About this file
This document is an Exceptions Determination from a state procurement for Foreign Language Interpretation and Translation Services under Solicitation #BPM005633. The offeror, Topete Stonefield (TSI), submitted exceptions to specific contract terms and conditions outlined in the Request for Proposal (RFP). The contract involves foreign language interpretation and translation services to be delivered remotely, with TSI's team working from individual home offices rather than on-site at state facilities. The determination was issued on December 4, 2023, and documents the state's responses to TSI's proposed alternative language for two contract requirements.
Regarding the exceptions, the State accepted TSI's alternative language exempting Sexual Abuse and Molestation (SAM) insurance coverage given that no in-person services would be provided, with the provision that if in-person services are offered in the future, the required insurance must be submitted. However, the State denied TSI's exception to Addendum B requirement 1-3.5.22, which addresses network security compliance. TSI cited their lack of access to the State's network and the prohibitive cost of compliance as justification for the exemption request. The State required TSI to work with Homeland Security after contract award to confirm whether these security requirements are not applicable to their remote service delivery model. TSI accepted the denial of this exception and agreed to coordinate with Homeland Security to resolve the matter post-award.

| a. | The policy shall include coverage for Sexual Abuse and Molestation (SAM) if needed. |
Rationale:
There is no need for this insurance in the case of companies that do not provide their services in person.
TSI’s team does not work in the State’s premises. All of us work from our respective homes.
State Response

Alternative Language is accepted.
Please Note that if in-person services are ever offered, this insurance must be submitted.
TSI Response

Thank you very much.
We pledge not to provide our services in person.
Addendum B
| 1-3.5.22 |
| Alternate language: |
NA
Rationale:
TSI has no access to the State’s network.
We feel this requirement should not be enforced if the State’s security is not in jeopardy.
As a small business we cannot comply with these extremely expensive and unnecessary requirements.
State Response
Alternative Language is denied. Please work with Homeland Security after award to confirm these are not applicable.
TSI Response
We understand and accept that this exception has been denied and that we will work with Homeland Security after award, to confirm these requirements are not applicable.
Thank you!
