DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval for Single Source Awards IAW FAR 13.106-1 for Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

1. Contracting Activity:

Department of Veterans Health Administration (VHA), Program Contracting Activity Central (PCAC) on behalf of VISN 01, VHA West Roxbury Healthcare System Engineering Service.

The proposed procurement is for a Seed Project solicited with the Request for Proposal (RFP) #36C77624R0098 for the VISN 1 Multiple Award Task Order Contract for construction projects in VISN 1. This Justification and Approval is applicable to the Non-recurring Maintenance Construction Project 523A4-20-205, Expand Emergency Department, at VHA West Roxbury Healthcare System. This project is budgeted for and is on the FY25 Operating Plan and a 2237 will be provided at time of award.

2. Brief Description of Supplies/ Services Required and the Intended Use/Estimated Amount:

This justification is to support the construction of an Emergency Department expansion at the VHA West Roxbury campus. This task order will be awarded as a firm-fixed price contract. This justification is for other than full and open competition for the procurement of certain construction materials necessary during this construction project. The VAAR Construction magnitude for the entire project is between $2,000,000 and $5,000,000.

The scope of the project includes everything necessary to complete the construction of the Emergency Department expansion. There are three brand name items listed for which the VA is not able to accept equal or alternate items. The total of the brand name items equals The breakdown of these items is listed below.

The use of a particular brand name for the items listed below accommodates standardization of these items throughout the campus.

a. Door Hardware

i. Corbin Russwin

iii. VA West Roxbury Engineering Building Standard for Keyed Security System.

c. Direct Digital Control Building Management System including components

i. TRANE Summit Tracer Building Technology Direct Digital Control HVAC Building Management.

iii. This system is VA West Roxbury Engineering’s Building Standard for the Direct

Digital Control HVAC Building Management System.

3. Unique Characteristics That Limit Availability to Only One Source, with the Reason No Other Supplies or Services Can Be Used:

These items have been standardized throughout the West Roxbury VAMC. Installing a different manufacturers’ system are not compatible with the existing system, in most cases will not function properly, therefore compromising patient health and safety. The specific impact for not using the brand name items is listed below:

a) Corbin Russwin Door Hardware – Corbin Russwin is the existing VA West Roxbury Engineering building standard for door locks that is installed and operating campus wide at the West Roxbury VAMC. This is a single master key system and Corbin Russwin products are compatible with the Kaba Peaks keying system used on the West Roxbury VAMC campus;

other manufacturer’s door locks may not operate properly or operate at all with the Kaba Peaks keying system. As the West Roxbury VAMC continues to move toward consolidation, patient and staff safety concerns remain at the forefront of design decisions when selecting systems. To change to a different locking system would require numerous master keys potentially causing delays in accessing all areas of the campus in the event emergencies.

This could result in the VA being unable to meet patient and staff safety requirements.

Therefore, only this manufacturer’s products are acceptable, no substitutions.

b) Kaba Peaks Lock Cylinders with Removable Cores – Kaba Peaks Lock Cylinders with Removable Cores is the existing VA West Roxbury Engineering building standard for door lock cylinders that is installed and operating for the keyed security system campus wide at the West Roxbury VAMC. The Kaba Peaks Locks only work with Corbin Russwin Door Mounting System (noted above in section a). Other manufacturers cannot make the Kaba Peaks lock cylinder and would not be compatible with the existing keyed security system.

The West Roxbury campus has an existing locksmith with inventory of 6-pin LFIC; for the new door lock cylinders with removable cores on this project be coordinated with the existing locksmith and inventory, the door lock cylinders with removable cores must be Kaba Peaks 6-pin LFIC door lock cylinders with removable cores. The Kaba Peaks keys cannot be duplicated and can only be replaced by the VA locksmith, therefore maintaining high level of security within the keyed system, which is important for patient safety. Therefore, only this manufacturer’s products are acceptable, no substitutions.

c) TRANE Building Technology Direct Digital Control HVAC Building Management System including components - TRANE Building Technology Direct Digital Control (DDC). HVAC Building Management System is the existing building management control system installed and operating campus wide at the West Roxbury VAMC. Any products to be used on the existing HVAC Building Management System must interface with the existing system. To minimize the technical risks of ensuring compatibility among the component parts and integration of the entire DDC system with the campus wide system, the system and components installed in this project should be provided by the same manufacturer as that of the campus wide system; other manufacturer’s components may not operate properly or operate at all on the existing system. The VA has existing service contracts with TRANE.

Using products from other manufacturers could potentially cause compatibility issues, disrupt the existing system's functionality, and potentially void the existing warranty with Trane, which is crucial for ensuring optimal patient care facilities. By adhering to Trane products, the VA can guarantee seamless integration with the existing system, minimizing technical risks and maintaining the reliability necessary for patient comfort and safety. Therefore, only this manufacturer’s products are acceptable, no substitutions.

4. Description of Market Research Conducted and Results or Statement Why It Was Not

Conducted:

Specific market research on other products was not conducted in association with this request because the products to be sole sourced were previously obtained through full and open competition procedures and are now integral parts of existing facility systems. Approval of the items as brand name only is critical for the overall efficiency of the completed project and the entire West Roxbury VAMC facility.

Market research was conducted to ensure all requirements of the Buy American Act (BAA) are complied with for each of these products. These products are all commercial off the shelf products.

See attached documentation for further information.

- For the Corbin Russwin Door Hardware, these items are manufactured in Berlin, Connecticut, USA. Therefore, there are no BAA concerns. See attached manufacture brochure.

- For the Kaba Peaks Lock Cylinders with Removable Cores, these items are manufactured in the

USA. Therefore, there are no BAA concerns. See attached manufacture documentation.

- For the TRANE Building Technology Direct Digital Control, TRANE provided the attached memo outlining BAA compliance for all controllers. Standard controllers are made in the USA. The AE subsequently confirmed that the TRANE items are BAA compliant.

5. Requirements Certification: I certify that the requirement outlined in this justification is a Bona

Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.

6. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief

Peaks Preferred is the most cost effective, application flexible, patented end-user key control system available. Two projections near the key bow, called “peaks” are part of the utility patents safeguarding the key blanks. The “peak” operates the patent pin stack. Since the uncut key blank itself is patented, Kaba con-trols blank manufacture and distribution.

All Peaks key blanks are marked with a unique identification number. The Kaba key control contract and this manual specify certain key control procedures. Breach of contract or failure to abide by factory key records policies can result in loss of the product line.

Contracts specify that:

1. The blank ID number may not be removed, stamped-over, or altered in any way;

2. Parties under contract may not duplicate any keys bearing a blank ID number different from their own;

3. Key blanks may not be sold, lent, or given away;

4. Proper key records must be kept and authorization procedures observed.
