SITE SECURITY

ATTACHMENT 20

PART 1 GENERAL

1.1 Site security and entry shall follow the procedures in this section of these Specifications.

1.2 The Contracting Officer or designated representative reserves the right to deny access to the site to any Contractor personnel who does not conform to security and safety regulations. If access is denied for safety or security violations, the Government shall incur no additional cost, and Contractors shall still be required to execute contracts in the period of performance.

1.3 Ensure all contract personnel protect all Government property, equipment and comply with all Air Force physical security regulations, directives, and procedures while on Government property.

1.4 Upon entering and exiting a restricted area, all individuals, hand-carried items, and vehicles will be subject to inspection for readily detectable contraband items IAW the Minot AFB Integrated Defense Plan, 31-1. It is the responsibility of the vehicle and/or equipment operator to present items and vehicles to be searched to include ensuring exterior bins and compartments are accessible.

1.4.1 Only authorized personnel are allowed to take photographs on site.

1.5 Submit the Contractor Entry Authorization List (EAL) according to the Contract and as required elsewhere in the Specifications. All Prime and Sub-Contractor EAL’s need to be completed prior to the start of scheduled work on-site, or the Contracting Officer will refuse to allow construction to start. The EAL Request template will be provided within 30 days prior to the start of on-site work. After the initial EAL approval any/all changes will be at no cost to the Government. The Contracting Officer will have the final say for any/all considerations. All EAL supporting documents shall be submitted to the follow email 5CES.CEM.EAL@us.af.mil for processing.

1.6 The Contractor and Government escort/inspector on-site will be responsible for on-site security. The Prime Contractor shall be responsible for Contractor personnel, equipment, and the accuracy and completeness of EAL data.

1.7 All Contractor personnel will be restricted to the project construction area within the site and to those USAF controlled areas outside the site fence, designated by the Government Inspector. All activities of the Contractor personnel, while on site, shall be conducted in strict compliance with all site security.

1.8 During all on-site work it is Contractor personnel responsibility to remain in visible contact with the escort/inspector. Failure to remain within the area being monitored will be a serious breach of security and safety regulations. Take all necessary actions to ensure compliance. The Contracting Officer or their designated representative reserves the right to deny entry to any Contractor personnel who refuse to conform to security and/or safety regulations. Delays resulting from such entry denial shall not result in any cost to the Government.

1.9 Missile Field Entry Authority List (EAL)

1.9.1 Thirty (30) working days prior to the initial commencement of work, the contractor must submit to the Contracting Officer each employees’ personal identification information along with a legible photocopy of each employee’s government issued REAL ID, credential photo ID and a summarized list of mission essential contractor owned/leased/rented vehicles. This information shall be used to prepare the contractor’s EAL. Foremen, supervisors, and superintendents must be identified as part of employee information. Identify which personnel on the EAL need to enter restricted areas. The EAL will be used to accomplish the restricted area entry authority list (EAL). Each Contractor will need to provide information for their own company EAL. Keep the number of personnel to a reasonable number to accomplish the required project. The Contracting Officer shall deny any EAL requests with excessive numbers of workers. The contractor must submit a valid REAL ID federal/state government issued photo identification and requested EAL information to the Contracting Officer at least thirty days prior to work. All changes, additions, and/or deletions must be sent to the Contracting Officer in writing.

1.9.2 All Contractors personnel listed on the EAL will be put into the National Crime Information Center (NCIC) database and the Defense Biometric Identification System for a background check in accordance with United States Air Force directives. Unfavorable results from the background check will require the Government to start the EAL over with the individuals being denied access to Minot AFB, MAFs, and LFs. Unfavorable results are listed in AFI 31- 113 and include, but are not limited to, individuals that are determined to fall into one or more of the following categories: those having outstanding wants or warrants, sex offenders, violent offenders, drug possession with intent to sell, drug distribution, those who are on probation, and those who are in pre-release program. The definition of sex offender and violent offender can be found at North Dakota Code Annotated § 12.1c20. Security Forces (SF) is allotted five days to complete these checks. If an employee on an EAL terminates his or her employment or is involved in an incident resulting in an unfavorable result, including, but not limited to those identified above, immediately notify the Contracting Officer in writing.

