| DTFAAC-17-R-00013 | Section I – Contract Clauses | Contract Clauses incorporates Clause 3.6.4-5 Buy American- Steel and Manufactured Products (Jul 2010). We request that the Trade Agreement Act (TAA) be added and incorporated in this RFP language, for the following reasons: | The FAA is exempt from the FAR and as such has its own policy, guidance and clauses. The FAA uses Acquisition Management System (AMS). The TAA is not a clause in the AMS. | |
| 1. The BAA significantly limits competition among UPS manufacturers. | ||||
| 2.Incorporating the TAA language into the RFP would increase competition, allowing all major UPS manufacturers to propose technical solutions and pricing in response to the RFP | ||||
| 3. The TAA enables the FAA to consider both Original Equipment Manufacturers (OEMs) and System Integrators as potential Prime contractors. A Systems Integrator is vendor agnostic and offers the FAA the opportunity to choose the best equipment/solution among multiple UPS OEMs, a major advantage. | ||||
| 4. The TAA would enable the FAA to build a more agile, cross-trained technical staff, able to maintain and sustain UPSs from multiple OEMs. | ||||
| 5. The TAA would not limit the FAA to technology from only a select few OEM’s throughout the 10 year contract term, but instead offer the FAA the agility and flexibility to choose the best solutions from OEMs who may have advanced technologies, which the FAA desires. | ||||
| 6. Other Federal agencies, including the Department of Defense, the General Services Administration, and various agencies in the Intelligence Community incorporate TAA language in their RFP’s in order to provide procurement agility and flexibility to obtain better pricing through increased OEM selection. | ||||
| Therefore, in order to increase competition for the requirements covered by this RFP, we request that the FAA consider adding and incorporating TAA language to the BAA language in Section I of this RFP. |
