About this file

This is a Contract Affidavit document for the State of Maryland, effective July 2024, that establishes compliance requirements for businesses entering into contracts with Maryland state agencies and political subdivisions. The affidavit requires an authorized representative of the contracting business to affirm the entity's legal authority to execute the agreement, validate registration or qualification status with the Maryland State Department of Assessments and Taxation, and confirm good standing in both Maryland and the jurisdiction of organization. The document mandates compliance with Maryland's financial disclosure requirements under State Finance and Procurement Article 13-221, which require businesses receiving $200,000 or more in aggregate state contracts during a calendar year to file beneficial ownership information with the Secretary of State within 30 days of reaching that threshold. Additionally, the affidavit requires acknowledgment of Election Law Article, Title 14 provisions obligating contractors receiving $200,000 or more in governmental contracts to file political contribution disclosure statements with the State Board of Elections, covering the 24 months prior to contract award and continuing on a semi-annual basis throughout the contract term.

The affidavit further establishes comprehensive drug and alcohol-free workplace certification requirements under COMAR 21.11.08, requiring contractors to maintain substance-abuse-free work environments, publish workplace policies prohibiting drug and alcohol use, establish awareness programs, and implement sanctions for violations including employee termination or mandatory rehabilitation participation. Contractors must notify procurement officers within 10 days of employee drug or alcohol convictions and provide all contract employees with copies of the workplace policy. The affiant affirms that all representations made in the related Bid/Proposal Affidavit remain true and correct as of the contract execution date. The document requires the authorized representative's sworn declaration under penalties of perjury, with the affiant's signature and date certifying the truthfulness of all statements.