1.9.3 REAL I.D. ACT Individuals, who do not possess a driver’s license or identification card compliant with the REAL ID Act and do not possess an acceptable alternate identification credential, must be denied access.

One form of the following documents will be accepted as proof of identity. (T-0) The document must be a picture ID, and all documents must be unexpired and valid. The goal is to minimize, within acceptable risk, the potential of improper screening and access credential issuance. NOTE: The information in section 3.7.6.1. – 3.7.6.15. is from Handbook for Employers, Instructions for Completing Form I-9 (Employment Eligibility Verification Form), U.S. Department of Homeland Security, U.S. Citizenship and Immigration Services and REAL ID Act of 2005 Implementation: An Interagency Security Committee Guide

· US Passport

· Permanent Resident Card/Alien Registration Receipt Card (Form I-551)

· Foreign passport with a temporary (I-551) stamp or temporary (I-551) printed notation on a machine-readable immigrant visa

· Employment authorization document that contains a photograph (Form I-766)

· Driver’s License that current and meets REAL ID Act contains a photograph and biographic information such as name, date of birth, gender, height, weight, eye color, and address.

· Identification cards issued by Federal, State, or local government agencies, provided they contain photograph and biographic information such as name, date of birth, gender, height, eye color, and address.

· U.S. Coast Guard Merchant Mariner Cards/Credentials

· PIV or Federally Issued PIV-1 Cards (Personal Identification Verification) issued by the Federal Government

· PIV-I card (Personal identification verification-Interoperable Issued by Non-Federal Government entities’

· DHS “Trusted Traveler Cards” (Global entry, NEXUS, SENTRI, FAST).

· Merchant Mariner card issued by DHS/ United States Coast Guard (USCG).

· Border Crossing Card (Form DSP-150).

· U.S. Certificate of Naturalization or Certificate of Citizenship (Form N-550) and U.S. Permanent Resident Card (Form I-551).

· U.S. Refugee travel document or other travel document or evidence of immigration status issued by DHS containing a photograph.

· Foreign Government Issued Passport.

1.9.4 The Contractor’s employee information must show each of the employees’ following information:

· Full name exactly as it appears on the REAL ID submitted for use in conjunction with the contractor’s EAL

· Date of birth (DOB)

· Full Social Security Account Number (SSAN)

· Employees’ control number (exactly as it appears on the REAL ID that was submitted for use in conjunction with the contractor’s EAL)

· Provide a legible copy of the individual’s REAL ID Act approved picture ID, see 1.9.3

· Employees work and home phone numbers

1.9.5 The Contractor’s summarized vehicle list must include:

· Vehicle Make

· Vehicle Model

· Vehicle Year

· Vehicle Primary Color

· Vehicle License Plate Number (State of Issue and Number). If there is no license plate, provide the vehicle identification number (VIN) or Serial Number.

· Owned/leased/rented status must be made clear.

· Mission essential equipment (skid-steers, bobcats, forklifts, loaders/backhoes, and any equipment being transported), trailers, and materials need not be listed individually on the EAL.

1.10 SITE ENTRY/EXIT

1.10.1 Missile Alert Facility (MAF) and Missile Launch Facility (LF)

1.10.1.1 Site Entry:

1.10.1.1.1 In order to gain entry inside the security fence of a Missile Alert Facility (MAF) or a Missile Launch Facility (LF), Contractor personnel and mission essential contractor owned/leased/rented vehicles (needed to accomplish the contracted work) must be listed on an authorized EAL, as submitted to the Government, identified by escort personnel, and physically escorted on-site by the authorized government escort/inspector official. Each Government Escort is only allowed to escort six personnel at one time. If the Contractor plans to have more than six personnel on-site at one time the Contractor needs to notify Missile Engineering, no later than 9:00 A.M. on Tuesday of the week prior to the scheduled workweek to ensure extra escort personnel. No privately owned vehicles (POVs) shall be permitted on the MAFs or LFs. If not coordinated the delay will not be considered a government delay and at no cost to the Government.

