About this file

This document is a Supplementary Conditions attachment for the Brevard County Solid Waste Management Department's Cell 3 Landfill Base Construction contract at the South Landfill Central Disposal Facility in Cocoa, Florida. The supplementary conditions amend the standard general conditions of the construction contract and establish operational requirements for the contractor performing work at the Central Disposal Facility (CDF). Key operational requirements include that the contractor's Site Supervisor must be on-site at all times when work is being performed, normal working hours are defined as 7:30 a.m. to 5:30 p.m., Monday through Saturday, and any work outside these hours requires written request at least 48 hours in advance. The project encompasses construction of a Class I landfill base liner system covering approximately 52 acres, with a pre-bid conference scheduled for February 12, 2026, a question deadline of February 26, 2026, and a revised bid submission deadline of March 31, 2026, with substantial completion required 730 days from Notice to Proceed.

The supplementary conditions impose specific restrictions and cost allocations for the CDF environment. Overtime work by the Resident Project Representative (RPR) and County Representative is compensable at $125 per hour and shall be deducted from monthly payments due the contractor, with the RPR preparing weekly overtime summaries. The contractor must ensure daily CDF operations are not interrupted for any reason by contractor activities and must notify all employees and subcontractors that County staff vehicles, solid waste delivery trucks, and County rolling equipment have rights-of-way at all times. Prohibited activities at the facility include consuming alcohol, possessing or using illicit drugs, fishing, hunting, and smoking. The contract requires the contractor to maintain comprehensive insurance coverage including general liability of $1,000,000 combined single limit, performance and payment bonds equal to 100% of contract price, and a 25% maintenance bond, with liquidated damages assessed at $2,500 per calendar day for missed milestone or completion deadlines.
