifications, unless otherwise specifically provided in this contract.
(b) The Contractor shall obtain the Contracting Officer’s approval of the machinery and mechanical and other equipment to be incorporated into the work. When requesting approval, the Contractor shall furnish to the Contracting Officer the name of the manufacturer, the model number, and other information concerning the performance, capacity, nature, and rating of the machinery and mechanical and other equipment. When required by this contract or by the Contracting Officer, the Contractor shall also obtain the Contracting Officer’s approval of the material or articles which the Contractor contemplates

Special Contract Requirements Project: WA RRP RIDG 100(2), River S Bridge Replacement the center-point and a ground improvement element. Provide graphic logs and electronic CPT data to the CO for information only.
276.04 Ground Improvement Design Requirements. Design the ground improvement system according to the following requirements:
(a) Design the stone columns and aggregate piers to be a minimum average diameter of 20 inches, circular in cross-section, continuous, and plumb.
(b) Design the layout for a minimum area replacement ratio of 0.2. Design the outer edges of the aggregate portion of the ground improvement elements to be tangent with the plan boundaries of the ground improvement zone. Specify the minimum element diameter and center to center spacing. Determine the ground improvement element diameter and spacing by the following equations:
Rs = 0.785(D/S)2 Rt = 0.907(D/S)2
Where: Rs = area replacement ratio for a square pattern Rt = area replacement ratio for an equilateral triangular pattern D = diameter of ground improvement element (feet) S = spacing (center to center) of ground improvement element (feet)
(c) Design the spacing to be a uniform pattern (square or equilateral triangle).
(d) Design the reinforced/improved zone from the top elevation shown on the plans to the bottom elevation shown on the plans.
(e) Design the construction sequence to preserve slope stability due to the lateral deformation of the soils, if located near a free-face slope or stream bank.
(f) Design the ground improvement to avoid structures within the reinforced/improved zone and use cement-treated aggregate or other suitable means to avoid detrimental impact to the element. Design the row of stone columns or aggregate piers adjacent to the drilled shafts at Abutment 1 to be cement-treated to avoid damage to these ground improvement elements during drilled shaft excavation.
(g) If Timber Piles with PVD’s are proposed, design timber piles with PVDs to a maximum spacing of 3D on a triangular pattern, where D is the butt diameter of the pile at the top elevation of the ground improvement zone. Provide PVD attachment details and quality control procedures for confirmation of the survivability of the PVDs if attached whether predrilling is used or not. Provide details for cutoff and wood preservative treatment of cutoff piling adhering to subsection 715.02. When timber piles are installed separately from the PVDs, install all unattached PVDs before installing timber piles. Install unattached PVDs at the midpoint between adjacent timber piles.

Section 570. — OPTIONAL WORK PLATFORM
(Added Section)
Description
570.01 This work consists of the design, construction, inspection, maintenance and removal of an optional work platform for the construction of permanent structures. This work also includes temporary facilities used in construction that do not become part of the permanent structure. Limits of optional work platforms are shown on the plansin Section H.
Material
570.02 Select material consistent with the safety and quality required by the design assumptions.
Furnish factory fabricated components of vertical shoring towers according to FHWA-RD-93-033, Certification Program for Bridge Temporary Works.
Design Requirements
570.03 Design. Design optional work platform that will support loads imposed (including any and all loads from contractor equipment, forces and movements generated for construction activities, contractor bridge erection sequencing, installation of drilled shafts, placement of concrete, etc) and provide the necessary rigidity to produce the lines and grades shown in the plans for the final structure. Design optional work platform according to the AASHTO, Load and Resistance Factor Design (LRFD) Bridge Design Specifications or AASHTO, Guide Design Specifications for Bridge Temporary Works. Ensure the design load on manufactured devices is within the load rating recommended by the manufacturer.
Limit the calculated deflections of falsework and formwork members for cast-in-place concrete structures as follows:
(a) Falsework member vertical deflection: 1⁄360 of the span under the dead load of the concrete only, regardless of the fact that deflection may be compensated for by camber strips;
(b) Formwork: 1⁄360 of the span under the dead load of the concrete only or the lateral pressure of fluid concrete only; and
Submit foundation design calculations and other relevant foundation design data for approval.
Do not apply loads to existing, new, or partially completed structures in excess of the load carrying capacity of any part of the structure as determined according to AASHTO, LRFD Bridge Design Specifications.
570.04 Drawings. Submit drawings according to Subsection 104.03. Furnish design calculations and supporting data in sufficient detail to permit a structural and safety review of the proposed
