About this file
This is a federal contracting provision establishing small business program representations required for federal contract solicitations. The provision applies to acquisitions in NAICS code 541350 with a small business size standard of $11.5 Million. Offerors must represent their status as small business concerns and identify whether they qualify under various small business programs including women-owned small business (WOSB), economically disadvantaged women-owned small business (EDWOSB), service-disabled veteran-owned small business (SDVOSB), and HUBZone small business concerns. Each category has specific certification and ownership requirements defined in the Code of Federal Regulations.
Offerors must complete representations indicating whether they are small businesses, small business joint ventures, or qualify under any of the specified small business program categories. For nonmanufacturer concerns not on construction or service acquisitions, a 500-employee size standard applies, or 150 employees for information technology value-added resellers under NAICS 541519, if the acquisition is set aside for small business above the simplified acquisition threshold, uses HUBZone price evaluation preference, or is designated as an 8(a), HUBZone, SDVOSB, EDWOSB, or WOSB set-aside or sole-source award. The provision includes statutory notice provisions under 15 U.S.C. 645(d) establishing penalties including fines, imprisonment, suspension, debarment, and ineligibility for program participation for misrepresenting business status to obtain preference contract awards.
