About this file

This is Addendum 5 to the Invitation to Bid issued by Brevard County Solid Waste Management Department for Cell 3 Class I Landfill Base Liner Construction at the South Landfill Central Disposal Facility in Cocoa, Florida (Bid# B-7-26-11). The addendum supplements the original bid package and must be acknowledged by all prospective bidders; bids submitted without the required acknowledgement will be deemed non-responsive. The addendum establishes critical operational requirements and supplementary conditions governing contractor performance, including oversight by a County Representative and Registered Professional Representative (RPR). The bid opening date has been extended to Tuesday, March 31, 2026 at 11:00 a.m., as referenced in Addendum 2. The contract covers approximately 52 acres of landfill base liner construction requiring all labor, materials, equipment, and services necessary for completion, with substantial completion required 730 days from Notice to Proceed.

Addendum 5 establishes supplementary conditions that significantly impact project execution and cost management. Overtime work is compensable at $125 per hour for work outside normal hours (7:30 a.m. to 5:30 p.m., Monday through Saturday) and is deducted from monthly payments; however, Sunday work required by the County to avoid interference with landfill operations is exempt from overtime charges. The contractor's Site Supervisor must be onsite at all times during work performance, and the contractor must ensure no interruption to daily CDF operations and maintain awareness of County vehicle and equipment right-of-way. Strict site conduct rules prohibit consuming alcohol, possessing illicit drugs, fishing, hunting, and smoking. The County reserves discretionary authority to permit price adjustments for unexpected material cost fluctuations during the pre-construction phase, limited to increases in resin costs reflected in HDPE geomembrane, HDPE pipe, and Composite Drainage Net unit costs, with the contractor required to provide certified price quotes and manufacturer correspondence as documentation. Any approved price adjustments exclude overhead or profit markup from subcontractors or contractors, though increases to insurance and bond costs may be considered if applicable.
