About this file
This document is a Location of the Performance of Services Disclosure form issued by the State of Maryland in conjunction with Solicitation No. BPM057552. The form requires bidders and offerors to disclose whether they or their proposed subcontractors have plans to perform any services required under the resulting contract outside of the United States. At the time of bid or proposal submission, bidders must indicate whether they have or do not have plans to perform services internationally. If services are anticipated to be performed outside the United States, bidders must provide the specific location(s) where services will be performed and explain the reasons why it is necessary or advantageous to perform services outside the United States.
The State of Maryland permits contracting for services provided outside the United States under three conditions: the services are not available within the United States; the price of services in the United States exceeds by an unreasonable amount the price of services provided outside the United States; or the quality of services in the United States is substantially less than the quality of comparably priced services provided outside the United States. This disclosure requirement is mandated by Md. Ann. Code, State Finance and Procurement Article, 12-111, and became effective in July 2024. The disclosure must be signed and affirmed by an authorized representative of the bidder or offeror, who certifies that the contents are true to the best of their knowledge, information, and belief.
