About this file
This document is a VA VAAR 852.219-75 Certificate of Compliance for Limitations on Subcontracting, effective January 2023, which is a required federal contracting form used for VA solicitations.
The certificate establishes subcontracting limitations for small and disadvantaged business (SDVOSB/VOSB) contractors across three contract categories. For services contracts (excluding construction), contractors cannot subcontract more than 50% of the government payment amount to non-certified SDVOSBs or VOSBs. For general construction contracts, the limit is 85% of the government payment to non-certified small businesses, with materials costs excluded. For special trade construction contracts, the limit is 75% of the government payment to non-certified firms, also excluding material costs. The certificate requires contractors to acknowledge jurisdiction under 38 U.S.C. 8127(l)(2) and understand that false or fraudulent certification may result in criminal, civil, or administrative penalties, including prosecution under 18 U.S.C. 1001. Contractors must demonstrate compliance through invoices, subcontracts, and task performance documentation, and must cooperate fully with VA requests for compliance verification. The contracting officer may require compliance demonstrations at any time during contract performance. Offerors who fail to complete and submit the signed certification with their bid, quotation, or proposal will be deemed ineligible for award.
