About this file
This is an appendix to a Maryland state solicitation (BPM: 057552) issued by the Department of Budget and Management for Cobra and Billing services, effective July 2024, establishing Veteran-Owned Small Business Enterprises (VSBE) participation requirements. The document outlines mandatory procedures for contractors to achieve a specified VSBE participation goal as a percentage of total contract dollar value, with the exact percentage identified in the solicitation's Key Information Summary Sheet. Bidders must demonstrate good faith efforts to meet this goal by identifying specific work categories suitable for subcontracting, conducting outreach to certified VSBEs through the State's eMaryland Marketplace Advantage (eMMA) platform and other resources, soliciting VSBEs before bid submission, documenting outreach attempts, assisting with bonding requirements, and attending pre-bid meetings. Within ten business days of notification as the apparent awardee, the successful bidder must submit a completed VSBE Project Participation Statement, Utilization Affidavit, and Prime/Subcontractor Participation Schedule, or provide documented waiver requests with supporting good faith efforts documentation if unable to meet the goal.
Contractors must submit monthly VSBE participation reports by the tenth of each month following the reporting period, detailing paid and unpaid invoices from VSBE subcontractors over forty-five days old, and must require VSBE subcontractors to submit similar monthly reports identifying all payments received and outstanding invoices. Contractors must maintain records for three years after final contract completion confirming VSBE and non-VSBE subcontractor participation, work performed, and actual dollar values, with all subcontract agreements available for State inspection upon request. VSBE Prime Contractors may receive credit for up to one hundred percent of the VSBE goal for distinct, clearly defined work performed with their own workforce, with any remaining goal percentage met through verified VSBE subcontractors. The State retains the right to require final affidavit reports of all VSBE payments upon contract completion and before final payment and retainage release.

The Bidder/Offeror shall specify the percentage of contract value associated with each

As set forth in COMAR 21.11.14.07.D(2), when a verified VSBE firm participates on a Contract as a
Prime Contractor, a procurement agency may count the distinct, clearly defined portion of the work of the contract that the VSBE Prime Contractor performs with its own workforce towards meeting up to one hundred percent (100%) of the VSBE goal.
