I. Contracting Activity.
5th Contracting Squadron,165 Missile Ave, Minot Air Force Base (AFB), ND
II. Nature and/or description of the action being processed.
The 5th Civil Engineer Squadron has submitted a request for the brand name procurement of Veeder Root TLS-450PLUS Automatic Tank Gauge System and related accessories and services. The proposed contract type is firm-fixed-price purchase order using FAR part 13 procedures. The existing Veeder Root 350PLUS is outdated and must be replaced with the Veeder Root 450PLUS to provide accurate and reliable monitoring of fuel levels and leak detection in underground storage tanks. The system continuously monitors and provides real-time alerts to prevent fuel loss, environment contamination, and ensure compliance with EPA regulations 40 CFR Part 280.
III. Description of supplies/services required to meet agency needs.
The contractor must provide all labor, equipment, supervision, fuel, transportation and material necessary to execute and satisfy the requirements. The work shall include but not limited to replacement of the existing Veeder Root 350/350PLUS fuel monitoring systems with the new Veeder Root 450PLUS systems. Work will be performed at 5 Missile Alert Facilities (MAFs) and 50 Launch Facilities (LFs) with 2 options for an additional 10 MAF's and 100 LFs to cover the entire missile complex.

IV. Statutory authority permitting other than full and open competition.
The statutory authority that permits awarding this contract using other than full and open competition is FAR 13.501(a), 41 U.S.C. 1901, which allows for acquisitions conducted under simplified acquisition procedures for brand name purchases over the simplified acquisition threshold.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The Veeder Root possesses unique features essential to the MAFs and LFs which have been vetted by the Air Force Nuclear Weapon Center (AFNWC). The system allows for remote monitoring and analysis of fuel data from multiple sites, providing a centralized view of our fuel operations. Additionally, per AFGSCI 32-1005 (dated Feb 2019) para 1.3.
and 1.4., all materials and equipment must meet a nuclear hardness test to qualify for areas that control part of the weapon system. AFGSC/A4C and AFNWC have authorized and validated that the brand Veeder Root has passed this criteria of hardness test and configuration control.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Veeder Root is commercially available and is not specific to government requirements. Market research identified numerous vendors in the commercial marketplace that can fulfill this requirement. A synopsis is required per FAR 5.201 and 41 U.S.C. 1708 and will be posted as a combined synopsis/solicitation on the Government point of entry via SAM.gov.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Price reasonableness will be determined through analyzing a comparison of competitive quotes submitted in response to the solicitation, an examination of previously proposed prices for similar items, a review of relevant government contracts, and a comparison to the IGE.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
The most appropriate NAICS code for this acquisition is 334519 - Other Measuring and Controlling Device Manufacturing. In researching the vendor pool, market research was conducted through FPDS-NG, GSA Advantage, SAM.gov, and contacting local vendors that are certified technicians for the Veeder Root. FPDS-NG identified numerous Air Force contracts awarded for Veeder Root Fuel Monitoring System which identified these acquisitions were competed under Simplified Acquisition Procedures as a total small business set-aside with 10+ offers received. Market research search was conducted on the Small Business Administration Dynamic Small Business Search which identified 200+ small business vendors that are certified under this NAICS. As a result, it's reasonable to expect 2 or more offers will provide competitive quotes and will be 100% small business set-aside.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
Other brands are capable of providing similar parts; however, they do not meet the configuration control requirements and hardness tests in accordance with AFGSCI 32-1005. There are many distributors of the Veeder Root brand that can fulfill this requirement.
X. List of any sources that expressed, in writing, an interest in the acquisition.
We reached out to 58 small business vendors and 2 responded expressing interest in the acquisition. O'Day Equipment, LLC out of North Dakota is registered in SAM, doesn't have exclusions, and is registered as a small business. They are certified technicians for Veeder Root equipment and software. The other response was received from Granite Group, LLC out of South Dakota who is registered in SAM, doesn't have active exclusions, and is registered as a small business.
They specialize in contract work, but specified they would be able to obtain certification to install Veeder Root equipment.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
Although this J&A is for brand name Veeder Root product, quotes will be solicited on SAM.gov to reach multiple certified Veeder Root distributors to ensure we obtain the most competitive price.