1.10.1.1.2 Government personnel will brief control methods and actions taken to enforce control in and around secure areas. Contract personnel may be removed from secure areas if classified material or information is present. Follow-up briefings will be given to all personnel throughout the contract period.

1.10.1.1.3 All Contractor personnel shall be restricted to the area within the site and to those USAF controlled areas outside the site fence as designated by the Government escort/inspector. All activities of the Contractor personnel, while on site, shall be conducted in strict compliance with all site security. Notify the escort official prior to departing a site.

1.10.1.1.4 Upon arrival at the MAF or LF sites, park on the access road at least fifty feet (50') from the site security gate, remain in the vehicle and wait for the arrival of the escort.

1.10.1.1.5 Upon arrival, the escort/inspector will identify all Contractor personnel. All Contractor personnel entering the site must present to the escort the government issued ID card that matches the EAL for all personnel entering the site.

1.10.1.1.6 Processing onto and off the MAF or LF will require approximately thirty (30) minutes and will not be considered delay time (see GOVERNMENT DELAYS below).

1.10.1.1.7 Contractor personnel can be subject to personal search upon entrance to the site.

1.10.1.1.8 Commercial or company vehicles will be allowed access to the site provided the vehicle is licensed to the company and not to the individual. Rental equipment will be allowed access to the site provided the rental companies’ emblems are permanently attached to the sides of the vehicles. Vehicles used for transporting tools and equipment will be permitted on site. The Government escort/inspector will specify the parking location of the vehicles. Vehicles used exclusively for personnel transportation will not be permitted on site but may be parked off the fenced site. Vehicles must be on EAL to enter site.

1.10.1.1.9 Vehicles may be searched upon entering and leaving the MAF or LF. Contractor vehicles and equipment will be searched by Air Force personnel. Exterior bins and compartments shall be accessible for inspection. Primary emphasis of the searches will be placed on locating large obviously explosive devices, unusual objects, intruders, and other objects of suspicious nature.

1.10.1.1.10 Personnel are authorized to bring personal and government cell phones on MAF. The LF is a Restricted Area, no personal cell phones are allowed on-site. This will be briefed by the escort official prior to entry onto the site. Contractor personnel are not authorized to use Bluetooth or camera function on phones.

1.10.1.2 Site Exit

1.10.1.2.1 Notify the escort official prior to departing the site. At this time, personnel and vehicles may be searched.

1.10.1.2.2 Processing off site will take up to thirty (30) minutes and shall not be considered delay time (see GOVERNMENT DELAYS below).

1.11 WORK AREA RESTRICTIONS DURING AIR FORCE OPERATIONS

1.11.1 Contractor personnel may be required to leave the area(s) or stop working and relocate within the area during Air Force inspections, real world incidents, and exercises. For certain Air Force actions, contractor personnel will be prohibited from entering specified areas. If personnel are already in these area(s), they may be allowed to relocate or may be required to exit the area(s) entirely. During certain actual exercises and investigations, the contractor and sub-contractor personnel will be under increased surveillance although they are not working near the area affected. If the contractor personnel are not involved in the investigation, these personnel may continue with their work.

1.12 GOVERNMENT DELAYS

1.12.1 If the Contracting Officer determines that the contractor incurred a work stoppage or security delay and the stoppage or delay was caused by the government, the contractor will be paid for lost progress at the rate in the proposal schedule. The Contractor shall allow 60 minutes each day for personnel to process on and off the work site that will not be considered delay time. This hourly rate will also apply to Government-caused work stoppages when the entire work crew will be asked to evacuate the work area. All site access delays must be reported by the Contractor, in writing/email, to the Contracting Officer within 24 hours of occurrence. All Government-caused work stoppages must be documented by Government officials and Contractors at the time of occurrence and reported by the Contractor. The Prime Contractor must report all security delays to the Contracting Officer within 48 hours.

1.12.2 Should work at a site be completed and the Contractor mobilizes to another site during working hours, the time it takes the escort to process off the completed site, drive to the next site following the Air Force designated primary route at the prescribed driving speeds (25 MPH on gravel and as posted all others), and process onto the next site, shall not be considered delay time.
