About this file
This is a federal contracting provision template (FAR 52.219-1) for small business program representations required in solicitations.
The provision establishes definitions and representation requirements for various small business categories including small business concerns, women-owned small business (WOSB), economically disadvantaged women-owned small business (EDWOSB), service-disabled veteran-owned small business (SDVOSB), HUBZone small business, and small disadvantaged business concerns. For this specific acquisition, the North American Industry Classification System (NAICS) code is 541350 with a small business size standard of $11.5 Million. Nonmanufacturer small businesses are subject to a 500-employee threshold, or 150 employees for information technology value-added resellers under NAICS 541519, when the acquisition is set aside for small business above the simplified acquisition threshold, uses HUBZone price evaluation preference, or is an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award.
Offerors must represent their status as small business concerns and identify participation in joint ventures complying with applicable regulations. The provision requires representations regarding WOSB, EDWOSB, SDVOSB, and HUBZone joint venture status, with offerors required to enter names and unique entity identifiers of all joint venture parties where applicable. The provision includes a notice section warning that misrepresentation of business status to obtain preference program contracts results in criminal penalties (fine and imprisonment), administrative remedies including suspension and debarment, and ineligibility for future Federal programs.
