About this file
This is a Conformance Statements attachment to a Request for Proposal (RFP) for Foreign Language Interpretation and Translation Services issued by the Arizona Department of Administration State Procurement Office under Solicitation No. BPM005633. The document serves as the offeror's declaration of compliance with the solicitation requirements across three categories: Instructions to Offerors, Scope of Work, and Contract Terms and Conditions. Offerors must indicate whether they accept all requirements as written or take exceptions that must be documented in accompanying Attachment Supplements. The State of Arizona will not consider any exceptions unless formally designated on this form, and offers with exceptions may receive lower evaluation scores or be found non-susceptible for award under Arizona Administrative Code R2-7-C311.
Bromberg & Associates, LLC submitted this conformance statement indicating full compliance with Instructions to Offerors and Scope of Work requirements. However, the company took an exception to the Contract Terms and Conditions regarding Sexual Abuse and Molestation (SAM) insurance coverage required under Exhibit A, Section 1.3. The offeror requested an exemption from SAM coverage requirements, asserting that all services would be delivered remotely through document translation, voice-over, telephonic, and video remote interpreting with no direct face-to-face contact. The company noted that during the Q&A phase, the State confirmed that remote services could be exempted from this coverage requirement. The document was signed on October 20, 2023.

Exhibit A
1.3, 1.3.1, a.&b.
The policy shall include coverage for Sexual Abuse and Molestation (SAM). This coverage may be sub-limited to no less than $500,000. The limits may be included within the General
Liability limit or provided by separate endorsement with its own limits. If you are unable to obtain SAM coverage under your General Liability because the insurance market will not support it, it should it be included with the
Professional Liability.
b. Contractor must provide the following statement on their Certificate(s) of Insurance: “Sexual
Abuse and Molestation coverage is included” or
“Sexual Abuse and Molestation coverage is not excluded.”
Alternate language: The policy shall include coverage for Sexual Abuse and Molestation (SAM) for services having face-to-face encounters.
Rationale: Our services would be only remote, as we are providing document translation, voice-over, telephonic and video remote interpreting, so we would not have any direct contact with other parties.
During Q&A we asked if we could get an exemption from this coverage and the answer was “yes” for remote services.
