About this file
This is an exceptions determination document for solicitation BPM005633, Foreign Language Interpretation and Translation Services, issued by a state agency. Bromberg and Associates, LLC submitted an exception to the insurance requirements specified in Exhibit A, Section 1.3 of the Request for Proposal. The offeror provides document translation, voice-over, telephonic, and video remote interpreting services exclusively through remote delivery methods with no direct face-to-face contact with other parties. Accordingly, Bromberg and Associates requested an exemption from the Sexual Abuse and Molestation (SAM) insurance coverage requirement based on the absence of in-person service delivery.
The state accepted the offeror's alternative language exception on November 30, 2023, with a conditional requirement that Sexual Abuse and Molestation insurance coverage must be submitted if in-person services are ever offered in the future. The standard policy requirement mandates SAM coverage with minimum sub-limits of $500,000, which may be included within General Liability limits or provided through separate endorsement. The Certificate of Insurance must contain specific language stating either that SAM coverage is included or that it is not excluded, unless the insurance market does not support such coverage, in which case it may be included with Professional Liability coverage instead.

Exhibit A 1.3, 1.3.1, a.&b.
Alternate language:
The policy shall include coverage for Sexual Abuse and Molestation (SAM) for services having face-to-face encounters.
Rationale: Our services would be only remote, as we are providing document translation, voice-over, telephonic and video remote interpreting, so we would not have any direct contact with other parties.
During Q&A we asked if we could get an exemption from this coverage and the answer was “yes” for remote services.
The policy shall include coverage for Sexual Abuse and Molestation (SAM). This coverage may be sub-limited to no less than $500,000. The limits may be included within the General Liability limit or provided by separate endorsement with its own limits. If you are unable to obtain SAM coverage under your General Liability because the insurance market will not support it, it should it be included with the Professional Liability. b. Contractor must provide the following statement on their Certificate(s) of Insurance: “Sexual Abuse and Molestation coverage is included” or “Sexual Abuse and Molestation coverage is not excluded.”
